111.01. Created. There ' s h�reby created a St. Paul

consist of five member , who�^ shall serve without
compensation, appointed b the m�yor with the consent
of the city council. Ini ially, wo members shall be
appointed for a term of t ree year�� each, two members
shall be appointed for a t rm of two �ears each and one
member shall be appoint d for a t�rm of one year.
Thereafter , members' ter s shall be or three years
until their successors are appointed an�qualify.

determined by the ard if it finds the complaint

purpose of harassm n . 'Additionally, the board
shall have t�ie authorif` to establish a filing fee
to be paid when a co la" nt is filed.

(2) The board may requi e thaC��, forms be developed and
prepared for the omplai'�,ts required by this
chapter. The city c erk sha�.,� assist the board in
developing and prepa ing saidh'��forms .
(3) In cooperation with the city e�erk' s office, the
board shall compile nd maintain °�,a current list of
all reports and s atem ents fi�:,ed pursuant to
Chapter 28 of the S . Paul Legis���tive Code and
Chapter 24 of the St Paul Administ��tive Code.
(4) The board shall investigate whether s�atements and
reports have been fi ed within the tic�es required
by Chapter 28 of the St. Paul Legislati�re Code and
Chapter 24 of the St. Paul Administrativ� Code.
(5) The board shall revi w reports for comp��eteness
and internal consist ncy and independently; verify
entries on cam paign isclosure reports and. other
forms on an arithm tically randomly selected
basis.

appropriate , recommend to the city council

hearing on each complai t not previously dismissed and
sha11 rule thereon; prov ded such hearing shall be held
and 'rulings made within ten days following the date a
com pl`aint is referred or within half the time from the
date tMe complaint is referred to it to the date of the
election,, whichever is 1 ss .
The chair''.,of the board ay obtain subpoenas from the
district court to compe the attendance of witnesses
and the prodUction of do uments at any hearing .
Upon completion of a hearing the board shall, within 72
hours, issue a iaritten etermination stating whether
there has been a viola ion of law and a statement

which the determin'�tion is based; provided, however ,
that where a com pl��int relates to an election to be
held within seven day� o the filing of the complaint,
the board shall make d,, ritten determination within

Election Board to Ethical Practic s Board, by including reports and
statements filed under Chapter 24 of the Administrative Code as items
to be reviewed by the Board by a lowing the Board to make
recommendations regarding the Ci `s code of ethics, by allowing
citizens to file complaints with the Board for alleged-violations of ,
Chapter 29 of the Legislative Co e and Chapter 24 of the Administrative
Code, and by adding an intent se tion stating the manner in which this'

shall have the auth rity to establish a filing fee
to be paid when a c m laint is filed.
(2) The board may requi e that forms be developed and
prepared for the com plaints required by this
chapter. The city lerk shall assist the board in
developing and prep ring said forms.
(3) In coopexation wit the city clerk's office, the
board shall com pile and maintain a current list of
all reports and statements filed pursuant to
Chapter 28 of the t. Paul Legislative Code and
Chapter 24 of the S . Paul Administrative Code.
(4) The board shall inv stigate whether statem ents and
reports have been filed within the times required
by Chapter 28 of`.th St. Paul Legislative Code and
Chapter 24 of the'°•,S . Paul Administrative Code.
(5) The board shall re iew reports for completeness
and internal consi t`�ncy and independently verify
entries on campaig �e�isclosure reports and other '
forms on an arit me ically randomly selected
basis.
(6) The board shall mak ong ing reviews of and, where
appropriate , rec mmen to the city council
am endm ents to ordinance relating to election
regulations and may make re ommendations regarding
the city' s code of thics. �
(7) Pursuant to St. P ul Legis�ative Code Section
28. 0�3 , Subd . 4 (7 ) , the boa�Xd shall have the
authority to exe pt an indi'Vidual , political
parties , politic 1 com mittee.s , and personal
campaign committee from the fil.ing requirements
of St. Paul Legisl tive Code Section 28.QJ3 , Subd.
4.

council and the ayor upon completisn of the
board' s findings r lating to (3) , (4) , and (5) of

That Section 111.05 of t e St. Paul Administrative Code be
and the same hereby is amended to read as follows :
"Section 111 .05. Complai t and Hearings.
Subdivision 1. Filing. Subject to the limitation set
forth in tion 11.411.3 f this chapter, �any resident
of the city or the city's internal auditor may file
with the boa d a com pl int , under oath, alleging a
violation of hapters 8 and/or 29 of the St. Paul
Legislative Co e and%o chapter 24 of the St. Paul
Administrative pde. � � !

Notwithstanding ��he provisions of Section 111.04 (1) ,
the ci� ty's internal' audit r shall have the authority to
receive anonymous yomp aints, wa vi e sic�ning of the
statement required k�y ection 111.P14 (1) and bring a
formal complaint on b�ha f of the cit , if the auditor
determines that a com ' 1 int is not frivilous, is not
made in bad faith, and ' s not brought for the purpose
of being vexatious or ha �:assing.

Upon receipt of such com l��int, the board shall conduct
a preliminary investigation'z,, Upon completion of that
investigation, if the b ard �t3etermines that there are
no reasonable grounds t bel �eve that a violation has
occurred or that the com laint is frivolous or made in
bad faith or brought for exatious reasons or
substantially for the p rpose o harassment, it shall
dismiss the com plaint; o herwise, the board shall refer
the com plaint for a h aring a set forth in this
section.
Subdivision 2. Procedu e. The b�rd shall conduct a
hearing on each complain not previo sly dismissed and
shall rule thereon; prov ded such hea .,ing shall be held
and rulings made within ten days follo,wing the date a
com plaint is referred or within half the time from the
date the complaint is referred to it to the date of the
election, whichever is 1 ss .
The chair of the board ay obtain subpoenas from the
district court to compel the attendance of witnesses
and the production of do uments at any hearing . ,

Councilmembers Bab Lang and Kiki nnen.
The League o#'Womea Voters prom tes an open goveramental system that is
representative, accountable, and res nsive. The League has long worked for the
citizen's right to know aad far broa citizen participatioa Adequate notice of
propo�ed actions, open meeting�, an accessibility tc� public records are ways in
which the citizen's right tn kaow is rotected.
�►ccessible and understandable poli 'ss aad procedures help residents make more
infarmed decisions aad take approp iate action when they deem it necessary.
Establishiag an Ethical Practices Baa d caa help formulate clearer and more open
chanaets [or citizens tu�zpress the' concecns. It will alsa help to establish
unifocm ezpectatians and develap u iform and understandabte procedures foc
responding.
Such a Board, made up c�t' responsib citizens, can pravide a tempering and
clarifying role tu aa investigation, that issues brought befcxe them can be looked
at unifcxmly, fairly, and openly.
The League c�'Wamea Vuters of Sa' t Paul suppor�s such an open governmental
system which clearly states the rule , publicizes pcocedures, clarifies ezpectations,
and uniformly reviews vomplaints hich might come before it.
