WHEREAS, Carelton E. Mix has submitted he attached proposed lot split for City
Council approval ; and
WHEREAS, the Departments of Planning a d Economic Development and Public Works
have reviewed the proposed lot split f r 2328 Priscilla and 1160 Raymond, as
described on the attached survey; and
WHEREAS, the proposed lot split meets he requirements of Sections 67.304 and
67.406 of the Zoning Code, except for ide yard setbacks for both properties
from the shared property line and the inimum lot requirements for the parcel
at 1160 Raymond; and
WHEREAS, the City Council on March 31 , 1988 held a public hearing to determine
the advisability and necessity for th granting of variances from the strict
application of the provisions of Sect'on 61.101 of the Zoning Code; at which
hearing all persons present were give an opportunity to testify; and
WHEREAS, following said public hearin , the City Council made the following
findings of fact:
1. The intent of chapter 67.100 is met;
2. The granting of the variance will not be detrimental to the public
safety, health or welfare or i jurious to other property or improvements
in the neighborhood in which t e property is located;
3. The conditions upon which the equest for a variance is based are unique
to the property for which the ariance is sought and are generally not
applicable to other property;
4. The literal interpretation of he provisions of this chapter would
deprive the applicant of righ s commonly enjoyed by other properties in
the same zoning district;

Attached please find the application survey and staff report for the Carlton
Mix request for a lot split with var ance for property located at 2328
Priscilla and 1160 Raymond, at the s uthwest corner of Priscilla and Raymond.
The parcel now has two existing buil ings on it, one is a five unit and one is
a duplex. A lot split is necessary in order to convey each building to
separate owners. Variances are req ired for side yard setbacks for both lots
and for minimum lot size requiremen s for the larger lot.

combined L�� Split and varian e for the properties located at
2328 Prisc:�la and 1160 Raymon , St. Paul, Minnesota.
The b��ldings are locate on Lots 1, 2 , and 3 , Subdivision
of Lots 1 �nd 2, Block 28 , St. Anthony Park. The buildings have
had single ownership since the ' r construction in the late 1800' s.
They have been mortgaged se arately on numerous occasions and
there are two abstracts for the property, each representing a
description as requested here n.
The buildings are curren ly of a legal, non-conforming use.
The lot split is nece sary so that the buildings may be
conveyed to separate owners. The variance is required for side
lot setbacks and lot square ootage requirements.

A. PURPOSE: To consider a lot split to con ey two existing residential structures
to separate owners; variances are requi ed for side yard setbacks and for
minimum lot size.
MINIMUM LOT REOUIREMENTS: In the RT-2 district - 10,000 square feet for
multiple unit buildings, 6,000 for dup ex: Parcel A with the multi-unit building
has 9,230 square feet and Parcel B, th duplex, has 6,390 square feet.
SIDEYARD SETBACK REOUIREMENTS: Minim of 9' for each side: Parcel A has 3.1'
on its southeasterly boundary and Parc 1 B has 3.96' at its northwesterly
boundary (this is the common boundary line) .
B. CUR.RENT WIDTH & AREA: Total parcel a ea is 15,620 square feet (including one of
the alley) and has 110' in width.
C. SITE � AREA CONDITIONS: There are tw existing residential structures on this
fairly flat lot, a five unit building on Raymond and a duplex on Priscilla,
Adjacent uses include single and mul iple unit residential structures and a
commercial node located two blocks n rth at Como and Raymond.
D. FINDINGS:
1. The City Council may grant a varianc from the subdivision regulations when
compliance would create an unusual h rdship to the development of the land, and
based on findings as specified in se tion 67.703 of the zoning code. These
findings are as follows:
1. The intent of the (subdivision) hapter is met;
The intent of the subdivision c apter is to provide for the orderly and
� economic development of land; is lot split and variance will meet that
intent.
2. The granting of the variance wi 1 not be detrimental to the public safety,
health or welfare or injurious to other property or improvements in the
neighborhood in which the prop rty is located;
This condition is met by this proposal.
3. The conditions upon which the equest for a variance is based are unique to
the property for which the var"ance is sought and are generally not
applicable to other property;
The variance is required bec se the placement of the structures on the lot,
originally built over 60 yea s ago, and the lot size do not meet the current
ordinance requirements.
4. The Ziteral interpretation of the provisions of this chapter would deprive
the applicant of rights comm 1y enjoyed by other properties in the sarne
zoning district;
The configuration of the st uctures on the lot and the resultant lot
size below the minimum requ rement is not a newly created condition; the
variance would legitimize t e status quo for this parcel. In the same RT-2
zoned area are found other ultiple dwellings.

6.Because of the particular natural surr undings, shape or topographical
conditions of the specific property i volved, unusual hardship to the owner
would result, as distinguished from mere inconvenience, if the strict

not be split for separate ownership; this would result in hardship for the
current property owner.
