1 WHEREAS, Citizen Service Office, Division of Code Enforcement has requested the Ciry

4 garage and metal shed located on properry hereinafter referred to as the "Subject Properry" and

WHEREAS, based upon the rewrds in the Ramsey County Recorder's Office and informauon
obtained by Division of Code Enforcement on or before May 7, 1998, the following are the now
known interested or responsible parties for the Subject Property: Gloria McGuire, 1099 Wakefield
Avenue, St. Paul, MN 55106-5703; Chase Mortgage Services Inc., 200 Old Wilson Bridge Rd.,
Worthington, OH 43085-5500
WHEREAS, Division of Code Enforcement has served in accordance with the provisions of
Chapter 45 of the Saint Paul I.egislative Code an order identified as an"Order to Abate Nuisance
Building(s)" dated June 1, 1998; and
WAEREAS, this order informed the then known interested or responsible parties that the
structure located on the S�bject Property is a nuisance building(s) pursuant to Chapter 45; and
WHEREAS, this order informed the interested or responsible parties that they must repair or
demolish the structure located on the Subject Property by July 1, 1998; and
WHEREAS, the enforcement officer has posted a placard on the Subject Property declaring
this building(s) to constitute a nuisance condition; subject to demolition; and
WFiEREAS, tkus nuisance condition has not been corrected and Division of Code Enforcement
requested that the City Clerk schedule public hearings before the Leglslative Hearing O�cer of the
City Council and the Saint Paul City Council; and
WHEREAS, the interested and responsible parties have been served notice in accordance with
the provisions of Chapter 45 of the Saint Paul L.egislative Code, of the time, date, place and purpose
of the public hearings; and

1 WHEREAS, a hearing was held before the I.egislative Hearing Officer of the Sain P 1 Cty Z
2 Council on Tuesday, February 16, 1999 to hear testimony and evidence, and after receiving testimony
3 and evidence, made the recommendation to approve the request to order the interested or responsible
4 parties to make the S�bject Properry safe and not detrnnental to the public peace, health, safety and
5 welfare and remove its blighting influence on the communiry by rehabilitating this structure in
6 accordance with all applicable codes and ordinances, or in the altemative by demolishing and
7 removing the structure in accordance with all applicable codes and ordinances. The rehabilitation or
8 demolition of the structure to be completed within fifteen (15) days after the date of the Council
9 Hearing; and

WHEREAS, a hearing was held before the Saint Paul City Council on Wednesday, February
24, 1999 and the testnnony and evidence including the action taken by the Legislative Hearing Officer
was considered by the Council; now therefore
BE IT RESOLVED, that based upon the testimony and evidence presented at the above
referenced public hearings, the Saint Paul City Council hereby adopts the following Findings and
Order concerning the Subject Property at 1099 Wakefield Avenue:
1. That the Subject Property comprises a nuisance condition as defined in Saint Paul
I,egislative Code, Chapter 45.
2. That the costs of demolition and removal of this building(s) is estimated to exceed three
thousand dolIars ($3,000.00).
3. That there now exists and has existed multiple Housing or Building code violations at
the Subject Property.
4. That an Order to Abate Nuisance Building(s) was sent to the then l�own responsible
parties to correct the deficiencies or to demolish and remove the building(s).

That the deficiencies causing this nuisance condition have not been corrected.
That Division of Code Enforcement has posted a placard on the Subject Property which
declares it to be a nuisance condition subject to demolition.
That this building has been routinely monitored by the Citizen Service Offices, Division
of Code Enforcement, VacanUNuisance Buildings.
8. That the known interested parties and owners aze as previously stated in this resolution
and that the notification requirements of Chapter 45 have been fulfilled.
ORDER
The Saint Paul City Council hereby makes the following order:

The above referenced interested or responsible parties shall make the Subject Property safe and
not detrimental to the public peace, health, safety and welfare and remove its blighting
influence on the community by rehabilitating this structure and conecting all deficiencies as
prescribed in the above referenced Order to Abate Nuisance Building(s) in accordance with all
applicable codes and ordinances, or in the alternative by demolishing and removing the
siructure in accordance with all applicable codes and ordinances. The rehabilitauon or
demolition and removal of the structure must be completed within fifteen (15) days after the
date of the Commcil Hearing.
2. If the above correcrive action is not completed within this period of time the Citizen Service
Office, Division of Code Enforcement is hereby authorized to take whatever steps are
necessary to demolish and remove this structure, fill the site and charge the costs incurred
against the Subject Property pursuant to the provisions of Chapter 45 of the Saint Paul
I.egislative Code.
In the event the building is to be demolished and removed by the City of Saint Paul, all
personal properry or fixtures of any kind which interfere with the demolition and removal shall
be removed from the propeny by the responsible parties by the end of this time period. If all
personal property is not removed, it shall be considered to be abandoned and the Ciry of Saint
Paul shall remove and dispose of such property as provided by law.
4. It is further ordered, that a copy of this resolution be mailed to the owners and interested
parties in accordance with Chapter 45 of the Saint Paul L,egislative Code.

The legal description of this properry is:

Division of Code Enforcement has declared this building(s) to constitute a"nuisance" as defined
by Legislative Code, Chapter 45. Division of Code Enforcement has issued an order to the then
known responsible parties to eliminate this nuisance condition by correcting the deficiencies or
by razing and removing this building(s).
Inasmuch as this Order to Abate has not been complied with the nuisance condition remains
unabated, the community continues to suffer the blighting influence of this property. It is the
recommendation of the Division of Code Enforcement that the City Council pass a resolution
ordering the responsible parties to either repair, or demolish and remove this building in a timely
manner, and failing that, authorize the Division of Code Enforcement to proceed to demolition
and temoval, and to assess the costs incurred against the real estate as a special assessment to be
collected in the same manner as taxes.

Gerry Strathman called the meeting to order at 10:04 a.m.
Resolution ordering the owner to remove or repair the building at 582 State Street. If the
owner fails to comply with the order, Code Enforcement is ordered to remove the building.
Chuck Votel reported the properry was condemned in September 1997, and has been vacant since
September 1998. The current owner is Michael Duginski. He has not discussed his intentions
with Code Enforcement. The City has issued eight summary abatement notices to secure all
buildings, remove refuse, and cut tall grass and weeds. The City boazded the building. The $200
vacant building fee is due. The real estate taxes are unpaid in the amount of $5,869.65. Code
Enforcement estimates the cost to repair this property at $40,000; the cost to demolish, $5,000 to
$6,000.
Daniel Kaplan, Best and Flanagan PLLP representing Transamerica Financial Services, appeared
and stated Transamerica is undergoing foreclosure proceedings against this property. If
Transamerica intends to proceed with the code compiiance, they will have a code inspection done
and deposit a$2,000 bond prior to the February 24 City Council meeting.
Gerry Strathman asked is this property an active nuisance in the neighborhood. Chuck Votel
responded the city boarded the building in October 1998. There has not been maintenance
problems since then.
Gerry Strathman recommended allowing the owner six months to complete rehabilitation on

building. The $200 vacant building fee is due. The mazket value of the property is estimated at
$43,700. Code Enforcement estimates the cost to repair this property at $40,000; the cost to
demolish, $7,000 to $8,000.

Dennis Dalen, Chase Mortgage Services, appeared and stated Chase received notice about this
property last week. Chase is preparing to convey this property to HLTD (Housing and Urban
Development) within 60 days. Mr. Dalen requested a continuance of this matter for 30 days.
Gerry Strathman asked about the current status of this property. Chuck Votel responded Code
Enforcement secured the door once. Other than that, there has not been a problem. Someone has
been taking care of the property.

Gerry 5trathman called the meeUng to order at 10:00 a.m.
Resolution ordering the owner to remove or repair the building at 993 Burr Street. If the
owner fails to comply with the order, Code Enforcement is ordered to remove the building.
Chuck Votel reported this building has been vacant since April 1998. The City has issued 3
summary abatement nofices. The City has boarded the building to secure it against trespass. The
registration fee and real estate t�es aze paid. Ramsey County has estimated the market value to
be $46,800. Code Enforcement estimated the cost to repair is $45,000; the cost to demolish,
$7,000 to $8,000. According to Ramsey County tax records, the property owner is Equi Credit
Corporation. They have not discussed their intentions with Code Enforcement.
Beth Asmussen, Shapiro and Nordmeyer, representing Equi Credit Corporation, appeazed and
stated they acquired the property in a mortgage foreclosure. The building is now listed with a
realtor, who intends to sell it as is. Ms. Asmussen requested 6 months to make repairs. Equi
Credit is willing to post a performance bond and have a code compliance inspection done.
Gerry Strathman recommended allowing the owner six months to complete rehabilitation on
condiUon that a$2,000 bond is posted and a code compliance inspection is completed by noon of
March 24, 1999.

Mohammed Shahiduliah, owner, appeared and stated he did not know what this is about.
Chuck Votel reported that he did not receive the required green postcard from the owner
requesting a hearing; therefore, Mr. Votel does not have the paperwork nor the videotape.

Guy Willits reported he }ust received the green postcazd today and does not have the videotape
with him.
Joseph Borgstrom, owner, appeazed and stated he was not awaze of any cleanup other than what
he paid for himself. He purchased this house ftom the government. There has been constant
cleaning up, and cutting down bushes and tree branches. At any given time, there may have been
something on the property.
Gerry Strathman stated an order was issued on November 5, 1998, mailed, and posted. Work was
done on November 13. It involved cleaning up discarded appliances, branches, brush, refuse, and
]oose debris from the rear yard. Mr. Borgstrom responded he lives there and nothing was posted.
He cleaned up those items.
Gerry Strathman suggested 7oseph Borgstrom make arrangements with Guy Willits to view the
videotape. If Mr. Borgstrom is not satisfied, he should attend the Aprii 6 I,egislative Hearing and
Mr. Strathman wall look into this matter at that time.

Rattanak Yin, owner, appeazed and stated he called the company he deals with to pick up the
trash, and the trash was removed.
Gerry Strathman stated orders were issued on September 29 and November 10, 1998. The
property was checked on November 23 and the items were removed by the City on November 30.
Rattanak Yin stated he did not receive the notice. Chuck Votel responded he sent the notices to
an address in Burnsville. None of the notices came back undeliverable.

Rattanak Yin stated he did the initial cleanup from the list Code Enforcement gave him. This
was the second pile. He left it there for a couple of days. Mr. Yin does not live there. He does
everything that Code Enforcement asks him to do. He is not neglecting the property. Chuck
Votel responded he gets a lot of complaints about this address because there is a restaurant across
the street. He suggested the owner get a dumpster so that trash is not left ln a pile on the ground.
Gerry Strathman recommended approval of the assessment It seems the notice was mailed and
the work was done.
708 Preble Street
Guy Willits reported orders were mailed on November 25, 1998, to discazd auto partshefuse with
a comply date of November 30. The work was not done and the items were removed on
December 2. The inspector wrote that there had been an ongoing problem with improperly stored
vehicles and refuse. There have been numerous orders issued. The inspector tried calling the
owner, but did not get in contact with ham. No mailed orders were returned.
Charles Crotty, owner, appeared stated he did not receive notice about this from December until
recently. He would like to be notified right away. His tenants have since moved, and Mr. Crotty
has no way of recovering this money. Roxanne Flink tesponded the City Council approves
the assessments on March 24; invoices are sent out afterwards.
Gerty Strathman stated there is a legal process the City has to go through. There has to be a
hearing and then approval by the City Council. Roxanne F1ink added anyone can call to find out
about assessments. Also, when an invoice is sent out, people have 30 days to pay it without any
interest added.

Geny Strathman stated he received a letter from Jeanette Kamman in which she writes that the
cleanup was for one sma11 bundle.

Guy Willits reported the owner asked for this fee to be cut in hal£ The owner was out of town
during the assessment. Mr. Willits was working with the manager of the building who gave the
wrong information to Code Enforcement, and Code Enforcement made a mistake with the dates.
The owner is willing to pay half the fee.
Gerry Strathman recommended the assessment be reduced by half plus the cost of the service
chazges, which brings it to a total of $125.

Chuck Votel reported the owner could not be found, it was important to get the building secured,
and a contractor was called. If this contractor is already on the road when the matter is canceled,
Code Enforcement pays the contractor $200. The owner showed up with his own contractor.

work was done.

Chuck Votel reported this building has been vacant since August 1998 and condemned since
February 1998. The owners are Edwazd and Joanne Soltau and the State of Minnesota Trust
Exempt. The owners have not discussed their intentions with Code Enforcement. The City has
issued five summary abatements. The City has boarded the building to secure it against trespass.
The registration fees are due. Ramsey County has estimated the market value to be $35,000.
Code Enforcement estimated the cost to repair is $50,000, the cost to demolish, $6,000 to $7,000.
James Gilliland, 1920 Roblyn Avenue, appeared and stated he is surprised to heaz the City would
tear down a building which looks repairable when there are enough vacant lots in the City.
Ramsey County has made a decision to put the house on tl�eir Apri129 auction. Mr. Gilliland
suggested letting the auction take place. He walked through the house, and feels there is nothing
structurally wrong with the foundation. A lot of labor needs to be done on the inside walls. Mr.
Gilliland may be interested in purchasing the home at a later date. Even if the home is sold for $1
to a contractor to repair, the home would stay on the taac rolls and everyone will be better off.
Gerry Strathman asked has Code Enforcement heard from Ramsey County. Chuck Votel
responded he has no notes in the file about this. Mr. Strathman stated this property is an eyesore

and numerous complaints have been received. One of the criticisms from neighbors is that the
City moves so slowly on properties.
Gerry Strathman recommended approval of the resolution. Without the owner and the taY
exempt property personnel coming forwazd, it would be problemauc to let this matter sit for a
while. Tas Exempt properties will be noti�ied of Mr. Strathman's decision, and they can come
forward with a plan to the City Council.

24, 1999 and the testnnony and evidence including the action taken by the Legislative Hearing Officer
was considered by the Council; now therefore
BE IT RESOLVED, that based upon the testimony and evidence presented at the above
referenced public hearings, the Saint Paul City Council hereby adopts the following Findings and
Order concerning the Subject Property at 1099 Wakefield Avenue:
1. That the Subject Property comprises a nuisance condition as defined in Saint Paul

The above referenced interested or responsible parties shall make the Subject Property safe and
not detrimental to the public peace, health, safety and welfare and remove its blighting
influence on the community by rehabilitating this structure and conecting all deficiencies as
prescribed in the above referenced Order to Abate Nuisance Building(s) in accordance with all
applicable codes and ordinances, or in the alternative by demolishing and removing the
siructure in accordance with all applicable codes and ordinances. The rehabilitauon or
demolition and removal of the structure must be completed within fifteen (15) days after the
date of the Commcil Hearing.
2. If the above correcrive action is not completed within this period of time the Citizen Service
Office, Division of Code Enforcement is hereby authorized to take whatever steps are
necessary to demolish and remove this structure, fill the site and charge the costs incurred
against the Subject Property pursuant to the provisions of Chapter 45 of the Saint Paul
I.egislative Code.
In the event the building is to be demolished and removed by the City of Saint Paul, all
personal properry or fixtures of any kind which interfere with the demolition and removal shall
be removed from the propeny by the responsible parties by the end of this time period. If all
personal property is not removed, it shall be considered to be abandoned and the Ciry of Saint
Paul shall remove and dispose of such property as provided by law.
4. It is further ordered, that a copy of this resolution be mailed to the owners and interested
parties in accordance with Chapter 45 of the Saint Paul L,egislative Code.

September 1998. The current owner is Michael Duginski. He has not discussed his intentions
with Code Enforcement. The City has issued eight summary abatement notices to secure all
buildings, remove refuse, and cut tall grass and weeds. The City boazded the building. The $200
vacant building fee is due. The real estate taxes are unpaid in the amount of $5,869.65. Code
Enforcement estimates the cost to repair this property at $40,000; the cost to demolish, $5,000 to
$6,000.
Daniel Kaplan, Best and Flanagan PLLP representing Transamerica Financial Services, appeared
and stated Transamerica is undergoing foreclosure proceedings against this property. If
Transamerica intends to proceed with the code compiiance, they will have a code inspection done
and deposit a$2,000 bond prior to the February 24 City Council meeting.
Gerry Strathman asked is this property an active nuisance in the neighborhood. Chuck Votel
responded the city boarded the building in October 1998. There has not been maintenance
problems since then.

Guy Willits reported he }ust received the green postcazd today and does not have the videotape

Joseph Borgstrom, owner, appeazed and stated he was not awaze of any cleanup other than what
he paid for himself. He purchased this house ftom the government. There has been constant
cleaning up, and cutting down bushes and tree branches. At any given time, there may have been
something on the property.
Gerry Strathman stated an order was issued on November 5, 1998, mailed, and posted. Work was
done on November 13. It involved cleaning up discarded appliances, branches, brush, refuse, and
]oose debris from the rear yard. Mr. Borgstrom responded he lives there and nothing was posted.
He cleaned up those items.
Gerry Strathman suggested 7oseph Borgstrom make arrangements with Guy Willits to view the
videotape. If Mr. Borgstrom is not satisfied, he should attend the Aprii 6 I,egislative Hearing and

Rattanak Yin, owner, appeazed and stated he called the company he deals with to pick up the
trash, and the trash was removed.
Gerry Strathman stated orders were issued on September 29 and November 10, 1998. The
property was checked on November 23 and the items were removed by the City on November 30.
Rattanak Yin stated he did not receive the notice. Chuck Votel responded he sent the notices to
an address in Burnsville. None of the notices came back undeliverable.

Rattanak Yin stated he did the initial cleanup from the list Code Enforcement gave him. This
was the second pile. He left it there for a couple of days. Mr. Yin does not live there. He does
everything that Code Enforcement asks him to do. He is not neglecting the property. Chuck
Votel responded he gets a lot of complaints about this address because there is a restaurant across
the street. He suggested the owner get a dumpster so that trash is not left ln a pile on the ground.
Gerry Strathman recommended approval of the assessment It seems the notice was mailed and
the work was done.
708 Preble Street
Guy Willits reported orders were mailed on November 25, 1998, to discazd auto partshefuse with
a comply date of November 30. The work was not done and the items were removed on
December 2. The inspector wrote that there had been an ongoing problem with improperly stored
vehicles and refuse. There have been numerous orders issued. The inspector tried calling the
owner, but did not get in contact with ham. No mailed orders were returned.
Charles Crotty, owner, appeared stated he did not receive notice about this from December until
recently. He would like to be notified right away. His tenants have since moved, and Mr. Crotty
has no way of recovering this money. Roxanne Flink tesponded the City Council approves
the assessments on March 24; invoices are sent out afterwards.
Gerty Strathman stated there is a legal process the City has to go through. There has to be a
hearing and then approval by the City Council. Roxanne F1ink added anyone can call to find out
about assessments. Also, when an invoice is sent out, people have 30 days to pay it without any
interest added.

Guy Willits reported the owner asked for this fee to be cut in hal£ The owner was out of town
during the assessment. Mr. Willits was working with the manager of the building who gave the
wrong information to Code Enforcement, and Code Enforcement made a mistake with the dates.
The owner is willing to pay half the fee.
Gerry Strathman recommended the assessment be reduced by half plus the cost of the service
chazges, which brings it to a total of $125.
900 Maryland Avenue East
Chuck Votel reported the owner could not be found, it was important to get the building secured,
and a contractor was called. If this contractor is already on the road when the matter is canceled,
Code Enforcement pays the contractor $200. The owner showed up with his own contractor.
There was a glitch in the paperwork that assessed this amount against the property; however, no
work was done.
Gerry Strathman recommended deleting the assessment.
Resolution ordering the owner to remove or repair the building at 382 Dewev Street. If the
owner fails to comply with the order, Cude Enforcement is ordered to remove the building.
Chuck Votel reported this building has been vacant since August 1998 and condemned since
February 1998. The owners are Edwazd and Joanne Soltau and the State of Minnesota Trust
Exempt. The owners have not discussed their intentions with Code Enforcement. The City has
issued five summary abatements. The City has boarded the building to secure it against trespass.
The registration fees are due. Ramsey County has estimated the market value to be $35,000.
Code Enforcement estimated the cost to repair is $50,000, the cost to demolish, $6,000 to $7,000.
James Gilliland, 1920 Roblyn Avenue, appeared and stated he is surprised to heaz the City would
tear down a building which looks repairable when there are enough vacant lots in the City.
Ramsey County has made a decision to put the house on tl�eir Apri129 auction. Mr. Gilliland
suggested letting the auction take place. He walked through the house, and feels there is nothing
structurally wrong with the foundation. A lot of labor needs to be done on the inside walls. Mr.
Gilliland may be interested in purchasing the home at a later date. Even if the home is sold for $1
to a contractor to repair, the home would stay on the taac rolls and everyone will be better off.
Gerry Strathman asked has Code Enforcement heard from Ramsey County. Chuck Votel
responded he has no notes in the file about this. Mr. Strathman stated this property is an eyesore

and numerous complaints have been received. One of the criticisms from neighbors is that the
City moves so slowly on properties.
Gerry Strathman recommended approval of the resolution. Without the owner and the taY
exempt property personnel coming forwazd, it would be problemauc to let this matter sit for a
while. Tas Exempt properties will be noti�ied of Mr. Strathman's decision, and they can come
forward with a plan to the City Council.

WHEREAS, a hearing was held before the Saint Paul City Council on Wednesday, February
24, 1999 and the testnnony and evidence including the action taken by the Legislative Hearing Officer
was considered by the Council; now therefore
BE IT RESOLVED, that based upon the testimony and evidence presented at the above
referenced public hearings, the Saint Paul City Council hereby adopts the following Findings and
Order concerning the Subject Property at 1099 Wakefield Avenue:
1. That the Subject Property comprises a nuisance condition as defined in Saint Paul
I,egislative Code, Chapter 45.
2. That the costs of demolition and removal of this building(s) is estimated to exceed three
thousand dolIars ($3,000.00).
3. That there now exists and has existed multiple Housing or Building code violations at
the Subject Property.
4. That an Order to Abate Nuisance Building(s) was sent to the then l�own responsible
parties to correct the deficiencies or to demolish and remove the building(s).

That Division of Code Enforcement has posted a placard on the Subject Property which

8. That the known interested parties and owners aze as previously stated in this resolution

The Saint Paul City Council hereby makes the following order:

The above referenced interested or responsible parties shall make the Subject Property safe and
not detrimental to the public peace, health, safety and welfare and remove its blighting
influence on the community by rehabilitating this structure and conecting all deficiencies as
prescribed in the above referenced Order to Abate Nuisance Building(s) in accordance with all
applicable codes and ordinances, or in the alternative by demolishing and removing the
siructure in accordance with all applicable codes and ordinances. The rehabilitauon or
demolition and removal of the structure must be completed within fifteen (15) days after the
date of the Commcil Hearing.
2. If the above correcrive action is not completed within this period of time the Citizen Service
Office, Division of Code Enforcement is hereby authorized to take whatever steps are
necessary to demolish and remove this structure, fill the site and charge the costs incurred
against the Subject Property pursuant to the provisions of Chapter 45 of the Saint Paul
I.egislative Code.
In the event the building is to be demolished and removed by the City of Saint Paul, all
personal properry or fixtures of any kind which interfere with the demolition and removal shall
be removed from the propeny by the responsible parties by the end of this time period. If all
personal property is not removed, it shall be considered to be abandoned and the Ciry of Saint
Paul shall remove and dispose of such property as provided by law.
4. It is further ordered, that a copy of this resolution be mailed to the owners and interested
parties in accordance with Chapter 45 of the Saint Paul L,egislative Code.

vacant building fee is due. The real estate taxes are unpaid in the amount of $5,869.65. Code
Enforcement estimates the cost to repair this property at $40,000; the cost to demolish, $5,000 to

Daniel Kaplan, Best and Flanagan PLLP representing Transamerica Financial Services, appeared
and stated Transamerica is undergoing foreclosure proceedings against this property. If
Transamerica intends to proceed with the code compiiance, they will have a code inspection done
and deposit a$2,000 bond prior to the February 24 City Council meeting.
Gerry Strathman asked is this property an active nuisance in the neighborhood. Chuck Votel
responded the city boarded the building in October 1998. There has not been maintenance
problems since then.

property last week. Chase is preparing to convey this property to HLTD (Housing and Urban
Development) within 60 days. Mr. Dalen requested a continuance of this matter for 30 days.

Enforcement secured the door once. Other than that, there has not been a problem. Someone has

Chuck Votel reported this building has been vacant since April 1998. The City has issued 3
summary abatement nofices. The City has boarded the building to secure it against trespass. The
registration fee and real estate t�es aze paid. Ramsey County has estimated the market value to
be $46,800. Code Enforcement estimated the cost to repair is $45,000; the cost to demolish,
$7,000 to $8,000. According to Ramsey County tax records, the property owner is Equi Credit
Corporation. They have not discussed their intentions with Code Enforcement.
Beth Asmussen, Shapiro and Nordmeyer, representing Equi Credit Corporation, appeazed and
stated they acquired the property in a mortgage foreclosure. The building is now listed with a
realtor, who intends to sell it as is. Ms. Asmussen requested 6 months to make repairs. Equi
Credit is willing to post a performance bond and have a code compliance inspection done.
Gerry Strathman recommended allowing the owner six months to complete rehabilitation on
condiUon that a$2,000 bond is posted and a code compliance inspection is completed by noon of
March 24, 1999.

Guy Willits reported he }ust received the green postcazd today and does not have the videotape
with him.
Joseph Borgstrom, owner, appeazed and stated he was not awaze of any cleanup other than what
he paid for himself. He purchased this house ftom the government. There has been constant
cleaning up, and cutting down bushes and tree branches. At any given time, there may have been
something on the property.
Gerry Strathman stated an order was issued on November 5, 1998, mailed, and posted. Work was
done on November 13. It involved cleaning up discarded appliances, branches, brush, refuse, and
]oose debris from the rear yard. Mr. Borgstrom responded he lives there and nothing was posted.
He cleaned up those items.
Gerry Strathman suggested 7oseph Borgstrom make arrangements with Guy Willits to view the
videotape. If Mr. Borgstrom is not satisfied, he should attend the Aprii 6 I,egislative Hearing and
Mr. Strathman wall look into this matter at that time.

Rattanak Yin, owner, appeazed and stated he called the company he deals with to pick up the
trash, and the trash was removed.
Gerry Strathman stated orders were issued on September 29 and November 10, 1998. The
property was checked on November 23 and the items were removed by the City on November 30.
Rattanak Yin stated he did not receive the notice. Chuck Votel responded he sent the notices to
an address in Burnsville. None of the notices came back undeliverable.

Rattanak Yin stated he did the initial cleanup from the list Code Enforcement gave him. This
was the second pile. He left it there for a couple of days. Mr. Yin does not live there. He does
everything that Code Enforcement asks him to do. He is not neglecting the property. Chuck
Votel responded he gets a lot of complaints about this address because there is a restaurant across
the street. He suggested the owner get a dumpster so that trash is not left ln a pile on the ground.
Gerry Strathman recommended approval of the assessment It seems the notice was mailed and
the work was done.

Guy Willits reported orders were mailed on November 25, 1998, to discazd auto partshefuse with
a comply date of November 30. The work was not done and the items were removed on
December 2. The inspector wrote that there had been an ongoing problem with improperly stored
vehicles and refuse. There have been numerous orders issued. The inspector tried calling the
owner, but did not get in contact with ham. No mailed orders were returned.
Charles Crotty, owner, appeared stated he did not receive notice about this from December until
recently. He would like to be notified right away. His tenants have since moved, and Mr. Crotty
has no way of recovering this money. Roxanne Flink tesponded the City Council approves
the assessments on March 24; invoices are sent out afterwards.
Gerty Strathman stated there is a legal process the City has to go through. There has to be a
hearing and then approval by the City Council. Roxanne F1ink added anyone can call to find out
about assessments. Also, when an invoice is sent out, people have 30 days to pay it without any
interest added.

Guy Willits reported the owner asked for this fee to be cut in hal£ The owner was out of town
during the assessment. Mr. Willits was working with the manager of the building who gave the
wrong information to Code Enforcement, and Code Enforcement made a mistake with the dates.
The owner is willing to pay half the fee.
Gerry Strathman recommended the assessment be reduced by half plus the cost of the service
chazges, which brings it to a total of $125.
900 Maryland Avenue East
Chuck Votel reported the owner could not be found, it was important to get the building secured,
and a contractor was called. If this contractor is already on the road when the matter is canceled,
Code Enforcement pays the contractor $200. The owner showed up with his own contractor.
There was a glitch in the paperwork that assessed this amount against the property; however, no
work was done.
Gerry Strathman recommended deleting the assessment.
Resolution ordering the owner to remove or repair the building at 382 Dewev Street. If the
owner fails to comply with the order, Cude Enforcement is ordered to remove the building.
Chuck Votel reported this building has been vacant since August 1998 and condemned since
February 1998. The owners are Edwazd and Joanne Soltau and the State of Minnesota Trust
Exempt. The owners have not discussed their intentions with Code Enforcement. The City has
issued five summary abatements. The City has boarded the building to secure it against trespass.
The registration fees are due. Ramsey County has estimated the market value to be $35,000.
Code Enforcement estimated the cost to repair is $50,000, the cost to demolish, $6,000 to $7,000.
James Gilliland, 1920 Roblyn Avenue, appeared and stated he is surprised to heaz the City would
tear down a building which looks repairable when there are enough vacant lots in the City.
Ramsey County has made a decision to put the house on tl�eir Apri129 auction. Mr. Gilliland
suggested letting the auction take place. He walked through the house, and feels there is nothing
structurally wrong with the foundation. A lot of labor needs to be done on the inside walls. Mr.
Gilliland may be interested in purchasing the home at a later date. Even if the home is sold for $1
to a contractor to repair, the home would stay on the taac rolls and everyone will be better off.
Gerry Strathman asked has Code Enforcement heard from Ramsey County. Chuck Votel
responded he has no notes in the file about this. Mr. Strathman stated this property is an eyesore

and numerous complaints have been received. One of the criticisms from neighbors is that the
City moves so slowly on properties.
Gerry Strathman recommended approval of the resolution. Without the owner and the taY
exempt property personnel coming forwazd, it would be problemauc to let this matter sit for a
while. Tas Exempt properties will be noti�ied of Mr. Strathman's decision, and they can come
forward with a plan to the City Council.

intended to convey this property to H[JD. Code Enforcement has not heard from the attorney; no
bonds or pernuts have been posted.
