5ection 1 .
7hat Section 31U.05 (c) of th Saint Paui Legislative Code is hereby
amended to read as follows:
(c) Where the cause for the dverse hearin is based u on a
violation of law and there is no dis ute as to the facts under-
lying the violation, the hear ng shall be held by the eed�efi�;
al�-�ep si�a�� effe�°d counc i 1 's ommi ttee des i nated to hear
iicense matters. Otherwise t e hearin sha11 be conducted before
a hearin examiner a ointed the council for that ur ose.
The applicant or the licensee shall be provided an opportunity
to present evidence and ar�gum nt as well as meet adverse testimony
or evidence by reasonable cro s-examination and rebuttal evidence.
The esbr�e-�� committee or hear n examiner may in its dis-
cretion permit other interest d persons the opportunity to present
testimony or evidence or othe wise participate in such hearing.

Section 2.
That Sectio� 310.05 of the S� int Paul Legislative Code is hereby
amended so as to add the followin new Subsections thereto to be numbered
as 310.05 (c-1) and 310.05 (c-2) :
c-1 Procedure• hearin exa iner. The hearin examiner shall hear
all evidence as ma be rese ted on behalf of the cit and the li-
cant or licensee and shail resent to the eenrnt��ee Council
written findin s of fact and conciusions of law to ether with a
recommendation for adverse a tion.
The eemm-'r��ee Council shall onsider the evidence contained in
the record the hearin exam ner's recommended findin s of fact and con-
clusions and shall not cons der an factual testimon not reviousl
submitted to and considered the hearin examiner. The eemm#��ee
