WHEREAS, Subject to the equirements of law, the City of
Saint Paul is authorized purs ant to the provisions of Minnesota
Statutes , Chapter 429, to spe ially assess the costs of
constructing, reconstructing, altering, extending, operating,
maintaining and promoting fir protection systems in existing
buildings; and
WHEREAS, The Saint Paul ity Council has determined that it
is in the public interest to rovide this means of providing fire
protection systems in existin buildings, which are required by
the Building or Fire Code to install fire protection systems, in
which the owner thereof is p rticipating in a city-sponsored
Small Business Assistance pro ram; and
WHEREAS, The City Council , by this resolution, intends to
set forth the requirements th t will be applicable to any
petition for the assessment of the costs of such fire protection
systems and which will be use to guide the city departments and
petitioners in the review of ny such petition; now therefore be
it
RESOLVED, That petitions to be presented to the City Council
for consideration of speciall assessing costs for fire
protection systems, as authorized by Minnesota Statute, Chapter
429 , must comply with the following requirements and criteria:
a) The petition must co ply with all of the applicable
requirements of Cha ter 429, including the submission
of plans and specifications together with a cost
estimate, all subject to approval of the City.
b) The petition shall prepared and signed by all owners
of the subject prop rty, and proof of record ownership
thereof shall also e submitted with the petition.

c) The petition shall ontain a statement that the owners
shall be responsibl for contracting for the actual
installation of the fire protection system using
contractors and ins allers licensed or registered
with the Citv of Sa nt Paul or the State of Minnesota .
d) The petition shall ontain a statement that the owners
waive all rights wh' ch they may have to a public hearing
on the proposed imp ovement and assessment and further
specifically waive ny and all rights which the owners
may have to appeal he adopted assessments to the
District Court
e) The amount to be sp cially assessed for the improvements
shall not exceed th amount of the approved construction
estimates , plus any administrative costs incurred by the
City and interest c arges. Administrative charges shall
include the costs o providing a disbursing agent ,
engineering inspect on services and other costs associ-
ated in the review nd implementation of the improve-
ments .
f) The petition shall ontain a statement that the owners
shall be responsibl for the difference between the
approved constructi n estimate and the actual construc-
tion costs , in the vent the actual costs exceed the
approved estimate .
g) No payment shall be authorized until the assessment is
ratified and the co pleted work is inspected and
approved by an engi eering inspection service and also
reviewed by the Div ' sion of Building Inspection and
Design and the Depa tment of Fire and Safety Services
for compliance with all applicable fire and building
codes . Any approva by a City division or department
shall be only as to compliance with existing codes
and is not a warran y of quality of materials or
workmanship.
h) Special assessments shall be for a period not to exceed
20 vears .
i ) Assessments shall b ar interest at the highest rate
applicable for any ther special assessment levied by
the City.
