The meeting of the Board f Appeals and Review was called to
order by Chairman Ron Glassm n at 1 :30 p.m. on February 9, 1988.
Mr. Giassman welcomed he appellants and explained the
procedures under which the b ard operates. He related the Board
merely makes a recommenda ion to the City Council on how to
proceed after reviewing the ndividual cases.

APPEARANCE : Mr. John L. Sel x
SUBJECT: Appellant is reque ting a waiver of the vacant building
fees in the amount of $340.0 as per letter dated January 1 , 1988
because of financial hardshi .
PROCEEDINGS: Mr. Selix e plained the building has been vacant
for about 4 years because of a fire. The insurance company paid
the claim but it had to go o pay off the loan; therefore, Mr.
Selix has had no funds to renovate the building and ctaims
financial hardship. Previou to the fire, Mr. Selix said, he had

done about $7500 worth of rk on the house. He would like to
fix it up, but cannot as t e insdrance money could not be used
. for renovation and because h is forced to live elsewhere and pay
rent. He has tried numerou times and places but cannot get any
funding.
Bilt Tilton suggested h try the East Side Development
Corporation and gave him the address, etc.
Sean Carey suggested Mr. S lix contact Mike Hatch of the State
Insurance Commissioner's o fice to see if his case can be
reopened to his advantage.

APPEARANCE: George Tortorelis
SUBJECT: Appellant is reque ting a waiver of the vacant building
fees in the amount of $120.0 as per letter dated December 15,
1987, because of financial h rdship.
PROCEEDINGS: Mr. Tortorelis explained this is a business
establishment (Roccos) where hey had a fire last June. He is in
the process of dealing with he insurance company and is asking
that he not have to pay the es while this is being decided. He
is very anxious, he stated, to renovate as he wants to get back
into business. He has no income at the present time and is
asking for a waiver of th fees on the basis of financial
hardship. Mr. Tortorelis sai the Fire Department ruled the fire
was incendiary and for that r ason it may result in a law suit.
BOARD ACTION: Bill Tilton M VED to deny the request for waiver
of the fees but grant a reque t for waiver on the late fees for a
six month period; also, to le the boarding up fees accrue and be
paid up when the insurance laim is settled. The motion was
seconded and passed unanimous y.

in upper bathroom, because o the size of room; also requesting a
• variance pertaining to dea bolts locks, as per letter dated
November 12, 1987.
PROCEEDINGS: Ms. Hines ex lained this is an upstairs apartment
in which the bathroom has a stool and shower; directly out the
door there is a sink in the next room. There is no kitchen in
this unit, so the sink is no used for cooking and there are only
two residents in the unit an never will be any more. Therefore,
she is asking a variance on he bathroom not having a sink. On
the item of dead bolts, ther was some confusion as to what units
needed them. It was agree to lay this item over for further
information.
BOARD ACTION: Glenn Gausman MOVED a variance be granted on there
being no sink in the upper b throom. It was seconded and passed
unanimously.

has put them in extrerne fina cial hardship; therefore, because of
this and the lessening in units, he is asking for a variance in
the number of occupants allo ed.
BOARD ACTION: Bill Tilton MOVED to grant the variance on the
number of occupants in a sle ping room. The motion was seconded
and passed unanimously.

unit - one to each apartmen - with vents piped to the roof and
it has been this way since e has had the building. There are
four individual shafts to th roof.

She is asking for a varianc on these. Also she is asking for a
variance on door closures o the individual apartments.
Pat Fish, Fire Prevention Division of the Fire Department, said
the door closures are a fire safety item and she would like to
see this enforced.
BOARD ACTION: Bill Tilton MOVED the request for variance on the
door closures be denied; a d a variance be granted on the dead
bolt locks until they nee to be replaced for other reasons.

PROCEEDINGS: Mr. Lang sai because state code and the Uniform
Buitding Code are less restr ctive on handraits, they would like
