Mr. Glassman welcomed he appellants and explained the procedures under which the b ard operates. He related the Board merely makes a recommenda ion to the City Council on how to proceed after reviewing the individual cases. David Schultz MOVED approval of the minutes for January 12, 1988. Motion carried. Chairman Glassman proceeded o hear the cases : CASE NO: PROPERTY APPE LED APPELLANT 4-88-H 853 E. l.awson St. John L. Selix (vacar:t bu i i i ng APPEARANCE : Mr. John L. Sel x SUBJECT: Appella�t is reque ting a waiver of the vacant building fees in the amount of $340.0 as per letter dated January 1 , 1988 because of financial hardshi . PROCEEDINGS: Mr. Selix e plained the building has been vacant for about 4 years because of a fire. The insurance company paid the claim but it had to go o pay off the loan; therefore, Mr. Selix has had no funds to renovate the building and claims financial hardship. Previou to the fire, Mr. Selix said, he had 1 . (:!"���� done about $7500 worth of ork on the house. He would like to fix it up, but cannot as he insdrance money could not be used for renovation and because e is forced to live elsewhere and pay rent. He has tried numero s times and piaces but cannot get any funding. Bill Tilton suggested e try the East Side Development Corporation and gave him th address, etc. Sean Carey suggested Mr. Selix contact Mike Hatch of the State Insurance Commissioner's o fice to see if his case can be reopened to his advantage. George Tortorelis (Vacant Buil ing APPEARANCE : George Tortore is SUBJECT: Appellant is reque ting a waiver of the vacant building fees in the amount of $120.0 as per letter dated December 15, 1987, because of financial h rdship. PROCEEDINGS: Mr. Tortore is explained this is a business establishment (Roccos) where they had a fire last June. He is in the process of dealing with the insurance cornpany and is asking that he not have to pay the ees while this is being decided. He is very anxious, he stated, to renovate as he wants to get back into business. He has n income at the present time and is asking for a waiver of t e fees on the basis of financial hardship. Mr. Tortorelis said the Fire Department ruled the fire was incendiary and for that eason it may result in a law suit. BOARD ACTION: Bill Tilton OVED to deny the request for waiver of the fees but grant a requ st for waiver on the late fees for a six month period; also. to 1 t the boarding up fees accrue and be paid up when the insurance claim is settled. PROCEEDINGS: Ms. Hines ex lained this is an upstairs apartment in which the bathroom has a stooi and shower; directly ou.t the door there is a sink in the next room. There is no kitchen in this unit, so the sink is no used for cooking and there are only two residents in the unit an never will be any more. Therefore, she is asking a variance on he bathroom not having a sink. On the item of dead bolts, ther was some confusion as to what units needed them. PROCEEDINGS: Mr. Hanks said the reduction of units from 19 to 15 has put them in extreme fina cial hardship; therefore. because of this and the lessening in un ts, he is asking for a variance in the number of occupants allo ed. BOARD ACTION: Bill Tilton MOVED to grant the variance on the number of occupants in a sle ping room. The motion was seconded and passed unanimously. PROCEEDINGS: Mr. Bump expt ined there are four bathrooms in the unit - one to each apartmen - with vents piped to the roof and it has been this way since e has had the building. There are four individual shafts to th roof. BOARD ACTION Bill Tilton MO ED to grant the variance on the four bathrooms for a period of fi e years or until Mr. Bump would setl the building. She is asking for a varianc on these. Also she is asking for a variance on door ciosures o the individual apartments. Pat Fish, Fire Prevention ivision of the Fire Department, said the door closures are a fi e safety item and she would like to see this enforced. PROCEEDINGS: Mr, Lang sai because state code and the Uniform Building Code are less restr ctive on handrails, they would like to see City code waived; the will install handrails on any units over 4 steps. BOARD ACTION: Sean Carey MOVED to grant the variance on handrails so that they meet the Uniform Building Code requirements. Motion was se onded and passed. PROCEEDINGS: Mr. Mordh said he would like an extension of time to take him through the wint r months without having to open up the building and he could the change the window size to conform with code.
