WHEREAS, Midwest Fence Company on ehalf of Tom and Sandy Prudhomme
applied for a variance from the strict pplication of the provisions of
Section 61.101 of the Saint Paul Legisl tive Code pertaining to building
setback in an R-3 zoning district so as to permit the construction of an
attached garage for property located at 1343 N. Dale Street on property
legally described as the south 12 feet f Lot 10 and Lot 11, Block 1, Warren
and McDowell Subdivision; and
WHEREAS, following a public hearin with notice to affected property
owners, the Board of Zoning Appeals by 'ts Resolution No. 10221 adopted
October 27 , 1987, varied the provisions of Section 61.101 of the Legislative
Code to allow a setback of five feet fr m the south property line and a 26
foot 8 inch setback from the front prop rty line for the proposed construction
of the attached garage; and
WHEREAS, pursuant to the provision of Section 64.205, Josephine Palermo,
1341 North Dale, duly filed with the Ci y Clerk her appeal from the
determination made by the Board of Zoni g Appeals requesting that a hearing be
held before the City Council for the pu pose of considering the actions taken
by the said Board; and
WHEREAS, acting pursuant to Sectio s 64.205 through 64.208, and upon
notice to Appellant and the affected pr perty owners, a public hearing was
duly conducted by the City Council on D cember 3, 1987 where all interested
parties were given an opportunity to be heard; and
WHEREAS, the Council having heard he statements made and having
considered the variance application, th report of staff, the minutes and
findings of the Board of Zoning Appeals does hereby

RESOLVE, that the Council of the Cit of Saint Paul does hereby reverse
the decision of the Board of Zoning Appe ls in this matter regarding the side
yard setback based upon a finding and de ermination made by the City Council
that the Board did commit an error, that there are reasonable alternatives to �
construct the attached garage without ha ing to require a setback from the
side yard zoning requirements and that a garage 12 feet in width could be
built without requiring any such varianc s; and, be it
FURTHER RESOLVED, that the City Coun il does hereby uphold the decision
of the Board in this matter in regards t front yard setback based upon the
finding by the City Council that a varia ce of front yard setback is necessary
for the construction of a garage because of the location of windows in the
existing house; and, be it
FURTHER RESOLVED, that the appeal of Josephine Palermo in regards to the
side yard setback be and is hereby grant d; and, be it
FURTHER RESOLVED, that all work need d to bring the garage into
compliance with the required seven foot ideyard setback shall be completed by
June 30, 1988; and, be it
FURTHER RESOLVED, that the appeal of Josephine Palermo in regards to
front yard setback be and is hereby deni d; and, be it
FURTHER RESOLVED, that the City Cler shall mail a copy of this
resolution to Midwest Fence Company, Tom and Sandy Prudhomme, Josephine
Palermo, the Zoning Administrator, the Planning Commission and the Board of
Zoning Appeals.

, for the Josephine Palermo a peal regarding the garage at 1343
' North Dale so as to grant the variance for the front yard setback,
while denying the variance for the side yard variance. The
resolution which I had pre iously prepared at the request of
, the City Clerk denied �311 va iances because that was the request
of the Clerk (and I �3ssume the request of the City Council ) .
Now you tell me that Jani e Rettman and you agree that the
Council did not intend to eny the front yard variance, and
if that is the case then it should be so reflected in the reso-
lution.

Council Member Rettman so tha they will know where the resolution

Dear Sir:
On October 27, 1987 the Board of Zoni g Appeals held a public hearing on a
request by Midwest Fence Company on b half of the property owners, Tom and
Sandy Prudhome, for a variance to per it construction of an attached, one-car
garage on the south side of the Prudh me's home.
The BZA granted variances for a front yard setback of 26' 8" (27' normally
required) and a side yard setback of ' (7' normally required) .
On November 6, 1987, an appeal of the BZA's decision was filed by Josephine
Palermo who owns the house directly s uth of the Prudhome's property. She
contends that the BZA erred and its d cision violated the intent and pupose of
the Zoning Code to insure adequate li ht and air, conserve property values,
prevent harmful encroachment by incom atible uses and prevent overcrowding of
land with buidlings.
The appeal is scheduled to be heard b the City Council on December 3, 1987.

for the Josephine Palermo appe 1 regarding the garage at 1343
North Dale so as to grant the var' ance for the front yard setback,
while denying the variance for the side yard variance. The
resolution which I had previou ly prepared at the request of
the City Clerk denied all varian es because that was the request
of the Clerk (and I assume th request of the City Council ) .
Now you tell me that Janice ettman and you agree that the
Council did not intend to den the front yard variance, and
if that is the case then it sho ld be so reflected in the reso-
lution.
If you have any further quest ' ons or changes, let me know.
I am sending a copy of this 1 tter to the City Clerk and to
Council Member Rettman so that th y will know where the resolution
is in the process.
