RESOLVED, that upon the p tition of J . Brooks Hauser , per
Finance Department number 28-19 7 , that part of the north-south
alley opened over the east 25 fe t of Lot 26 , Block 7 , Wifelburg
Hills and bounded by Rice , H wthorne , Park , and Maryland ,
hereinafter described , be and the same is hereby vacated and
discontinued as public property.
That the vacated area be de cribed as follows :
All that part of the nor h-south alley as opened across
the east 25 feet of Lot 6 , Block 7 , Wifelburg Hills and
recorded as document 140 924 dated September 6 , 1956
1 . That the vacation be subject to all the terms and
conditions of Chapter 1 0 , codified March 1 , 1981 , of the
Saint Paul Legislative ode , as amended .
2. That the petitioner , hi heirs and assigns, pay the City
of Saint Paul $7 , 419 as compensation for this vacation
which is due and payabl within 60 days of the date of
publication of this res lution .
3 . Based upon utility eas ment Certificates of Intended

Public Works , Northw stern Bell Telephone Company ,
Northern States Power Company , the Water Utility ,
Continental Cablevision , District Energy Saint Paul and
Western Union and made a part hereby by this reference
and filed in the office of the City Clerk of Saint Paul ,
the City for itself an on behalf of these corporations
and departments waives he right to utility easements in
that portion of the vac ted area , described as follows :
All that part of t e alley, as opened , over the
east 25 feet of Lo 26 , Block 7 , Wifelburg Hills
4 . That the petitioner his heirs and assigns , by
acceptance of the terms and conditions of this vacation ,
agree to idemnify, defe d and save harmless the City of
Saint Paul , its office s and emplo�rees from all suits ,
actions or claims of a y character brought as a result
of injuries or damage received or sustained by any
person , persons , or property on account of this
vacation , or petitioner ' s use of this property ,
including but not limit d to a claim brought because of
any act of omission , neglect or miseonduct of said
petitioner or because o any claims or liability arising
from any violation of an � law or regulation made in
accordance with the law whether by the petitioner or any
of its agents or employ es .
5 . That the petitioner , his heirs and assigns , shall within
60 days of the publicat on date of this resolution file
with the City Clerk an aceeptance in writin� of the
conditions of this re olution and shall within the
period ( s) specified in he terms and conditions of this
resolution comply in al respects with these terms and
conditions.
That the Council of the City of aint Paul hereby authorizes the
proper City Officials to convey t the petitioner , his heirs and
