WHEREAS, MT Properties, Inc. has submitt d the attached proposed lot split for
City Counci approval ; and �
WHEREAS, the Departments of Planning and Economic Development and Public Works
have revie ed the proposed lot split on est side of Prior Avenue at
Cottonwood Street as described on the at ached survey; and
WHEREAS, t e proposed lot split meets t requirements of Sections 67.304 and
67.406 of he Zoning Code, but requires a variance from the platting
requiremen ; and
WHEREAS, t e City Council on January 28 1988 held a public hearing to
determine he advisability and necessit for the granting of variances from
the strict application of the provision of Sections 67.304 and 67.406 of the
Zoning Cod at which hearing all person present were given an opportunity to
testify; a d
WHEREAS, f llowing said public hearing, the City Council made the following
findings o fact:
1 . The in ent of the subdivision chapt r is to provide for the orderly and
econom c development of land; this pplication and variance will meet that
intent
2. The gr nting of the variance will n t be detrimental to the public safety,
health or welfare or injurious to o her property or improvements in the
neighb rhood in which the property s located.
3. The c nfiguration of land to railro d lines are unique to this property
and a e generally not applicable to other property.

Dea Allan:
On November 24, 1987, M T Properties, Inc. applied to the
Cit of Saint Paul for he above-referenced lot split with
var ance. The lot split s requested in conjunction with the
sal and transfer of the roperty in question to Irvin Grudem
for his use as a parking ot. Grudem owns the property to the
wes of the lot in questi n on which he operates a commercial
bui ding. Grudem' s existi g parcel does not have any parking
fac' lities and Grudem' s lea e for the parking area he is currently
usi g has been terminated. The property in question is being
sol to Grudem for use as parking lot to service his existing
bui ding. M T Properties, Inc. is willing to sell the property
to rudem as it is no longe using it. The parcel has been split
int three lots to facilitate M T Properties, Inc. ' s need to
ret in property containing and surrounding existing spur tracks
whi h are currently owne by M T Properties and used by a
com ercial railway.
In reviewing this application, it should be noted that while
par els B and C do not front on an existing road, M T Properties,
Inc. will be granting an asement for a right-of-way and track

A. P POSE: To split unplatted pr erty off from railroad property in order to
cr ate three parking lots; a va iance is required to waive the requirement for
pl tting.
B. SI E & AREA CONDITIONS: As can e noted from the attached survey, the site is
di ided into three parcels by t e intersection of two railroad spur lines. The
su rounding area is flat and is developed as industrial uses.
C. RE UIRED FINDINGS FROM SECTION 7.406 OF THE ZONING CODE:
1. A1 the applicable provisions o the ordinance are complied with.
Th subdivision chapter require that all unplatted property to be platted at
th time of a lot split. The r quest for variance is to wave that requirement
du to the unusual dimension an location of the proposed new parcels.
2. Th proposed subdivision wi11 n t be detrimental to the present and potential
su rounding Iand uses.
T�a spur tracks divide the parc 1 into three oddly shaped sections. These
se tions would be very difficul to develop as any other use besides parking.
3. Th area surrounding the subdiv sion can be planned and developed in
co rdination and compatibility ith the proposed subdivision.
Th surrounding area is develop d and zoned industrial; the parking areas will
co plement this development.
4. Th subdivision is in conforman e with the Comprehensive Plan.

2. The granting of the variance wi11 not be detrimental to the public safety,
hea th or welfare or injurious t other property or improvements in the
nei hborhood in which the proper is located.

3. The conditions upon which the re uest for a variance is based are unique to the
pro erty for which the variance s sought and are generally not applicable to
oth r property.
The configuration of land to rai road lines are unique to this property.
4. The Iiteral interpretation of th provisions of this chapter would deprive the
app icant of rights commonly enj yed by other properties in the same zoning
dis rict.
The surrounding area is unplatte property; there is no intent to build or to
use the land for other than surf ce parking for the adjacent industrial use. By
per itting the subdivision, the pplicant will be able to retain use of the
tra ks but sell the vacant parce s between the tracks to an adjoining property
own r.
5. The special conditions and circu stances do not result from the actions of the
app ican t.
The land configuration is not a esult of actions of the applicant.
6. Be ause of the particular natur 1 surroundings, shape or topographical
co ditions of the specific prop ty involved, unusual hardship to the owner
wo Id result, as distinguished rom a mere inconvenience, if the strict letter
of these regulations were carri d out.
Th parcel has both an unusual hape and relationship to railroad spur lines.
E. ST FF RECOMMENDATION: Based on taff findings, staff recommends that the lot
sp it with variance be approved subject to the applicant granting an easement
fo a right-of-way and track cr ssing for Lots B and C, as indicated on the
su ey.
