Murphy (vacant bld . ) AP EARANCE: Peter Fooshe, r. SU JECT: Appellant is requ sting a waiver of the vacant building fe s in the amount of �370. 0. as per letter dated December 15, 19 7. PR CEEDINGS: Mr. Fooshe rep esenting Grace Murphy, the fee ow er of the property loc ted at 586-586 1/2 Van Buren. Ms. Mu phy has a Contract for eed on the property which was sold to La bert W. & Karen L. Mot . They as Contract purchasers were re ponsible for taking care of the property and have failed to do so. The rear property has been vacant for a long time and is in ve y much need of repair, the building has been condemned and pl - carded by the city. Mr. Motz failed to response in anyway to th notices and they have ccumuiated for a considerable length of time. The amount outsta ding is in the amount of $480. 00. A 1 notice of cancellatian on the Contract for Deed has been f91ed. It was expected that by this time Ms. Murphy would be the owner of right. Ms. Murphy has paid delinquent taxes and presently has hired an Electrician to do the electrical work to try and bring the building up to code. Jim Prill , from Vacant Buildings stated that the ordinance reads, all delinguent vacant building fees shali be paid prior to any transfer of ownership interest in a vacant building. Mr. Fooshe feels that Ms. Murphy is a victim of circumstances, therefore, would like the fees waived. BOARD ACTION: Motion made by Ron Glassman to waive the fees of $480.00 with the condition that if Ms. Murphy retains title within 90 days and has a permit then work is started to bring building up to code. PR CEEDING5: Appellant w uld like a variance from Fire Code pe taining to having to install Automatic Fire Extinguisher Sy tem in Spray room. Ther is only one painter at a time working in the spray room and oper ted only as a convenience. Rihm Motor Co. deals with trucks, 1 cated in the Midway area covering one sq are block. The buildi g is separated from any other business by the streets that surro nd it. The amount of spray painting th t is being done is s minimal , that it would not pay to i stalll the sprinkler sys em. The co$t factor is about $ 7,000.00. The buildi g is solid concrete blocks. The � v ntilation in the build'ng is calied the make-up air system. T is system is turned on before the spraying starts, stays on d ring spraying and then 1 ft on after the painting is completed. S erry Webb. from Fire P evention stated that the building has r oms for spraying, rathe than booths. The contention of Fire P evention Code is that all spray finishing areas are required to h ve Automatic Fire Extin uishers 5ystems, either Sprinklers or D y Chemicai . Ms. Webb tated that the Dry Chemical systems is 1 ss costly. The cost on the smail rooms would be about $ , 000. 00, in this case t ree sytems would be required. These r oms are ground level . M . Ostrum, MPH, CSP, Cons ltant spoke briefiy on his observation f om his inspection. The spraying area has a ventilation system with a volume of 60,000 cfm which exhausts the vapors to the o tside of the building. 7he ventilation system is designed to p event accumulation of flammable vapors and to keep the vapors b low the lower explosive limits . Based on the conclusion of Mr. O trums observation, the ventilation system has such a volume t at the accumlation af vapors would not occur. The cost of i stallation is excessive when compared to the amount of work b ing done. 5 Ms. Webb, from Fire Prevention stated that the ventilation must be vented directly to the outside.
