12 said vacated property, by Quit Claim Deed, to the Aousing and Redevelopment Authority of the
13 City of Saint Paul, Minnesota (HRA); with proceeds from the re-sale of Parcel 1 going towards
14 the project to improve Prosperity Avenue from Johnson Pazkway to Rose Avenue, Funding
15 Code C94-2B019-0787-25052 and proceeds from the re-sale of Parcel2 going towards the
16 purchase of a replacement site for use by Public Works Street Maintainence, Funding Code
17 Number GL 225-42316-6999 .

19 2. That the petitioner, its successors and assigns will cause the conveyance of a ten foot wide
20 easement, for right of way purposes, south of and abutting the exisung right of way along the
21 south side of Maryland Avenue East from West line of Lot i, Goffin's Addition to the East line
22 of Lot 1, Block 2, Maryland Heights.

The Department of Public Works l�as completed a review of your request to declare the
above referenced praperty as surpl�s and have no objects subject 10 the fo�lov�ina
comments anci requirements:
1. �Lot 2, Goffin's Addition was recently acquired as part of New Prosperity. Proceeds
from the sale of this piece of properry should go towards the project to improve
�rosperity Avenue from Johnson �arkway f� Rose Ave., Funding Code C94-2B019-
0787-25052.
2. The other piece of property, our sait and sand lot is probably not designated as
right-of-way, which may affect the procedure for disposal. Proceeds for the sale of this
parcel should go to Public Works, Street Maintenance for the purchase of a similar site,
They will supply you with a funding code
3. fn addition, the hiRA shall cause the dedication of a ten foot strip of land along the
south side of Maryland Avenue between New Prosperity Avenue and Barclay Street for
the future widening of Maryland Avenue. If we pay the BCA market value for the 10 ft.
strip along Maryland Avenue, we would expect to get market value for the above
referenced parcels we are selfing. Costs for the 10 ft. widening of Maryland Avenue
may be deducted from the proceeds of the sale of Lot 2, Goffin's Add.

I took a look at this and I have quite a few questions about this vacation.
First and foremost, S�m not yet sure that we should be proceeding under LC
130. Second, it strikes me that we are disposing of real property and not
duly designated ROW. Wouldn't AC 51 be more appropriate - especially for the
sand and gravel lot. I�m not sure what that other lot was for, but it should
be sgelled out in the resolution. Also, NSP gas indicated that it had a gas
line in one of the areas to be vacated. We need to protect its right. There

The City Clerk has refesed to this office the petition of the City of Saint Paul for the vacation of:

Pam - The short answer is because we are a bureaucracy and the ordinances and procedures that cover
vacating the City's interest in property and the disposai of property require actions that take, at least , that
much time.
The procedure allows all interested parties to have input into the disposal of public property. Following the
procedure ensures that the city passes good title to the HRA (or at least as good a title as the City has).
Here are the steps we have to take:
1. The department with jurisdiction over the properry (in this case Public Works) declares the property
surplus to its needs. We have initiated this but haven't yet received the paper work.
2. The mayor signs a petition to vacate the city's interest.
3. We inquire of various utilities and City departments and offices whether there are objections to the
vacation or conditions to be placed on the vacation and safe. We have sent the inquiries. I don't expect
any objections. In this case PED should be making the recommendation that the City deed the property to
HRA for eventual transfer to the State for the BCA. This step is usually the most time consuming since
some utilities and departments are less responsive than others. We usually work with the petitioner, in this
case Dave Gontarek, to apply pressure where necessary.
4. Based on the responses we prepare a council resolution that vacates the city interest and, in this case,
directs the transfer to the HRA, send the resoiution and responses to the attorney for review, and, then,
set a public hearing at the council, The pubiic hearing has maii and pubiication notification requirements.
We will overlap the attorney review and the notification time to save time.
5. Aiter the public hearing and approval of the resolution we get the deed signed. This should take a
couple days, at most.
As you can see heaven has nothing to do with the process. 1 hope this answers your question. We will
take as much action concurrently as we can.

The Department of Public Works l�as completed a review of your request to declare the
above referenced praperty as surpl�s and have no objects subject 10 the fo�lov�ina
comments anci requirements:
1. �Lot 2, Goffin's Addition was recently acquired as part of New Prosperity. Proceeds
from the sale of this piece of properry should go towards the project to improve
�rosperity Avenue from Johnson �arkway f� Rose Ave., Funding Code C94-2B019-
0787-25052.
2. The other piece of property, our sait and sand lot is probably not designated as
right-of-way, which may affect the procedure for disposal. Proceeds for the sale of this
parcel should go to Public Works, Street Maintenance for the purchase of a similar site,
They will supply you with a funding code
3. fn addition, the hiRA shall cause the dedication of a ten foot strip of land along the
south side of Maryland Avenue between New Prosperity Avenue and Barclay Street for
the future widening of Maryland Avenue. If we pay the BCA market value for the 10 ft.
strip along Maryland Avenue, we would expect to get market value for the above
referenced parcels we are selfing. Costs for the 10 ft. widening of Maryland Avenue
may be deducted from the proceeds of the sale of Lot 2, Goffin's Add.

Juan,
I took a look at this and I have quite a few questions about this vacation.
First and foremost, S�m not yet sure that we should be proceeding under LC
130. Second, it strikes me that we are disposing of real property and not
duly designated ROW. Wouldn't AC 51 be more appropriate - especially for the
sand and gravel lot. I�m not sure what that other lot was for, but it should
be sgelled out in the resolution. Also, NSP gas indicated that it had a gas
line in one of the areas to be vacated. We need to protect its right. There
are mor. Give me a shout. PWW

The City Clerk has refesed to this office the petition of the City of Saint Paul for the vacation of:
(see attached description). This inquiry pertains to the vacation of City right-of-way only.
Depending on the petitioner's reason for requesting this vacation and the intended use for the
vacated right-of-way, some or all of the utility easements may be retained.
The purpose of this vacation is to: construct a state office for the Bureau of Criminal
Apprehension.
Will you please advise me of any existing utility easements or of any concerns over the intended
future use of this proposed vacation. T would like to receive your comments as soon as possible so
I can prepare a report to the City Council on this matter.

The two parcels are located between Barclay and the new Phalen Blvd along Maryland Avenue, (see
map). The HRA will consider selling 3.6 acres of property adjacent to Ames Lake Wetland for the BCA
project. The State will purchase the six houses along Maryland for the project.
A street vacation requests is also being prepared for a part ot Rose avenue.
Parcel 1 is ID-27-29-22-21-0021-6, (value of $37,700, a former gravel pit).
Parcel2 is ID-27-29-22-21-0038-4 (value $23,6D0, excess street right a way).
The BCA would like to have all property under contract within the next month. The second HRA meeting

Pam - The short answer is because we are a bureaucracy and the ordinances and procedures that cover
vacating the City's interest in property and the disposai of property require actions that take, at least , that
much time.
The procedure allows all interested parties to have input into the disposal of public property. Following the
procedure ensures that the city passes good title to the HRA (or at least as good a title as the City has).
Here are the steps we have to take:
1. The department with jurisdiction over the properry (in this case Public Works) declares the property
surplus to its needs. We have initiated this but haven't yet received the paper work.
2. The mayor signs a petition to vacate the city's interest.
3. We inquire of various utilities and City departments and offices whether there are objections to the
vacation or conditions to be placed on the vacation and safe. We have sent the inquiries. I don't expect
any objections. In this case PED should be making the recommendation that the City deed the property to
HRA for eventual transfer to the State for the BCA. This step is usually the most time consuming since
some utilities and departments are less responsive than others. We usually work with the petitioner, in this
case Dave Gontarek, to apply pressure where necessary.
4. Based on the responses we prepare a council resolution that vacates the city interest and, in this case,
directs the transfer to the HRA, send the resoiution and responses to the attorney for review, and, then,
set a public hearing at the council, The pubiic hearing has maii and pubiication notification requirements.
We will overlap the attorney review and the notification time to save time.
5. Aiter the public hearing and approval of the resolution we get the deed signed. This should take a
couple days, at most.
As you can see heaven has nothing to do with the process. 1 hope this answers your question. We will
take as much action concurrently as we can.

The Department of Public Works l�as completed a review of your request to declare the
above referenced praperty as surpl�s and have no objects subject 10 the fo�lov�ina
comments anci requirements:
1. �Lot 2, Goffin's Addition was recently acquired as part of New Prosperity. Proceeds
from the sale of this piece of properry should go towards the project to improve
�rosperity Avenue from Johnson �arkway f� Rose Ave., Funding Code C94-2B019-
0787-25052.
2. The other piece of property, our sait and sand lot is probably not designated as
right-of-way, which may affect the procedure for disposal. Proceeds for the sale of this
parcel should go to Public Works, Street Maintenance for the purchase of a similar site,
They will supply you with a funding code
3. fn addition, the hiRA shall cause the dedication of a ten foot strip of land along the
south side of Maryland Avenue between New Prosperity Avenue and Barclay Street for
the future widening of Maryland Avenue. If we pay the BCA market value for the 10 ft.
strip along Maryland Avenue, we would expect to get market value for the above
referenced parcels we are selfing. Costs for the 10 ft. widening of Maryland Avenue
may be deducted from the proceeds of the sale of Lot 2, Goffin's Add.

I took a look at this and I have quite a few questions about this vacation.
First and foremost, S�m not yet sure that we should be proceeding under LC
130. Second, it strikes me that we are disposing of real property and not
duly designated ROW. Wouldn't AC 51 be more appropriate - especially for the
sand and gravel lot. I�m not sure what that other lot was for, but it should
be sgelled out in the resolution. Also, NSP gas indicated that it had a gas
line in one of the areas to be vacated. We need to protect its right. There

The City Clerk has refesed to this office the petition of the City of Saint Paul for the vacation of:

to the HRA.
The two parcels are located between Barclay and the new Phalen Blvd along Maryland Avenue, (see
map). The HRA will consider selling 3.6 acres of property adjacent to Ames Lake Wetland for the BCA
project. The State will purchase the six houses along Maryland for the project.
A street vacation requests is also being prepared for a part ot Rose avenue.
Parcel 1 is ID-27-29-22-21-0021-6, (value of $37,700, a former gravel pit).
Parcel2 is ID-27-29-22-21-0038-4 (value $23,6D0, excess street right a way).
The BCA would like to have all property under contract within the next month. The second HRA meeting

Pam - The short answer is because we are a bureaucracy and the ordinances and procedures that cover
vacating the City's interest in property and the disposai of property require actions that take, at least , that
much time.
The procedure allows all interested parties to have input into the disposal of public property. Following the
procedure ensures that the city passes good title to the HRA (or at least as good a title as the City has).
Here are the steps we have to take:
1. The department with jurisdiction over the properry (in this case Public Works) declares the property
surplus to its needs. We have initiated this but haven't yet received the paper work.
2. The mayor signs a petition to vacate the city's interest.
3. We inquire of various utilities and City departments and offices whether there are objections to the
vacation or conditions to be placed on the vacation and safe. We have sent the inquiries. I don't expect
any objections. In this case PED should be making the recommendation that the City deed the property to
HRA for eventual transfer to the State for the BCA. This step is usually the most time consuming since
some utilities and departments are less responsive than others. We usually work with the petitioner, in this
case Dave Gontarek, to apply pressure where necessary.
4. Based on the responses we prepare a council resolution that vacates the city interest and, in this case,
directs the transfer to the HRA, send the resoiution and responses to the attorney for review, and, then,
set a public hearing at the council, The pubiic hearing has maii and pubiication notification requirements.
We will overlap the attorney review and the notification time to save time.
5. Aiter the public hearing and approval of the resolution we get the deed signed. This should take a
couple days, at most.
As you can see heaven has nothing to do with the process. 1 hope this answers your question. We will
take as much action concurrently as we can.
