WFiEREAS The City of Saint Paul has reques ed that the Department of Tra sportation
grant a v riance from the State's standards or desi� of �ban roadways r the
reconst tion of ST. CLAIR AVENUE from C tin Avenue to Snelling Avenu ; and
1KHEREAS The Commissioner of the Departm nt of Transportation has by 1 tter notified
the City at the request for a variance has een granted upon condition th�t the City
Council o the City of Saint Paul adopt a res lution indemnifying, saving a holding
harmless the State of Minnesota from any claims arising out of the grantir�of this
variance; and
WHEREAS The City has no other option avaii ble to it to receive the variar�ce requested
unless it omplies with the demands of the ommissioner of the Departme�nt of
Transpor at i on; now, theref ore, be i t
RESOLVE , That as the sole condition to rec iving a variance from the pro�isions of
State Ai Rules Section 8820.9912, the Co il of the City of Saint Paul d es hereby
agree to ndemnify, save and hold harmless he State of Minnesota and ail f its agents
and empl yees of and from any and all ciai s, demands, actions, or cause of actions of
�y nat or character arising out of or by ason of, in any manner, the construction
project o ST. CLAIR AVENUE from Cretin A enue to Snelling Avenue, in an other manner
than as a 3b foot wide curb to curb street f om Cretin Avenue to Clevelan� Avenue with
parking one side, and in any other mann than as a 44 foot wide curb t curb street
from Cle elanci Avenue to Sneliin Avenue ith parking on both sides, in a�cordance with

Minnesot Rule 8820.9912, and further agre s to defend at their sole cost'�d expense
any acti or proceeding commenced for th purpose of asserting any clai of
whatsoe er character arising as a result of the granting of this variance.
