HEREAS, The City Attorney, acting pusuant to secti�n 310.05
(a) o the Saint Paul Legislativ Code has recommended t at the
Counc 1 consider taking adver e action regarding t�e renewl
or b siness licenses either iss ed to Mr. Earl Montpet' t person-
ally r held in a corporate nam but owned by Mr. Earl ontpetit;
and
HEREAS , The Council has determined that the e identiary
heari g should be conducted y an administrative !law judge
and hat the Council consider the necessity of taki ' g adverse
actio upon receipt of the f'ndings of fact and c' nclusions
of la from said law judge ; now, therefore , be it
ESOLVED, Pursuant to Mi n. Stat. § 14. 55 , t e Council
does hereby direct the proper City officers to con ract with
the tate of Minnesota' s Chi f Administrative Law Judge for
the urpose of providing the services of an admi',nistra�c-i_ve
law udge and reporter for the purpose of hearing al evidence
as m y be presented on behalf f the City and Licens e in this
matte , the law judge ' s duties o be to present writte findings
of f ct and conclusions of la , together with a rec�mmendation
for a verse action; and, be it
URTHER RESOLVED , That upon the receipt of the administrative
law judge ' s findings , conclu ions and recommendati ns , this
Counc ' 1 shall afford the lic nsee an opportunity 'to appear
�efor it at a public hearing f r the limited purpose ' f stating
any bjections he may have t the findings , concl�sions and
reco endations , and thereaft r the Council shall' I��� determine
what, if any, adverse action sha 1 be taken regarding tt�e business
licen es currently issued to Mr. Earl Montpetit o�^ held in
a cor orate name but owned by Mr. Montpetit. I
