January Pettyi AP EARANCE: January Petty ' SU JECT: Appellant is requesting a variance pertaining to having to install a Key Box and mo ifing the transoms as p�r letter da ed October 9, 1987 beca se of the historicai value of the ho se. A ( ` ' 1 , PROCEEDINGS: Appellant 9s appealing the Key Box and the Transoms. The house 102 years old, a Victorian House it is a legal non- conforming three unit house. Ms. Petty lives in one of the units and the other two are rental units. Pat Fish, from Fire Prevention stated that the Key Box is required for safety. This being a three unit building, there is more danger of the tenants all being gone at one time, as opposed to larger buildings. Key Box is intended for Medic access. The transoms cannot be exempt, because code requires 20 minute doors with self-closures, therefore, the glass transoms are not up to code. These are clear glass transoms. Quarter inch wired glass with metal frames would be acceptabie. BOARD ACTION: Motion made by Harold Knutson to deny the variance pertaining to installation of Key Box and revamping Transoms. SUBJECT: Appellant is appealing the Vacant Buiiding Fees in amount of $230.00 from a letter dated October 15, 1987. This place is being used as a second residence, and it is being repaired as time permits. PROCEEDINGS: The Appellant stated he lives there occassionally as he is trying to fix up the place. Steve Roy, from Vacant Bldgs stated that this home has been vacant for many years. There has been numerous complaints over the years going back to 1980 and a eye-sorer to the community. The building has been condemned, because of no utilities to the � building. The Appellant cannot have two residents, Mr. Johnson lives in Marine, Minn. The Appeliant acquired the building June ofi 1586. City became aware of this buiiding September of 1986. Appeilant feels he needs a year to complete the repairs. The vacant building fees are in the amount of $230. 00. BOARD ACTION: Motion made by William Hite to deny the waiver of the vacant building fees ($230. 00) . Seconded by William Tilton. William Sylvester ( 1 unit) APP ARANCE : William Sylvester SUB ECT: Appellant is appealin the "Vacate Order" frqm a letter dat d November 12, 1987. PRO EEDINGS: The Appellant i working on the inside 'to try to com lete the plumbing, which h hopes to complete in �wo weeks. 3 The exterior is in very bad shape, looks terrible. The Board �� rec�ived several letters and phone cails regarding the appearance � of the building from concerned neighbors. The Appellant has ali the material to compiete the work, he is financially strapped. Mr. Sylvester wants to get the work done so that the outside looks better and the neighbors are happy. Mr. Sylvester is requesting that he be allowed to continue to live in the house to complete the plumbing. Steve Roy, from Vacant Buiidings stated that the building lacks water , and presently the Appellant lives in the building. Bill Tiiton stated that he received a phone call before the meeting. Mr. Tilton is very concerned that the outside looks so terrible and wants the appellant to finish the outside. Mr. Syivester stated that if he is ordered to vacate that this could affect his home owners permit, which ailows him to live there and do his own plumbing and then have final inspection. Mr. Tilton asked Mr. Syivester if he could come up with a date as to when the outside could be completed, then the Board could look more favorably on the ptumbing issue, because of the concerns of the neighbors . _ It was suggested by Mr. Tilton that if the Board granted Mr. : Sylvester some time to complete the outside and then additionai time to complete the piumbing, would Mr. Syivester be in agreement with this? Mr. Sylvester agreed, and appreciated that he could remain in the house to continue his work. BOARD ACTION: Motion made by William L. Tilton to grant the Appellant an extension of time for four (4) weeks to complete the exterior and an additional two (2) weeks to compiete the plumbing. Seconded by David Schultz. The ap al was to be filed within ten ( 10) days of October� 16, 1987. The Appellant filed November 23, 1987. The advise to Mr. Lippert fro Assistant City Attorney Paul McCloskey was that the Appeal sho ld not be heard. The Appellant stated that all vi4�lations have bee completed. Mr. Anders n stated that the main �oncern from the Housing Code Office is th t the Water Heater is not vented cor ectly. , Tl�e Board felt that the case should be heard at this �ime. Dic Lippert, from the Housing Division stated that fif the Board feels they should hear this c se, then he would lik� to state the City's position to the Bo rd. The building wa� inspected tod y, (December 8, 1987) , there is still � illegal plumbing, tra ping, improper plastic pi e, that was installed l�y a amateur inc rrectly. The water hea er is not vented, �aroducts of com ustion are back-spitling ut of the vent. . its do�s not vent out of the chimney. Between he Plumbing, Furnace ar�d the Water Hea er, these are the cause for "Condemnation" and remain in eff ct. Several inspections ave taken place and Mr. Anderson doe only the bare minimum. The building in gener`al , is in mar inal condition. Mr. An erson has hooked up to 'City water, and recovering that money, i any time frame is q�estionable. � Win ows do not fit correctly, there rotting, very o�d building. The building is vacant. Grossbaum SUBJECT: This case was laid over from the November 10, meeting, to allow the Appellant to meet with Fire Prevention and return to the Board with definite plans, pertaining to Item #4-Provide middle basement sleeping room with light and ventilation; Item #5-Provide all steeping rooms except S.E.Bedroom in basement with escape windows; Item #7-Provide Alarm System; Item #11-inadeyuate sleeping roam space in dorm style rooms, as per letter dated September 15, 1987. PROCEEDINGS: The Appellant was to meet with Mike Ricketson, from Fire Prevention to work out some plans as to which rooms could be used as bedrooms. This building is used for Retreats lasting three day, therefore, having people staying overnite for a couple of days. The building is constructed of solid concrete and brick, very thick walls. Sorne of the rooms that are used for sleeping rooms lack windows or have improper windows. Pat Fish, from Fire Prevention and Carolyn Sheppard from Housing Code office went to the House and drew up a floor plan that could be arranged so that rooms that are used for sleepiny rooms will be up to code. .,. � This building had been used by the Oblates -Fathers, and housed 25 persons , some years ago. Mike Ricketson, from Fire Prevention stated that the bui )ding must have a Smoke Alarm 5ystems, which is being worked on presently. The building has casement windows. The estimate for replacing the windows was $35,000.00. The primary issue is the windows in the sleeping rooms, second issue is Sprinkler System. Mr. Grossbaum would like to do his own Electrical wiring. Harold Knutson stated that Code requires that a Master Electrictian. licensed by the City, do the Electrical . Pat Fish, from Fire Prevention and Carolyn Sheppard, fi-om Housing Code met with someone at the building. Carolyn 5heppard took measurement on the roam size and windows. Carolyn Sheppard drew up floor plans and came up with recommendations, as to the the number of beds, per room size. Fire Prevention has no problem with this buitding being used for the present program. Fire Prevention is requesting the safety issues be corrected. Windows in the basement are several feet frorn the floor. Windows on the other ` floors are 16 x 48. Another problem is the number of beds in the '� sleeping rooms.
