WHEREAS, the vendor for the fireworks show will be Melrose Pyrotechnic, Inc., and
they will be the only individuals permitted access to Harriet Island, and the Island will not be
used for public viewing of the display; and
1 WHEREAS, Firstar Capital New Year would like to shoot off a fireworks display from
2 Harriet Island as part of the Capital New Year celebration; and
4 WHEREAS, the City of Saint Paul has contracted with C.S. McCrossan Construction,
5 Inc. for the capital improvements to Harriet Island Regional Park; and
7 WI3EREAS, McCrossan has control of Harriet Island far the period of construction of
8 said improvements, and as part of the contract has assumed the risk of liability for individuals on
9 Harriet Island during the contract period; and

WHEREAS, McCrossan is willing to permit Melrose Pyrotechnic, Inc. access to Harriet
Island for use as a shooting grounds for fireworks display on the condition that the City of Saint
Paul indemnify and hold them hannless from any injuries resulting from the set-up, shooting off,
and take-down of the firewarks display; and

WI�REAS, the City finds a public purpose in the fireworks display to celebrate the New
Year; now, therefore, be it
RESOLVED, that the Saint Paul City Council on behalf of the City of Saint Paul hereby
agrees to defend, indemnify and hold C.S. McCrossan Construction, Inc. and its officer, directors
and employees hannless for any and all damages as a result of suits, claims, actions or judgments
arising out of the use of Harriet Island by Melrose Pyrotechnic, Inc. for the shooting off of
fireworks on December 31, 1999 for injuries received or sustained by any party, parties or
property by reason of any act of negligence or omission of said City, its contractors, agent or
employees; and be it

FURTHER RESOLVED, that the foregoing defense and "mdemnification does not cover
any damages in excess of the City's liabiliry lunits as set forth in Minn. Stat. §466.04.
