Montpetit and any of his licenaed establishments within the City, including but not limited to Mr. Montpetit's Janu�ry 9, 1988 arrest , and report back to the Council 's Finance, Management and Personnel Committee by January 27 , 1988 with recommendations ae to whether the evidence reviewed provides a suffficient basis for the Council to proceed with a public hearing on an adverse licenee action against Mr. Montpetit. The License Inspector's request did not respond to the Council's desires to have the Inspector review all of the Police investigation files pertaining to Mr. Montpetit and his licensed establishments in Saint Paul, including any incidents or Police reports prior to January 9, 1988. I discussed this matter with Jerry Segal following our January 19 Council meeting. It appears that Mr. Segal could review Police Department files regarding Mr. Montpetit in matters unrelated to the active investigation or the January 9, 1988 arrest . Based on his review of those Police records, and any other records made available to him regarding the January 9 incident , Mr. Segal could make an informed recommendation to the Council as to whether there are surricient grounds , based on existing evidence, to proceed with a public hearing on an adverse action against Mr . Montpetit. This question arose after newspaper articles were published alleging that Mr. Montpetit was arrested on charges of prostitution. . Mr. Montpetit is the licensee of the Oz Nightclub, a business licensed by the City of Saint �aul . Because these charges concerning Mr. Montpetit are considered by the Police Department to be an active and ongoing investi- gation which has not been presented as evidence in court, the Police D�partment ' s records and files on t;hese allegations are classified as confidential pursuant to Minnesota Statutes , section 13. 82 , subdivision 5 , and may not be released to the City Council . Tnerefore, it is not possible to make any determi- nation at this time whether there is probable cause to consider taking adverse action on the business licenses held by Mr. Montpetit. Procedures governing license hearings are set forth in Section 310. 05 of the Saint Paul Legislative Code. These procedures require that notice be provided to the lic:ensee specifying the "issues involved or grounds upon which trie adverse action may be sought or based. " The purpose of this is to give the licensee adequate notice of the reasons for the possible adverse action so that he may have an opportunity to prepare his �3efense and this is a fundamental due process right. The Office of License Inspector utilizes the Police Department staff in conducting investigations into alleged improper or illegal activities of licensed businesses. It is essential that those investigative reports be available :�n making initial determinations whether the Inspector should recommend that the Council take any form of adverse action. This investigative data is not available at the present time. ` � �-�7 Council President Scheibel and Members of the City Council Page Two January 15, 1988 Because the City License Inspector and the City Attorney do not have adequate information regarding any alleged wrong-doing on the part of Mr. Montpetit, we are not able to prepare the required notice. In addition, it is not possible at this time, and without the opportunity to have a full investigation, for our offices to determine what evidence there exists to present at a City Ccuncil hearing. ° It is our recommendation that the Council not proceed to schedule any hearings on possible adverse action until after the investi- gations are completed and we have had an opportunity to inspect all of the evidence. In that manner, the hearing process will be in accord with the Legi�lative Code, and will minimize the possible legal objections to;�;a fiawed process.
