A. PURPOSE: To consider a lot split with variance to convert an existing side by
side duplex into two separate units and lot descriptions to achieve 100 percent
owner occupancy.
MINIMUM LOT REOUIREMENTS: In the RT-1 district - 3000 square feet in area and
30 feet in width.
VARIANCE REOUESTED: Each parcel 2,654 square feet in area and 20 feet in width.
B. CURAENT WIDTH & AREA: Total parcel area 5308 square feet and 40 feet in width.
C. SITE & AREA CONDITIONS: This is an existing two unit structure in a residential
neighborhood; RT-1 zoning to the north, east and west, R-4 zoning to the south.
D. FINDINGS:
1. The City Council may grant a variance from the subdivision regulations when
compliance would create an unusual hardship to the development of the land, and
based on findings as specified in section 67.703 of the zoning code. These
findings are as follows:
1. The intent of the (subdivision) chapter is met;
2. The granting of the variance will not be detrimental to the public safety,
health or welfare or injurious to other property or improvements in the
neighborhood in which the property is located;
3. The conditions upon which the request for a variance is based are unique to .
the property for which the variance is sought and are generally not
applicable to other property;
4. The literal interpretation of the provisions of this chapter would deprive
the applicant of rights commonly enjoyed by other properties in the same
zoning district;
5. The special conditions and circumstances do not result frorn the actions of
the applicant;
6. Because of the particular shape and size of the specific property involved,
unusual hardship to the owner would result, as distinguished from a mere
inconvenience, if the strict letter of these regulations were carried out.
2. The applicant can meet each of the variance findings. The variance will not be
detrimental to the public safety or injurious to other property in the immediate
neighborhood; the variance is required because of the existing parcel size and
the intent to create two distinct parcels, each with ownership opportunities;
the literal interpretation would preclude two family ownership; the
circumstances of this variance request is not a result of actions of the
applicant and unusual hardship would occur for the applicant if strict letter of
the subdivision regulations were carried out.
E. STAFF ANALYSIS:
After this split, these lots will become too small in the RT-1 zoning district
to have separate single family residences constructed on either lot if
destruction of the structure has occurred. Therefore, each deed should include
a stipulation that if the structure is destroyed in part or in whole, that only
an attached, common wall double dwelling may be reconstructed to established
city standards.

F. STAFF RECOM1�fENDATION:
Based on the above findings, staff recomrnends approval of this lot s�plit with
variances for width and area subject to the following conditions:
Parcel "A" : Reduce lot area from 3000 square feet to 2654 square feet and
reduce lot width from 30 feet to 20 feet with the the following condition - a
covenant will be attached to the deed stating that, in the event of destruction
of, or damage to the dwelling in whole or in part, to a point warranting
removal, new construction, reconstruction or repair of the dwelling shall be
restricted to either a common wall dwelling attached to the dwelling situated on
parcel "B" , or the split lot shall be recombined for construction of a single or
two family dwelling, until such time, if any, that the property zoning is

3. That Supplier will have available during regular busaness hours for �
the City's use, automobiles which shall be of 1985, 1986 and 1987 calendar year
manufacture or another year. of make and model as may be agreed ta b� the parties.

4. That in consideration of the use of Supplier's vehirle(s) tEre City �
zgrees to pay Supplier the sum of ten dollars ($10.00) per day, per vehicle, to
�maximum of three hundred ten dollars ($310.00) per month, per vehicle.
5. That the City agrees to save and hald Suppli er harmless from any and .
all claims arising out of the City's use of vehicles here�nder and sha11,
acditionally, repair at its own expense any damage susta�ned by the vehicles
during the course of City's use, normal wear and tear excepted.

6. 7hat the City shail be responsible fpr supplying each vehicle rented
hereunder with sucti amourrts of gasotine and oil as is needed to make the� �
vehicle operational, but no othe� mainterrartce obligations sha]1 be the respon-
sibility of the City.
7. That the City will not use any vehicle for a periact of mare than
sixty (60) days without Supplier's coRSent, but the City reserves the right
to request and receive from Supplier a replacement vehicle of a type and
� make as above-described at any time; time being of the essence in fulfiliing �
� requests for replacenrent Yehic?es. � � . �
S� �That�the City ackcfaaledges the right af the Supplier to demand the
return of the vehicle rented tiereunder upon twenty-four t24). hours'. notice�.ta -
the City and upon such notice, the Ci�y wilt return said automobile.
9. That the use of the vehicles rented hereunder are for tFie use of the �
City's Police Department and f�r the purp�rse af the administration of this
agreement, Captain Thomas Reding, 100 Eas� Eleventh Street, Saint Paul,
Minnesota, Phone No. 292-3588, shall be its liaison. '
1Q. That this Agreement shall be for a period of one (1) year and sha11
automatically be exte�ded for an additional period of one (1) year providing
no written notice is submitted by either party of an intent to terminate tt�is
Agreement at least thirty (30) days prior to the expiration of the first year.
