The meeting of the Board of Appeals & Review was called to order
by Chairman Ron Glassman, at 1 :35 p.m. November 10, 1987. Mr
Glassman welcomed the appellants and expiained the procedures
stating that what the Board does is recommends action to the City
Council .
Minutes of the October 13, 1987 meeting were approved as
submitted in writing.
Mr. Giassman referred to the letter that was forwarded to the
Council for consideration regarding, Amendinq the enforc_ement__of
the provisions of the Residential Enercav Code with respect to
requirina existinq walls above and below arade be insulated.
Mr. Glassman requested that a letter be sent to Councilmember
John Drew, who suffered a heart attack, wishing him good health
� and a speedy recovery.

APPEARANCE : John Volkert, Sr.
SUBJECT Appellant is requesting a waiver from St. Paul
Legislative Code, pertaining to vacant building fee in the amount
of $110.00 because of financial hardship.
PROCEEDINGS: Appellant is waiting for a rehab loan to be
approved. No work is being done presently. There is a problem
with the title, until this is straighten out the loan is being
held up.
Steve Roy, from Vacant Buildings Departrnent stated the building
has been vacant since August of 1986. Fees were not started
until three months ago. Presently the fee is $120. 00 including a
1 ate fee.
BOARD ACTION: Motion made by Ron Glassman to waive future
building fees, with the condition that if the paper work and the
loan is approved and apply for a building permit by the end of
November. The amou�t of $120.00 would have to be paid at the time
the permit is taken out. Seconded by William Tilton. MOTION
CARRIED UNANIMOUSLY.

APPEARANCE: Robert Huebner
SUBJECT Appellant is requesting a waiver from St. Paul
Legislative Code, pertaining to vacant building fee in the amount
of $110.00 because of financial hardship.
PROCEEDINGS: This building was condernned because there was a
piece of the wall out, the appellant was installing a new
basement step. There was dynamiting in the area and another piece
of the wall was cracked and had to be removed. The wall has been
completed.
Steve Roy, from Vacant Building Department stated the building
was condemned as unfit in 1984. Under the new registration
ordinance a building does not have to be boarded if it condemned
as unfit and remains vacant for a year then it has to be
registered as a vacant building. Vacant buiiding department
became aware of this building in February of 1987. Mr. Huebner
and �Mr. Roy met on October 7, 1987, as Mr. Huebner was trying to
obtain a permit to do some roofing work. At that time Mr. Roy
advised Mr. Huebner that the fee of $120. 00 had to be paid before
a permit could be issued. Mr. Huebner did not have the money to
pay the fees, also that he had hurt is back and is out of work.

Mr. Roy advised Mr. Huebner to file an appeal . Mr. Roy stated
that if Mr. Huebner contact Mr. Lippert from Department of Health
to see if the building meets ail code requirements, then the
pla�ard could be lifted and Mr. Huebner could live in the
building, removing all the boards from the windows, then he would
no longer have to register the building as vacant.
When the vacant building fees are paid the appeliant must have a
plan, along with a time frame as to when the work will be
compieted which must be approved by Mr. Roy.
BOARD ACTION: Motion made by William Tilton to deny the waiver of
vacant fees. Seconded by Glenn Gausman. MOTION CARRIED
UNANIMOUSLY.

SUBJECT This case was before the Board in September. The
Appe] lant was asked to return with some definite bids, pertaining

begin November 16, 1987.
BOARD ACTION: Motion made by Glenn Gausman to grant a variance to
delete the requirment of doing Item "0" (Floor over unheated
space not properly insulated; Entire structure sits on unheated
space. ) from the Energy Audit violation report, provided he does

Carolyn Sheppard stated that square footage allows for 9.
BOARD ACTION: Motion made William Tilton to grant a variance
on baths with the condition, that this variance is granted only for
the time that this buitding is used for a boardinghouse, and
operated by Ms. Leonard and the building is owned by Ron Saxon
with a limit of 7 occupants. Seconded by Glenn Gausman. MOTION
CARRIED UNANIMOUSLY.

and separating; dernands are unreasonable and will create a
financial hardship.

very bad shape and should be condemned.

factor.
PROCEEDINGS: These building have deadbolts 5/8 " presently and
are in very good condition. The door frames are wood frames.
These frames are all in good condition. The building does not
have a security system.
Mike Ricketson, form Fire Prevention stated that Fire Prevention
would support a variance, if when there is a need for replacement
in the future that the deadbolts be replaced with a 3/S " with a
one inch projection.
BOARD ACTION: Motion made by Rosie Bostrom to grant a variance
pertaining to existing deadbolts, with the condition that if in
the future the deadbolts need replacernent they are repiaced with
the 3/8 " - one inch projection. Seconded by Glenn Gausman.

SUBJECT Appellant is appealing Item #4 - Provide middle basement
sleeping room with light and ventilation; Item #5 - Provid� all
sleeping rooms except S.E. Bedroom in basement with escape
windows; Item # 7 - Provide •Alarm System; Item #11 - inadequate
sleeping room space �in dorm style rooms, as per letter dated
September 15, 1987
APROCEEDINGS: This building is used as an educational building.
Item #4 (middle basement sleeping room with light and
ventilation) this has been completed.
Mike Ricketson, from Fire Prevention stated that he feels very
uneasy about this situation.
After much discussion Mr. Tilton suggested that Rabbi Grossbaum
return to the December meeting with some definite floor plans
that would be agreeable with Fire and Safety. Another questions
that was asked, was the building Zoned for a roominghouse?
Ron Glassman suggested that Rabbi Grossbaum research the issue,
about roominghouse.
BOARD ACTION: Motion made by William Tilton to grant a variance
for 30 days, then return with plans showing sleeping rooms, etc.
Mr. Ricketson will work with Rabbi Grossbaum on a plan.

APPEARANCE: Cyrus Lewis
SUBJECT Appellant is appealing the request to keep apartment
clean and in sanitary condition as per letter dated September 4,
1987.
PROCEEDINGS: Mr. Lewis really does not want to contest the work
orders, but feels he needs more time to find a place to put his
belongings.

Mike Ricketson, fram Fire Prevention stated that two sets of
orders were issued, one August 28, 1987 and one in September.
The inspector feels that amble time was given for the appellant
to clean up his unit. A condemnation for gross unsanitary
conditions by the Fire Department is very unusual . Initially
this matter was brought to the attention of the Fire Department
through a complaint. Mr. Ricketson stated that if the Board
should decide to give Mr. Lewis more time, consideration should
be given to the fact that the building was posted September 4,
1987 for Condemnation, at that time Mr. Lewis was given till
October 4, 1987 to clean the place or Fire Prevention will shut
the place down.
BOARD ACTION: Motion made by William Tilton to give the appellant
one week (November 17, 1987) to clean up his living quarters or
he must move out. Seconded by Glenn Gausman. MOTION CARRIED
UNANIMOUSLY.
