WHEREAS, Jases Wingate, has sub,i ted the attached progosed lot eplit for City
Council approval; and
WHEREA3, the Depart�ent of Planni g and Econoeic Developoent and Public Works
have reviewed the proposed lot sp it located on the Unioproved Arkwright Street
north of Wheelock Parkway, as dea ribed on the attached aurvey; and
WHEREAS, the proposed lot s lit m ets the require,ents of Chapter 67.304 of the
Zoning Code, except for the�yt.is o improved street frontage; and
WHEftEAS, notice of public hearing before the City Council was duly published in
the official newspaper of the cit and notices were ■ailed to each owner of
affected property and property si uated wholly or partly within 350 of the
subject property; and
WHEREAS, a public hearing before he City Council was held on Noveober 16,
1989, where all interested parti were heard, the Council having considered
all the facts and recomaendation concerning the lot split with variance;
NOW, THEI2EFORE, BE IT RESOLVED, at the City Council accepts and approves the
lot split located on the uniwpro d Arkwright Street north of Wheelock Parkway,
with variance for the uniaproved treet frontage; and
BE IT FURTHEB RESOLVED, that a c py of this resolution will be eailed by the
City Clerk to the applicant at 1 67 Etna Avenue, St. Paul MN 55106, Planning
Adrinistrator and to the Zoning �inistrator.

PURPOSE: To review a lot split wi h variance to divide a parcel now having four
separately described lots in one having two lots; a variance is required
because the property does no have street frontage.
STAFF RECOMMENDATION: Staff reco ends that the lot split with variance be
denied.

Attached please find the applicati n, survey and staff report for the James J.
Wingate request for a lot split wi h variance for property located adjacent to
unimproved Arkwright Street, betwe n Larpenteur and Wheelock Parkway.
The parcel now is vacant. The lot split was requested for the property prior
to securing street access therefor a variance is requested. Staff recommends
denial of the application because he proposal does not meet the intent of the
subdivision ordinance if access is not first acquired; subdividing the parcel
would be premature.

A. PURPOSE: To consider a lot s lit with variance to divide a parcel of
land from east to west so one half of the property is adjoining
unimproved Arkwright Street a d the other half is adjoining the
unimproved alley.
A variance is required becaus there is no street frontage.
B. �ITE & AREA CONDITIONS: This site is vacant land. It is located
approximately 160 feet north f Wheelock Parkway ,just off the top of a
small hill. The slope of the property is approximately 188. The
surrounding area is wooded la d with residential homes to the north.
There is a City ponding area o the east.
C. MINIMUM LOT REOUIREMENTS: Fo the R-3 District, b000 Square feet in
area and 50 feet in width.
D. CURRENT WIDTH � AREA: 160 fe t along unimproved Arkwright Street and
20,000 square feet in area.
E. PROPOSED WIDTH & AREA: For t e east parcel - 62.5 feet in width &

F. HISTORY: Alethea Habberstad wned this property and some surrounding
land until her death in 1975. In 1976, Public Works Department obtained
some adjoining land to create a ponding area known as Wheelock Ponding
Site. The applicant, James W ngate, bought his property from the estate
of Ms. Habberstad in May of 1 77. In 1980, the applicant petitioned to
have the city-owned property outh of his property vacated (Lots 1,2,3,
Block 1, Dawson's Addition an Lot 9, Block 2, Clark's 2nd Addition) so
he could have access from Whe lock Parkway. On April 8th, 1980, City
Council held a public hearing on the vacation petition. Valuation

The applicant's proposal can eet all conditions except conditions 1 and
4. Arkwright is unimproved this area. Public Works Sewers Division
staff have indicated that Ar right will not be improved as a through
street because the ponding s e to the south must be maintained.
Therefore the parcel has nei er frontage nor access to municipal
services.
2. The City Council may grant a ariance from the subdivision regulations
when compliance would create n unusual hardship, based on six findings
of Section 67.703. These req irements and the applicant's ability to
meet them with this current p oposal are as follows:
1) The intent of the (subdivi ion) chapter is met.
The intent of this chapter is to provide for the orderly, economic,
and safe development of la . This lot split was found in 1980 to be
economically unfeasible. e conditions have not changed since that
time except for rising cons ruction costs. Development which would
not have access to city se ices or street frontage does not meet the
intent of the chapter.
2) The granting of the varian e wi11 not be detrimental to the public
safety, health or welfare o injurious to other property or
improvements in the neighbo hood in which the property is Zocated.
This lot split could advers ly affect improvements of the entire area
if acted on prematurely. is parcel and the surrounding area has
the potential of being full developed with single family homes.
3) The conditions upon which he request for a variance is based are
unique to the propertp for hich the variance is sought and are
generally not applicable to other property.
This property is landlocked do to Arkwright Street being unimproved.
The proposed split would be favorable if the lots to the south were
vacated.
4) The Ziteral interpretation f the provisions of this chapter would
deprive the applicant of ri hts co�only enjoyed by other properties
in the same zoning district
The applicant first needs t secure access to his property. Without
access to the property, cre ting two landlocked parcels is not in the
spirit of the provisions of this chapter.

Dear Mr. Czaia:
With respect to supplying water o the two lots created by Subdivision 290,
the Saint Paul Water Utilit staff is recommending denial of the
developer's petition to serve t e property from an extension of the water
main at Wheelock Parkway and E gemont Street. In our opinion, water main
assessments can only be levied against properties abutting the street in
which the public water main i located. As you know, the petitioner's
property is four lots removed fr m the Wheelock Parkway right-of-way.
Any questions may be referred to Allen Coulter at 292-6583.
