WHERREP,S, on November 5, 1986, fi e year-old Jennifer Ehlenz ran into the
street on Montana Avenuevest of Oxford Street and was struck by a squad car
driven by a St. Paul police officer. ennifer Ehlenz sustained injuries and
her parents incurred medical expenses s a result of the accident; and
Wf�REAS, since the accident inv ved a pedestrian and a business vehicle
operated in the course of the ofticer's du�ies, the No Faul� Act requires the
insurer of the vehicle to pay the ped s'c.rian's medical expenses or reimburse
an insurer who paid those expenses; d
Wf�REAS, State Farm Insurance C any paid the �dical bills incurred by
Jennifer Ehlenz's parents on her beha f; and
WHEREAS, the City Attorney's O ice reco�rmends that this case be fully
and c�letely ccxnpromised for $9,62 .55; now, therefore, be it
RESOLVED, that upon receipt of an e�ecuted Release, the proper City officials
are hereby authorized and directed t pay out of the Judgment and Compromise
Fund 09065-0511-000 �o State Farm In urance Ccxnpany as subrogee for Timothy
Ehlenz the sum of $9,620.55 to fully and completely settle any and all claim�
or matters made or not made against e City of St. Paul arising out of the
accident of November 5, 1986.
