An ordinance amending Chapter 60 of the Saint Paul Legislative
Code pertaining to zoning for the City of Saint Paul and the
zoning e�aps thereof.
WHEREAS, Pursuant to Minnesota Statutes, 462.357 and § 64.400 of the
Legislative code, Michael D. Killa duly titioned to rezone 2047 Grand Avenue
located on the north side of Grand Avenu between Cleveland and Prior Avenues,
from RM-2 to B-2C for the purpose of con rting part of the existing structure
for general office use, the petition hav' g been certified by the Planning
Division on March 2, 1989 as having been onsented to by at least two-thirds
of the owners of the area of the propert to be rezoned, and further having
been consented to by at least 67% of the owners of the property situated
within 100 feet of the total contiguous roperty within one year preceding the
date of the petition; and
WHEREAS, The Zoning Committee on April 2 , 1389 conducted a public hearing for
the purpose of considering the rezoning etition, and pursuant to Section
107.03 of the Administrative Code, submi ted its recommendation to the
Plannir►g Commission that the petition be granted; and
WHEBEAS, The Planning Commission conside ed the rezoning petition at its
meeting held on May 26, 1989 and reco�me ded that the City Council deny the
petition; and
WHEREAS, Notice of a public hearing befo e the City Council on said rezoning
petition was duly published in the offic'al newspaper of the City on June 17,
1989 and notices were duly mailed to eac owner of affected property and
property situated wholly or partly withi 350 feet of the property sought to
be rezoned; and

July 3, 1989 wherein all interested pers ns were heard, and the Council having
considered all the facts and recommendat ons concerning the petition; now,
therefore,
THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Sectio 1.
That the zoning map of the City of Saint Paul, Sheet No. 17, as
incorporated by reference in Secti n 60.301 of the Saint Paul
Legislative Code, as a�ended, is h reby further amended as follows:
That property located on the north side of Grand Avenue between
Cleveland and Prior Avenues, being more particularly described as Lot
2$, Block 2, Rosedale Park Additio be and is hereby rezoned fro� RM-2
to B-2C.
Sectio 2.

On April 6, 1989, the Zoning Committe of the Planning Commission held a public
hearing on this rezoning. The petiti ner testified. At the close of the
public hearing, the Committee voted 3 to 2 to approve the rezoning based on
staff findings.
On May 26, 1989, the Planning Commiss'on reversed the Zoning Committee's
recommendation and voted to deny the ezoning on a vote of 12 to 1.
This rezoning is scheduled to be hea by the City Council on July 6, 1989.
Please notify me by July 3, 1989, if any member of the City Council wishes to
have slides of the site presented at the public hearing.

WHEREAS, Michael D. Killa, file #10444, h s petitioned to rezone 2047 Grand Avenue,
situated on the north side between Clevel nd and Prior Avenue, from RM-2 to B-2C for
the purpose of permitting the operation o a small business office in one portion of
the building and allow the remainder to b used as residential property; and
WHEREAS, the Zoning Committee of the Plan ing Commission on April 6, 1989, held a
public hearing at which all persons prese t were given an opportunity Lo be heard
pursuant to said application in accordanc with the requirements of Section 64.400
of the Saint Paul Legislative Code; and
WHEREAS, Saint Paul Planning Commission, ased on the evidence presented to its
Zoning Committee at the public hearing as substantially reflected in the minutes,
made the following findings of fact:
The rezoning requested constitutes an ext nsion of commercial use into an area that
is residentially zoned and occupied and a such is inconsistent with the
Comprehensive Plan for this portion of th city.
The rezoning of the site to B2-C would pe it use of the entire property for future
commercial uses and this is not in the be t interests of neighboring residential
property.
NOW, THEREFORE, BE IT RESOLVED, by the Sa'nt Paul Planning Commission that the
petition of Michael D. Killa to rezone pr perty at 2047 Grand Avenue, more
particularly described as Lot 28, Block 2, Rosedale Park Addition, from a RM-2
zoning classification to a B-2C zoning cl ssification is inconsistent with the
Comprehensive Plan for the City; and
BE IT FURTHER RESOLVED, that the Saint Pa 1 Planning Commission does hereby

Michael D. Killa (#10444) : A Rezoning rom RM-2 to B-2C for property located
at 2047 Grand Avenue to permit use of e-half of the two-family dwelling as

The applicant was present; there was n opposition present at the hearing.
Mr. McGuire showed slides of the site d reviewed the staff report with a
'recommendation for approval. He said at District 14 sent a letter of
conditional support, that the Grand Av ue Business Association sent a letter
in support and that one letter in oppo ition was received from a Summit Avenue
�neighbor.
Bill McCrum, 1133 Palace Avenue, state that he is Michael Killa's partner in
their general construction and archite tural firm specializing in residential
remodeling. He said that their Grand enue neighbors hsve agreed to the
rezoning pending a deed restriction to limit the amount of the. rear yard to be
paved and that the remainder of the ba ard will be used for green space in
order to maintain the residential char cter of the house.
Ms. Zieman inquired about the rental its in the house. Mr. McCrum replied
that there are three apartments and on office in the structure and described
the configuration.
Ms. Hirte asked about signage and mate ials which could be used for paving of
the parking lot. Mr. McGuire outlined signage restrictions and zoning code
requirements for the paving of parking lots.
There being no further testimony, Ms. orton closed the public hearing.
Committee discussion followed regardin the number of parking spaces needed.
Mr. Repke moved to recommend approval f the Rezoning from RM-2 to B-2C based
on staff report findings. Mr. Levy se onded the motion.
The motion passed on a roll call vote f 3-2 (Zieman, Hirte) .

from residential to commercial and s such, change its use from
a dunlex to a business.
As homeowners within 350 feet of th s property, we are very
concerned about the colrmiercializati n of our neighborhood and
the proliferation of businesses in primarily residential area.
We believe that our neighborhood al eady has too many businesses
within it and too much traffic, con estion, and parking problems
as a result of these businesses.
�Je realize th at the intent of B-2C oning is to retain the residential
character of a p roperty while permi ting the operation of a business.
However, the logical consequences o co�Yerting a proaerty from
residential to business use are the creation of additional parking
spaces and erection of signs, Zhes are both unsightiv and destructive
to the residential character of the neighborhood. �ere is also the
possibility that major modification would be made tc the prooerty as
business needs change. In addition there is the uncertainty about
how the property will be used and w at businesses wi.il be o�erated by
future owners of the property.
We are residents of a ciistinctive d historical neighbo�hood and we
pa,y very high taxes i.n order to liv in this particular residential
area. We oppose ari,y additional th ats to our neighborhood's

A. PURPOSE: To rezone an existing duplex rom RM-2 to B-2C, to permit the
operation of a small business office i one portion of the building and allow
the remainder to be used as residential property.
B. PARCEL SIZE: The property has 50 feet f frontage on Grand Avenue, and a depth
of 160 feet. The area of the parcel is 8,000 square feet.
C. EXISTING LAND USE: The site is curre ly occupied by a wood frame structure
originally built as a duplex. A two � ar garage occupies a part of the rear
yard.
D. SURROUNDING LAND USE:
North: Single family residences along Summit Avenue. The College of St. Thomas
lies to the northwest.
East: Properties to the east are gen rally developed with mixed density
residential uses.
South: Properties to the southeast ar mixed density residential. To the
southwest, property is develop d with B-2 Commercial uses.
West: A Seven-Eleven store occupies he next site to the west.
E. ZONING HISTORY: Prior to 1975 the sit was zoned commercial, but occupied by a
duplex residential use.
F. �ISCUSSION: The rezoning site abuts o cupied B-2 property which has some
adverse influence on this property. N wspaper collection boxes on the adjacent
site abut the front yard area of the s te, and the convenience store use of the
adjoining property is noisy. The owne believes that use of the side of the
duplex closest to the B-2 property by low intensity office use will help
buffer the tenant on the oppisite side of the building, and the residential area
to the east.

Plans provided with the application ndicate that the total floor area of the
structure which will be devoted to a commercial use will provide 362.75 square
feet of space, enough for one small ffice. The property owner and neighbors
have agreed to a deed restriction li iting the amount of the rear yard which
will be paved. The paved area and th existing garage structure will provide
sufficient off-street parking space or the uses proposed under the terms of
Section 60.573. Required Conditions. for uses in B-2C zones.
G. STAFF RECONIl�IENDATION: Although the roposed use of the site is an extension of
commercial use into a residential ar a, such use relationships are not uncommon
along Grand Avenue. The rezoning ca also be viewed as a logical expansion of
an existing commercial area. The mi ed use character of the B-2C zone will
provide reasonable buffering between the more intensive B-2 uses to the west.
The provision of off-street parking roposed for the site is adequate, and the
area neighbors most impacted by the roposal feel adequately protected provided
the agreed to deed restrictions are place when the property is rezoned. The
Staff recommends approval of the req ested rezoning to B-2C.

We would like to recind our iynatures on the petition
regardiny the rezoniny of the �ro erty at 2047 Grand Ave. We
were under the mistaken impressio that a site plan would give
the neiyhbors some control over t e number of parking spaces in
the rear of the building. We now understand that the site plan
could be ammended, i.e. , the park ' ng could be ex�anded, without
our approval as long as it isn ' t gainst the zoning code. There
is yuite a larye yard in the rear of this buildinc� and we do not
want to see it turned into a park ' ny lot.
The current owner has yiven s assurances that he will limit
the �arkinc� but that will not pre ent future owners from doiny
what they want. What we, the nei hbors, are askiny for is that a
restrictive covenant be attached o the property ' s deed, limiting
the �arking spaces and providing or some yreen space in the rear
of the buildiny.
It is not our intention to � event Authentic Construction
from operating out of this buildi y but we do want some input
regarding the maintenance ot the roperty. We see this as a
�ositive step for both the neiyhb rhood and the buildiny owner,
since the Planniny Commission may consider such a covenant in its
rezoning decision.
