unsuccessful canc3idate for electi n fram District 1 to the City Council

Members of the City Council
Pursuant to the request of Ci y Council candidate Bill Wilson and
in accordance with State Law, I have recounted the ballots of the
November 7, 1989 election fo District 1 and submit my summary
report of the recount and also 11 challenged ballots.
The duty of the City Council, as the Canvassing Board, is to rule
on the challenged ballots an incorporate the results into the
summary statement. The Canv ssing Board shall then certify the
results of the recount.
I will present each ballot in ividually for your consideration and
action. After hearing the basis for the challenge from the
candidate, or the candidate' s representative, you should vote to
accept the challenge or deny t e challenge.
Upon completion of your dec sions and after incorporating the
results into the summary state ent, a resolution should be adopted
declaring the results and dec aring one of the candidates elected
to the office of Councilmember for District 1.

Subd. 2. More than one candidate to be lected; piling. Where more than one �- , �

Subd. 13. Identifying ballot. If a ballo is marked by distinguishing characteris-
tics in a manner making it evident that th voter intended to identify the ballot, the
entire ballot is defective.
Subd. 14. No votes for certain offices. f the number of candidates for an office
. is equal to the number of individuals to b elected to that office, and the voter has
not marked any name, no vote shall be c unted for any candidate for that ofTice. -
_ Subd. 15. Blank ballot for one or mor offices valid. If no name or position is `
marked and no name is written in, the bal ot is blank with respect to that office or
question. A ballot that is blank with respe t to one or more offices or questions is

Subdivision 1. Information requi ements. Precinct summary state-
ments shall be submitted by the election jud s in every precinct.The election judges
� shall complete three or more copies of the s mmary statements, and each copy shall
� contain the following information for each k nd of ballot: �
(a) the number of votes each candidate r eived or the number of yes and no votes
on each question,the number of undervotes o partially blank ballots,and the number
of overvotes or partially defective ballots wit respect to each of�ce or question;
(b) the number of totally blank ballots,t number of totally defective ballots,the -
number of spoiled ballots, and the number o unused ballots;
(c) the number of individuals who voted at the election in the precinct; �
(d) the number of voters registering on e ection day in that precinct; and �' ,
(e) the signatures of the election judges w o counted the ballots certifying that all _

Subd. 2. Sealing in envelopes. The ele tion judges shall place a full set of
completed summary statements in each of t ee separate envelopes and seal them
so that the envelopes cannot be opened wit out leaving evidence that they have -
_ been opened. The election judges shall then s n each envelope over the sealed part -
so that no envelope can be opened without isturbing the continuity of the signa-
�`,i` tures. Each of the envelopes shall show subst ntially the following information on -

The procedures carried out in this rec unt are to be followed according to the
Minnesota State Statute 204C.36 and Se retary of State Rules on Recounts -Chapt.
8235, specifically 8235.1000 for Elect onic Voting Systems.
"The scope of an automatic or administ tive recount is limited to the recount of
the ballots cast and the declaration o the person nominated or elected."8235.0200
1.) The ballot box compartments have a 1 been checked in each of the 23 precincts
and will be empty prior to the rec unt testing.
2.) The prom packs* remain sealed sinc initial programming was done and are now
sealed in each of the 23 precinct abulators to be used for the recount.
3.) The public counter for each machin shows zero votes cast and a zero tape
will be generated prior to testing to show no votes have been accumulated
prior to feeding in ballots for ta ulation(regular, absentee, write-ins) .
4.) Ballot postions on the initial tap agree with candidate ballot postions on
the ballot cards.
5.) Test Sample(8235.1000) . The test ample shall be from two precincts, one
selected by each candidate. In ea of the precincts selected, the sample
shall be at least 3� of the ballots cast or 50 ballots, whichever is the
greater.
-- Count sample ballots anually and tally.
-- Count sample ballots n automatic tabulating equipment/tally.
Manually fill in the "Test Sample" orm; stating precincts selected, by
whom, and the results.
6.) Then all ballots in District 1 must be recounted by precinct. A report of
recount results must be provided fo each precinct and a summary statement
of the recount compiled.
7.) The recount official shall present he summary statement of the recount and
any challenged ballots to the canva sing board. The canvassing board shall
certify the results of the recount. 8235.1100) .
