WHEREAS, the City collects s rvice charges for both taxable and
tax-exempt properties; and
WHEREAS, when property owner challenge service charges, the City
has the burden of proving th t the property value increased by
the amount of the service ch rge through a "market value"
analysis; and
WHEREAS, market value analysis is appropriate to measure the
benefit derived by a propert from a capital improvement, but it
improperly reflects the bene it associated with service charges
for ongoing operation and ma 'ntenance, and
WHEREAS, Minnesota law recog izes the distinction between a
charge for the installation f a capital improvement and a charge
for ongoing operation and maintenance;
THEREFORE, BE IT RESOLVED, t at the City of Saint Paul proposes
changes to Minnesota Statute , 1988, Chapt. 429 . 101 to expand the
defintion of benefit to incl de "properties that receive the
service. "
