My surveillance of this establish .ent taok place on June 19 , 1985 at ap-
proximately 11 :30 p.m. it w2s xtremely busy on this particular night and
when I enter•ed the establishment a doorsan asked me if I could be helped and I
indicated that I was looking for specific individual. he allo«ed me to go
do«nstairs into the bar and enter ainment area in an attempt to finci this in-
dividual if Z pro�ised I woulu i ave ii he was not present. = iII±Ln.eciiately
went downstair•s to view the oper tion and observed a standard bar operation
with the bartenc3er pouring alcohol'.c mi:�ed drinks directly irom the bottle and
using t;he appropr�iate nix when re ired. S only stayed a short time and left
the facility within 8 to 10 minu es. 4'hen I phoned the establishment, I was
told that _i might need to purchas a �5.00 guest c2rd, but it was O.K. to go
in.

RE: Private Club Investigation Gopher Elks Lodge, 739 Selby
As requested by the City Attorney, I accompanied Lt. Daryl Olson from
the Saint Paul Police Department ice Unit to Gopher Elks Lodge. We
arrived at the Gopher Elks Lodge, 739 Selby Avenue, at approximately
10:20 p.m. They had a security p rson at the door. Lt. Daryl Olson
identified himself as a vice offi er and me as Kris Van Horn from the
License Division to this person. He then opened the door to the lower
part of the building with a key.
We went to the bar where approxim tely 10 people were sitting and drink-
ing. I observed a female bartend r. We asked to speak to the person in
charge and went to sit at a table in the area. The music from the juke
box was so loud, I found it very ifficult to hear or understand what
was being said.
I don`t think the gentleman that 'ndicated he was the manager was very
familiar with the operation, and 'ndicated that Cornelius Brown was the
person that was in charge there ring the day. We asked the manager
how a person got in and were tol that you would have to be a member or
purchase a guest pass for $3.00 t the door.
There were bottles located behin the bar. I did not see whether they
Iiad names on them or not. Lt. 0 son had gone behind the bar to talk to
the bartender and check out the ottles. I stayed with the manager and
tried to find out more about how a person became a member. He indicated
that he thought that they were v ted in at a meeting, but he wasn't sure.
The guest passes were purchased t the door for $3.00 and logged in a
register that was kept upstairs. You didn't have to be with a member in
order to purchase a guest pass.
Lt. Olson finished his intervie and we went upstairs to talk to the
doorman. He indicated that you ould have to have a card or a key to
get in or have a guest pass whi was Iogged in a book that was kept
downstairs or someplace, but he didn't have it.

Two males, approximately 45-50 year old entered as we were leaving.
They indicated that they knew the d orman and had to wait for him to
open the door. I saw no cards sho and they did not have a key. We
left at 11:00 p.m.
On Monday at 8:00 a.m. , Cornelius B own contacted me and I informed him
that we had been observing the oper tion of all the Private Clubs. He
indicated that the large amount of eer in their coolers was for their
bowling team. On Tuesday and Thur ay nights the club gives them free
beer. He then changed it to Tuesd and Friday. I asked him where they
bought their liquor and he said at various liquor stores in the neighbor-
hood.

We are in receipt of your letter ising questions of whether there has
been a violation of our bottle cl license. We don't dispute there
could have been a violation by an employee. However, to assure there
is cc�m�liance with our present cl liscense, the following guidelines
will be iirurediately adopted, and ollowed by the Gopher Elks upon your
consent, effective� 7, 1989

1. All members and guest o wish to constune
liquor on the premises e required to supply
the Gopher Elks with th ir private liquor
stock which will be se ed in a locker by
the Gopher Elks and se ed to them upon request.
2. The Gopher Elks will se e and sell set-ups,
including ice, juice, p, water and other
chasers to the patrons der our present
club license.
3. Identification cards e issued by the Gopher
Elks to guests of rs free of charge.
The guest(s) must be a proved by a member of
this Lodge.
4. The Gopher Elks also grees to cornply with all
other relevant laws a fecting its club license.
5. In going over your c laint, I find that you
have been given the ong names of the persons
that manage our club. The following names are
correct: Manager: ck Cooper; Assistant
Manager: Robert Jon s; Night Supervisor: Milton
Milan. I hope this nform�ation will clear up
this point.

entering our establishment and require they
register at the door.
7. The names of all Brothers d Daughters of the
Elks in St. Paul, MN are 1'sted on a roster on
file with the club manage at 739 Selby Avenue.
8. I would like to inform yo that all of our help
is voluntary. We are a n n-profit organization
and we are in tYie process of selling our property
at 739 Selby and we are h peful that we will be
closing on or before Dec r 1, 1989.
Based on our assesr�nt, we believe the above eight conditions should
address the specific problems that may have existed. We don't wish
to contest the complaint, but requ st the City Council would accept
these stipulations to meet the req 'rements of the City ordinance.
We request that no penalty be ass sed against us because of a mis-
understanding by our new mernbers s to the requirements of a club
license.
The GOPHER ELK.S LODGE NO. 105 has been apart of the St. Paul community
for eight-three (83) years and ha tried to abide by the rules and
regulations of the Ci�cy of St. Pa l.
It will be our endeavor to meet t e ccxnpliance as set forth by the City
of St. Paul, Minnesota.

My surveillance of this establish ,ent took place on June 19 , 1�85 at ap-
proximately 11 :3G p .m. i� was xtremely busy on this particular night ar�d
when I enter�ed the establishment a doorman asked me if I could be helped and I
indicated that I was looking for specifi.c individual. he allowed me to go
downstairs into the bar and enter ainment area in an attempt to find this in-
dividual if Z promised I woul.0 i ave ii he was not present. ' ig�r.��ediately
went downstair�s to view the oper tion and observed a standard bar operation
with the bartender pouring alcohol'.c mi:�ed drinks directly from the bottle and
using the appropr�iate nix when re ired. I only stayed a short tinie and left
the facility within 8 to 10 minu es. U+'hen I phoned the establishment, I was
told that I might need to purchas a Y5.00 guest card, but it was d.K. to go
in.

RE: Private Club Investigation Gopher Elks Lodge, 739 Selby
As requested by the City Attorney, I accompanied Lt. Daryl Olson from
the Saint Paul Police Department ice Unit to Gopher Elks Lodge. We
arrived at the Gopher Elks Lodge, 739 Selby Avenue, at approximately
10:20 p.m. They had a security p rson at the door. Lt. Daryl Olson
identified himself as a vice offi er and me as Kris Van Horn from the
License Division to this person. He then opened the door to the lower
part of the building with a key.
We went to the bar where approxim tely 10 people were sitting and drink-
ing. I observed a female bartend r. We asked to speak to the person in
charge and went to sit at a table in the area. The music from the juke
box was so loud, I found it very ifficult to hear or understand what
was being said.
I don`t think the gentleman that ndicated he was the manager was very
familiar with the operation, and ndicated that Cornelius Brown was the
person that was in charge there d ring the day. We asked the manager
how a person got in and were told that you would have to be a member or
purchase a guest pass for $3.00 a the door.
There were bottles located behind the bar. I did not see whether they
had names on them or not. Lt. Ol on had gone behind the bar to talk to
the bartender and check out the b ttles. I stayed with the manager and
tried to find out more about how person became a member. He indicated
that he thought that they were vo ed in at a meeting, but he wasn't sure.
The guest passes were purchased a the door for $3.00 and logged in a
register that was kept upstairs. You didn't have to be with a member in
order to purchase a guest pass.
Lt. Olson finished his interview nd we went upstairs to talk to the
doorman. He indicated that you w uld have to have a card or a key to
get in or have a guest pass which was logged in a book that was kept
downstairs or someplace, but he d'dn't have it.

Two males, approximately 45-50 ye rs old entered as we were leaving.
They indicated that they knew the doorman and had to wait for him to
open the door. I saw no cards sh wn and they did not have a key. We
left at 11:00 p.m.
On Monday at 8:00 a.m. , Cornelius Brown contacted me and I informed him
that we had been observing the op ration of all the Private Clubs. He
indicated that the large amount o beer in their coolers was for their
bowling team. On Tuesday and Thu sday nights the club gives them free
beer. He then changed it to Tues ay and Friday. I asked him where they
bought their liquor and he said a various liquor stores in the neighbor-
hood.

Dear Mr. Weyandt:
We are in receipt of your letter raising questions of whether there has
been a violation of our bottle c ub license. We don't dispute there
could have been a violation by employee. However, to assure there
is cornpliance with our present c ub liscense, the following guidelines
will be inrnediately adopted, and followed by the Gopher Elks upon your
consent, effective�t 7, 198 :

1. Al1 �rs and guest ho wish to consume
liquor on the premises e required to supply
the Gopher Elks with th ir private liquor
stock which will be se ed in a locker by
the Gopher Elks and se ed to them upon request.
2. The Gopher Elks will se e and sell set-ups,
including ice, juice, p, water and other
chasers to the patrons der our present
club license.
3. Identification cards ar issued by the Gopher
Elks to guests of inemb� s free of charge.
The guest(s) must be a roved by a member of
this Lodge.
4. The Gopher Elks also a ees to comply with all
other relevant laws af cting its club license.
5. In going over your laint, I find that you
have been given the wr g names of the persons
that manage our club. e following narr�s are
correct: Manager: Ja Cooper; Assistant
Manager: Robert Jones, Night Supervisor: Milton
Milan. I hope this in ormation will clear up
this point.

6. We will throughly screen a 1 guests of inembers
entering our establishment and require they
register at the door.
7. The names of all Brothers d Daughters of the
Elks in St. Paul, M[�1 are 1' ted on a roster on
file with the club manager t 739 Selby Avenue.
8. I would like to inform you hat all of our help
is voluntary. We are a non profit organization
and we are in the process o selling our property
at 739 Selby and we are ho ful that we will be
closing on or before Dec r 1, 1989.
Based on our assesment, we believe t e above eight conditions should
address the specific problems that y have e�sted. We don't wish
to contest the ccxriplaint, but reques the City Council would accept
these stipulations to meet the requi ements of the City ordinance.
We request that no penalty be assess d against us because of a mis-
understanding by our new memb�rs as the requirements of a club
license.
The GOPHER ELKS LODGE NO. 105 has be apart of the St. Paul community
for eight-three (83) years and has t 'ed to abide by the rules and �
regulations of the City of St. Paul.

of St. Paul, Minnesota.
