Sincerely, ��-� /� • �G�C� Peggy A. �eichert � ��� Deputy Director for Planning PAR:rm � Attachments city of saint paul planning commission reso tion file number 89-65 � ' te July 28, 1989 WHEREAS, Port Authority of Saint Paul, ile #10475, has petitioned to rezone 403 Maria Avenue situated on both sides of aria Avenue between East Sixth and East Seventh Streets from OS-1 and RM-2 to B 2 for the purpose of permitting relocation of Metropolitan State University; and WHEREAS, the Zoning Committee of the P1 nning Commission on July 20, 1989, held a public hearing at which all persons pre ent were given an opportunity to be heard pursuant to said application in accorda ce with the requirements of Section 64.400 of the Saint Paul Legislative Code; and WHEREAS, Saint Paul Planning Commission based on the evidence presented to its Zoning Committee at the public hearing s substantially reflected in the minutes, made the following findings of fact: 1. A consent petition was filed on Marc 17, 1989, and after the mandatory seven day waiting period was determined to be insufficient, containing only 34 of the required 37 signatures for sufficien y. 2. A second petition containing the si atures of 39 property owners was filed in June, 1989. On June 20, 1989, the s cond petition was declared sufficient. 3. The Metropolitan State University pr poses to use the site as a university campus. Under the provisions of Sec ion 60.352. (g) , ". . .colleges, universities, . . .seminaries, and othe such institutions of higher learning, public and private, offering courses in general, technical, or religious education and not operated for profi ; . . ." are permitted uses. 4. Higher education facilities are perm tted in the B-2 district subject to three pro�isions. These are: a. Dormitories or other group stude housing shall not be permitted in the district; b. When an institution is establishe in the district, the institution shall be required to provide the minimum ber of off-street parking spaces for employees, staff or students as s t forth in Section 62.102(g)(2)(e) . Hirte, Morton, Tra y, Wencl and Zieman; and Mr. Repke of the Zoning Committee; Mr. Se al, Assistant City Attorney; Ms. Lane of the Building Inspection nd Design Division; Mr. McGuire, Ms. Murray and Mr. Ryan of t e Planning Division staff. The meeting was chaired by Gladys rton, Chairman. o Author t u 4 A Rezoning from OS-1 and RM-2 to B-2 for property located at 403 Maria A enue to permit the relocation of Metropolitan State University. The applicant was present; there wa no opposition present at the hearing. Mr. McGuire showed slides of the si e and reviewed the staff report with a recommendation for approval. He st ted that District 4 sent a letter recommending approval. Ms. Hirte r quested that the staff report reference to Inver Hills Community College be co rected to read Lakewood Community College. John Campbasso, Port Authority of S int Paul, and Dan Kirk, executive assistant to the president of Metro State, testified. Mr. Kirk said that the school has now completed purchase o 8.2 acres of the site and their purpose in requesting rezoning of the site s to simplify development of the site. Committee members requested informa ion from Mr. Kirk regarding anticipated enrollment of full- and part-time s udents, plans for consolidation into fewer sites, and parking for students and staff. Ms. Hirte moved to recommend approv 1 of Rezoning from OS-1 and RM-2 to B-2 based on staff recommended findings and provisions. Mr. Repke seconded the motion which passed on a unanimous oll call vote (6-0) . Ms. Hirte asked that the minutes re lect phone calls received by her and Ms. Morton from Mr. Neid expressing his support of the rezoning. STAFF INVESTIGATION AND REPORT: DATE: July 11, 1989 BY: Charles L. McGuire A. PURPOSE: To consider a petition to rez ne the property to permit its use as a university campus with associated parki g. With a B-2 Zoning, no special condition use permit is required. B. PARCEL SIZE: The property is bounded g nerally by E. Seventh St. , Bates Ave, E. Sixth St. and Mounds Boulevard. The tw parcels contain 404,496 square feet, or about 9.3 acres. C. EXISTING LAND USE: Some buildings from the old Saint John's Hospital currently occupy the westerly parcel of the site. During the past year these structures were used as classroom and office space by Metro State University, and Lakewood Community College. The easterly site i a paved parking facility. D. SURROUNDING LAND USE: North: Industrial and mixed commercial uses in I-1 and B-3 zones. East: Mixed density residential uses n RM-2 zoned property. South: Mixed commercial and vacant pro erty adjacent to the westerly parcel, and mixed density residential p operty ad�acent to the easterly parcel. Properties to the south are zon d B-2 and RM-2. West: Open space and major transporta ion corridor uses. E. ZONING CODE CITATION: Section 64.400, f the zoning code provides the authorization for amendment of the zoni g code by petition of two thirds of the owners of all properties within 100 fee of the sub,ject property and 67� of the owners of property to be rezoned. F. ZONING HISTORY: Saint John's Hospital as originally established on a part of the site facing Mounds Boulevard. Fron ages along Maria and E. Sixth St. were developed with low density residential ood-frame structures. In 1939, a Special Condition Use Permit was grante to establish a used car lot along the southerly side of E. Seventh street. H spital expansion continued over the years and the housing on the block was ught up for off-street parking lots. File #10475 Page �ao These lots were subsequently converte to building expansion space as the hospital grew. In the 1970's, in res onse to the increasing need for off-street parking space, a new parking facility was developed on the block bounded by East Seventh Street, Bates Avenue, East Si th Street, and Maria Avenue. This space was expanded on several occasions dur ng the 1970's. G. FINDINGS: 1. A consent petition was filed on M rch 17, 1989, and after the mandatory seven day waiting period was dete ined to be insufficient, containing only 34 of the required 37 signatures or sufficiency. 2. A second petition containing the ignatures of 39 property owners was filed in June, 1989. On June 20, 1989, the second petition was declared sufficient. 3. The Metropolitan State University roposes to use the site as a university campus. Under the provisions of ection 60.352. (g) , " . . .colleges, universities, . . .seminaries, and o er such institutions of higher learning, public and private, offering cour es in general, technical, or religious education and not operated for pr fit; . . ." are permitted uses. 4. Higher education facilities are p rmitted in the B-2 district sub�ect to three provisions. These are: a. Dormitories or other group stu ent housing shall not be permitted in the district; b. When an institution is establi hed in the district, the institution shall be required to provide the min mum number of off-street parking spaces for employees, staff or studen s as set forth in Section 62.102(g)(2)(e) . The institution shall be requi ed to provide additional parking spaces only when the minimum number o parking spaces will have to be increased due to a more than ten (10) pe cent gain in the number of employees, staff or students. Thereafter additional parking spaces will have to be provided for each subsequent g in of more than ten (10) percent in the number of employees, staff or tudents; and c. To determine compliance with p rking requirements in item 2. above, the institution must file an annua report with the planning administrator stating the number of employee , staff and students associated with the institution. H. STAFF RECOMMENDATION: Use of this si e by a university or college appears to be an appropriate land use. The use on he site has been historically that of an expanding institution. The site is a equate in size to accommodate the current and near term future needs of Metropo itan State University for a Saint Paul campus. Based on the above recommend d findings and provisions, staff recommends approval of the requested ezoning.
