RESOLVED , that upon the etition of Rollee Smith Halper, et
al, per Finance Department ile No . 13-1g89, that part of the
alley in Block 1, Stinson ' Boulevard Addition to St . Paul,
hereinafter described, be a d the same is hereby vacated and
discontinued aa public proper y
The vacated property is escribed as follows :
Beginning at th southwest corner of Lot g,
Block 1 , of said S inson ' s Boulevard Addition to St .
Paul; thence East , assumed bearing, along the south
line of Lots 3 � 4 � 5 , 6 , 7 , 8 and 9, said Block 1 a
distance of 276 . 5 feet ; thence South 6 degrees 56
minutes 05 seconds Eaat a distance of 20. 15 feet to a
point on the nort line of Lot 16 , Block 1, of said
Stinson' s Boulevar Addition to St. Paul ; thence West
along the north lin of I,ots 10 , 11 , 12 , 13 , 14 , 15 and
16 , said Block 1 a distance of 278.83 feet to the
northwest corner of said Lot 10 , Block 1, of said
Stinson' s Bouleva d Addition; thence North 00 degrees
17 minutes 56 seco ds West a distance of 20 •00 feet to
the point of begin ing.
Also all of the ea ement in the land necessary for the
slopes , cuts , and ills , including the right of removal
of lateral suppo t from subject land or remainder
thereof occasio ed by excavation thereof or
construction of sl pes in the grading of said right-of-
way lying within or adjacent to said vacated area
described above .
This vacation shall be s bject to the following conditions :

1. That the vacati n be subject to all the terms and
conditions of C apter 130, codified March l , 1981
of the Legislat ' ve Code , as amended .
2. That a permanen utility easement be retained
within the vaca ed area , to protect the interests
of U. S . West .
3 . That a permanen utility easement be retained
within the vac ted area, to protect the interests
of Northern Sta es Power Company.
4. That the petiti ners , their heirs , and assigns
ahall , in lieu f compensation for this vacation,
pay all costs a d expenses for the construction and
extension of a torm water drain as shown on
Exhibit "A" att ched hereto and made a part of this
resolution. Th petitioners ' contractor shall
construct this storm sewer extension in accordance
with applicable City codes , ordinances , and
specifications and shall be subject to the approval
of the Public orks ' Sewer Engineer. This vacation
shall be autom tically void if the petitioners ,
their heirs , a d assigns fail to conetruct this
sewer extensio within 180 days of the publication
date of this r solution and said vacated alley
shall automati ally revert to the City without
charge or cost
5 . That the petit oners , their heirs , and assigns ,
shall pay 11 costs and egpenses for the
landscaping of the parking lot located on lots 10
through 16 , B1 ck 1, Stinson' s Boulevard Addition
in accordance ith specifications to be set forth
in a site plan This site plan will be supplied to
and approved b the Department of Planning and
Economic Devel pment , Zoning Division, within 60
days of the pu lication date of this resolution.
Construction o the approved landscaping shall be
completed by ovember 30 , 1gg0.
6. That the peti ioners , their heirs , and assigns , by
acceptance of the terms and conditions of this
vacation agre to indemnify, defend, and save
harmless the ity of Saint Paul , its officers , and
employees fro all suits , actions , or claims of any
character bro ght as a reault of injuries or
damages recei ed or sustained by any person,
persons , or p operty on account of this vacation or
petitionera ' se of this property, including but
not limited t a claim brought because of any act
of omission, eglect , or misconduct of said
