Classified Confidential Employees Association Memorandum of Agreement
Summary
1. Use of Sick Leave for De ende t Care
An employee may now use up to 40 hours of sick leave, per incident,
to care for or make arrangeme ts for the care of a sick or disabled
parent, child or household me ber.
2. Flexible Working Arran�ements
Employees may now, through mu ual agreement with the Employer, work
flexible schedules and share obs.
3. Guaranteed One-Year Leave of bsence
A 12 month unpaid leave of ab ence will now be granted to a natural
parent or an adoptive parent ho requests same in conjunction with
the birth or adoption of a ch ld. Such leave may be extended for an
additional 12 months by mutua agreement between the Employer and the
employee.
4. Holidavs
The Employer may designate th day after Thanksgiving as a paid
holiday. In the event such d signation takes place, the Columbus Day
holiday would be deleted from the list of paid holidays.

MEMORANDUM OF AGREEMENT
This Memorandum of Agreement is by a d between the City of Saint Paul and
the City of Saint Paul Classified Co fidential Employees Association. In
full settlement of negotiations, the parties hereto have agreed as follows:
1. Except as herein modified, the 1 88-1989 Agreement executed on
October 5, 1988 between the part'es shall be the basis of the
forthcoming labor agreement.
2. The following Articles attached ereto shall be a part hereof and become
effective upon execution of this emorandum:
A. Articles 3.11, 3.12 and 3.13 shall be added to the current
Article III.
B. Article 5.5 shall be added t the current Article V.
C. Article 16.3 and 16.9 regard' g leave of absence shall replace the
current Articles 16.3 and 16.9.
D. Article XXV regarding sick 1 ve usage for dependent care shall be
added.
E. Article XXV regarding terms agreement shall become Article XXVI.
It is understood that the above settl ment shall be recommended by the City
Negotiator, but is subject to approv by the City Administration and
adoption by the City Council.

3.11 Notwithstanding Articles 3.1 hrough 3.6, employees may, through
mutual agreement with the Emp oyer, work schedules other than
schedules limited by the norm 1 work day and work week as set forth
in Articles 3.1, 3.2 and 3.3. Overtime compensation for employees
working under such agreements shall be subject to the provisions, for
same, as set forth by the Fai Labor Standards Act.
3.12 For employees who wish to sha e a position, the employer will attempt
to provide options €or implem nting a sharing arrangement. Such an
arrangement must be mutually greed upon by the Employer and the
employees involved. Vacation, holiday and sick leave benefits for
employees who share a positio shall be pro-rated based upon the
percent of hours worked. Hea th insurance benefits shall be
administered in accordance wi the provisions of Article 10 of this
Agreement. In the event that ne of the employees participating in
the shared position is termin ed or terminates employment, the
Employer shall post the job sh ring vacancy for a period of ten (10)
days. If, at the end of ten ( 0) days, such vacancy cannot be
filled, the Employer shall hav the option of increasing the
remaining employee's work hour .
3.13 Articles 3.11 and 3.12 shall n t be subject to the provisions of
Article 6 of this Agreement. �

16.3 Any employee who has accumula ed sick leave credits as provided
above shall be granted leave ith pay, for such period of time as the
head of the department deems cessary, on account of sickness or
injury of the employee, quara tine established by a public health
enforcement agency, death of e employee's mother, father, spouse,
child, brother, sister, mothe -in-law, father-in-law, or other person
who is a member of the househ ld; and may be granted leave with pay
for such time as is actually cessary for office visits to a doctor,
dentist, optometrist, etc.
16.9 Maternity and Parental Leave. Pregnant employees of the City of
Saint Paul shall be eligible r the use of paid sick leave and
unpaid leave of absence in the same manner as any other disabled or
ill City employee. Such paid ick leave eligibility shall begin upon
certification by the employee' attending physician that the employee
is disabled in terms of her ab'lity to perform the duties of her
position.
A twelve (12) month Parental 1 ave of absence without pay shall be
granted to a natural parent or an adoptive parent, who requests such
leave in conjunction with the irth or adoption of a child. Such
leave may be extended an addit'onal twelve (12) months by mutual
agreement between the employee and the Employer. Refusal on the part
of the Employer to grant an ex ension of such leave shall not be
subject to the provisions of A ticle 6 of this Agreement.
Employees who return following such leaves of absence shall be placed
in a position of equivalent sa ary and tenure as the one held just
prior to the beginning of thei leave.

ARTICLE XXV - SICK LEAVE USAGE FOR EPENDENT CARE
25.1 In the case of a serious illn ss or disability of an employee's
child, parent or household me ber, the head of the department shall
grant leave with pay in order for the employee to care for or make
arrangements for the care of uch sick or disabled persons. Such
paid leave shall be drawn fro the employee's accumulated sick leave
credits. Use of such sick le ve shall be limited to 40 hours per
incident.
25.2 The head of the Department or the Personnel Director may require a
physician's certificate or ad itional certificates at any time during
an employee's use of sick lea e for the purposes stated in 25.1
above. All such certificates shall be forwarded by the appointing
officer to the Personnel Offi e.
If an employee is absent beca se of the provisions of Article 25.1
for three or fewer calendar d s he/she shall submit to the head of
the Department a certificate igned by the employee stating the
nature of the child, parent, household member's sickness. If the
sickness continues for more t n three calendar days, no further sick
leave shall be granted unless r until a physician is consulted. The
sick leave may be continued fr m and include the day of consultation,
but only if a certificate sig d by the physician certifying to the
nature and period of the perso 's sickness is submitted and approved
by the head of the department nd forwarded to the Personnel Office.
25.3 No sick leave shall be granted for the above reasons unless the
employee reports to his/her de artment head the necessity for the
absence not later than one-hal hour after his/her regularly
scheduled time to report for w rk, unless he/she can show to the
satisfaction of the department head that the failure to report was
excusable.
25.4 An employee shall be paid unde the provisions of this paragraph only
for the number of days or hour for which he/she would normally have
been paid if he/she had not be n on sick leave.
