WHEREAS, the Department of Com unity Services is authorized by CF89-1007
to acquire Lots 5 and 6, Block 6, Edw n M. Ware's Cumberland Addition Plat 2
(378 West Wheelock P�rkway) to add to Wheelock Parkway, and
WHEREAS, there is additional p ivately owned land immediately south of
said Lots 5 and 6, which is vacant an should also be acquired for Wheelock
Parkway and for bluff preservation,
NOW THEREFORE BE IT RESOLVED, y the Council of the City of Saint Paul ,
upon recommendation of the Mayor and dvice of the Long Range Capital
Improvement Budget Committee, that t scope of the project entitled Wheelock
Parkway Acquisition, as included in he 1989 Capital Improvement Budget
(C89-3F003) shall be revised to incl de acquisition of vacant properties
immediately south of Lots 5 and 6, Block 6, Edwin M. Ware's Cumberland Addition
Plat 2.

WHEREAS, Mike Maggi, has submitted he attached proposed lot split for City
Council approval; and
WHEREAS, the Department of Plannin and Economic Developoent and Public Works
have reviewed the proposed lot spl� located on the 850 Forest Street and 859
Ducheas Street, as described on th attached survey; and
WHEREAS, the proposed lot split �e s the require0ents of Chapter 67.304 of the
Zonin� Code, except for the mini�u lot size for the single fa�ily residential
district; and
WHEREAS, notice of public hearing fore the City Council was duly published in
the official newspaper of the city nd notices were �ailed to each owner of
affected property and property sit ted wholly or partly within 350 of the
subject property; and
WHEREAS, a public hearing before t City Council was held on October 12, 1989,
where all interested parties were ard, the Council having considered all the
facts and recommendations concerni the lot split with variance;
NOW, THEREFORE, BE IT RESOLVED, th t the City Council accepts and approves the
lot split located at 850 Forest St et and 849 Duchess Street, with variance
for minimun lot size for a single a�ily structure in a I-1 district; and
BE IT FUBTHER RESOLVED, that a cop of this resolution will be �ailed by the

A. PURPOSE: To consider a lot split ith variance to permit division of the
parcel into two separate legal des riptions.
A variance is required because the single family home requires a minimum lot
size of 5,000 square feet. The pr posed lot split with variance requests a lot
size of 3,321 square feet, for a v riance of 1,679 square feet.
B. SITE & AREA CONDITIONS: The site h s two buildings on a single lot of record.
The building with the address of 8 0 Forest Street is a two story commercial
building that is currently being u e as a bar. The building with the address of
849 Duchess Street is a two story uilding that is a single family home.
The adjacent properties to the nor h, east, south and west are developed for
parking or industrial use.
C. MINIMUM LOT REOUIREMENTS: Minimum lot size required for a single family home in
I-1 district, is the minimum requi ement set in the R-4 requirement of 5,000
square feet. The commercial struc ure does not require any minimum lot size.
D. CURRENT WIDTH AND AREA: The curre t width of the lot is 50.00 feet and both
buildings are on this single lot w ich has a lot size of 6,571 square feet
E. PROPOSED WIDTH AND AREA: The prop sed lot width for both new lots would be
50.00 feet. Parcel A (commercial tructure) would retain the lot size of 3,250
square feet. Parcel B (residentia structure) would obtain the lot size of
3,321 square feet.

F. REOUIRED FINDINGS:
1. The requested lot split meets all requirements of Section 67. 304 of the
zoning code except the minimum lo size requirement for a single family
residential home.
2. The City Council may grant a vari nce from the subdivision regulation when
compliance would create an unusua hardship, based on such findings of Section
67.703 of the zoning ordinance, ese findings and the applicant's ability to
meet them with the current propos 1 are as follows:
a) The intent of the subdivision hapter is met.
The intent of this chapter is o provide for a orderly, economic, and safe
development of the land. This intent can be met with the proposed lot
split.
b) The granting of the variance w 11 not be detrimental to the public safety,
health or welfare or injurious to other property or improvements in the
neighborhood in which the prop rty is located.
The lot split will have virtua ly no impact on the adjoining properties.
c) The conditions upon which the equest for a variance is based are unique to
the property for which the var' nce is sought and are generally not
applicable to other properties.
The property contains both a c nmercial structure and a residential
structure which is unique to t 's property. The request is to separate the
two structures into two separat legal descriptions.
d) The special conditions and cir umstances do not result from the actions of
the applicant.
The current condition use is 1 gal nonconforming. The lot split would no�
change this condition.
e) Unusual hardship to the owner uld result, as distinguished from a mere
inconvenience, if the strict le ter of these regulations was carried out.
G. STAFF RECOMMENDATION: Based on the above findings, staff recommends approval of
the Lot Split with Variance.
