1 WI�REAS, the City of Saint Paul through its Division of Parks and Recreafion
z provides a variety of special events for youth including youth basketball and karate programs;
3 and
4 WHEREAS, the Division of Pazks and Recreation is in need of facilities for its youth
5 basketball program; and
6 WHEREAS, Highland Catholic School has a school with a gymnasium at Bohland
7 Avenue,and
s WHEREAS, Highland Catholic School has given permission to the Division of Pazks
9 and Recreation to use the gymnasium for its youth basketball and karate programs from
lo December 1999 until canceled, on the condition that the City indemnify and hold the School
11 harmless during the use; and
12 WHEREAS, these events serve a legitimate public purpose by serving the youth of the
13 Ciry; and
14 WHEREAS, the expenditure of public funds, which includes the promise of
15 indemnification and defense, for such purpose will facilitate and enable it to take place, now
16 therefore, be it
17 RFSOLVED, that the Ciry Council of the City of Saint Paul on behalf of the City of
1s Saint Paul hereby agrees to defend, indemnify and hold Highland Catholic School harmless
19 from any and all damages it may be required to pay as a result of suits, claims, actions, or
z o judgments arising out of said basketball practices and games and karate lessons which aze
21 attributable to the negligent act of omission by the City of Saint Paul, its employees, agents or
22 contractors.

FUR'i'HER RFSOLVED, that this indemnification does not include: 1) injuries or damages
arising from hidden traps or dangerous conditions in the gymnasium itself as to wluch the
School had actual or constructive notice; and 2) damages or injuries arising out of occunences
or events which are not part of the gymnasium and do not take place on the premises being
used as part of the basketball and karate program. Furthermore, nothing in the foregoing
provisions shall be construed as a waiver of the municipal tort liability limits and defenses set
fotth in Minn. Stat. 466.01 et.seq.
