said RICE AND IRVINE' S ADDI ION TO ST. PAUI, and its extensions ;
the bottom plane of the ver ical space contained within said
description shall be elevat on 805 . 62 feet (based on National
Geodetic Vertical Datum 192 Adjustment ) and the top plane of the
vertical space of said desc iption shall be elevation 834• 29 feet .
WHEREAS , condition num er 2A of Resolution C .F. 88-
1704 requires the petitione to dedicate to the City a permanent
easement for right-of-way p rposes as described therein; and
WHEREAS , Ramsey County Recorder' s office has advised that a
dedication by deed cannot b accomplished because portiona of
this land are registered pr perty and that the only means by
which petitioner can accomp ish the dedication of this right-of-
way is by filing a new plat in accordance with City codes and
ordinances .
THEREFORE BE IT RESOLV D, that condition number 2A of
resolution C.F . 88-1704 sha 1 be amended to read as follows :
2A. That the petitione , its successors , and assigns
shall dedicate a n w right-of-way aa described in
resolution C.F . 88 1704 by filing and obtaining the
approval of a new lat including the right-of-way to be
dedicated . Said p at shall be filed in accordance with
all codes and ordi ances applicable to new plats .
BE IT FURTHER RESOLVED that in all other reapects ,
resolution C .F. 88-1704 sha 1 remain in full force and effect .
