WHEREAS, the Division f Public Health has requested the City
Council to hold a public he ring to consider the advisability and
necessity of the correction or wrecking and removal of a one and
one-half story, fire damaged, wood frame, single family house which
is located on property he eafter referred to as the Subject

Sections 45 . 01 , Subd. 1 an 45 . 02 , Subd. 11 of the Saint Paul
Legislative Code. The Janua y 6 , 1989 order also had attached to
it a list of deficiencies regarding the house on the Subject
Property, said list is atta hed and incorporated as part of this
resolution; and
WHEREAS, the January , 1989 order informed all owners,
interested parties and resp nsible parties that they must either
repair the structure on the ubject Property by correcting the list
of deficiencies or demolish the structure, either action to take
place by March 7 , 1989 .
WHEREAS, no action has en taken regarding compliance with the
January 6 , 1989 notice and rder, and as a result the Division of
Public Health requested tha a public hearing be scheduled to take
place on Thursday, October 2 , 1989 for the City Council to consider
the advisability and neces ity of ordering the correction of the
nuisance condition or in t e alternative consider the demolition
and removal of this house; nd
WHEREAS, the above ref renced owners , interested parties and
responsible parties have be n served notice in accordance with the
provisions of Chapter 45 of the Saint Paul Legislative Code of the
time and purpose of the Octo er 20, 1989 hearing before the Council ;
WHEREAS, a hearing was held before the Saint Paul City Council
on October 20, 1989 and al testimony and evidence was considered
by the Council .
NOW THEREFORE, BE IT RESOLVED, that based u�$n all of the
testimony and evidence pre ented at the October .2�, 1989 hearing,
the Saint Paul City Council hereby adopts the following Findings and
Order concerning the build ng at 1369 Marion Street:
l . Thdt in July of 1986 the house located on the Subject
Property was determined to be vacant and open to access . The house
has remained vacant and ha been either open or boarded sinr_e July
of 1986 .
2 . That since July f 1986 the City of Saint Paul has on
several occasions issued rders to the owners to make this house
secure and not accessibl . On two occasions, because of the
inaction on the part of he owners, the City has had to hire a
private contractor to make the house secure and not open to access .
3 . That there are ow and have been since July of 1986 ,
multiple exterior Housin Code or Building Code violations in
existence at the Subject roperty.
4. That the Division f Public Health of the City of Saint Paul
condemned this structure as "Unfit for Human Habitation under
Chapter 34 of the Saint P ul Legislative Code" in June, 1986 . The
building is still subject to this condemnation order.

5 . That the owners, int rested parties and responsible parties
of this building are as previ usly stated in this resolution. These
individuals have been properly served notice of the October 20 ,
6 . That on ,Tanuary 6 , 1989 an Abandoned Building Notice was
sent to the owners, inter sted parties or responsible parties
ordering these persons to ither demolish the building or make
repairs and cure the list o deficiencies by March 7 , 1989 .
7 . That the order of J nuary 6 , 1989 have been disregarded by
the owners, interested part es and responsible parties .
8 . That the one and on -half story, fire damaged, wood frame,
single family house located on the Subject Property is an abandoned
building under Section 45 . 01 , Subd. 1 , of the Saint Paul Legislative
Code in that it is "a buil ing or portion thereof which has stood
unoccupied for longer than ne ( 1 ) year" and during that period of
time it has been either "uns cured" , "boarded" , or has had "multiple
exterior Housing Code or uilding Code violations" or has been
"placarded as "Unfit for H man Habitation" pursuant to Chapter 34
of the St. Paul Legislative Code. "
9 . That the one and on -half story, fire damaged, wood frame,
single family house locate on the Subject Property is a nuisance
as defined under Saint Pau Legislative Code Section 45 . 02, Subd.
11 , in that it is an abando ed building located in the City of Saint
Paul that has created a da gerous or unhealthy condition or which
threatens the public peace, health, safety or sanitary condition of
the City or which is offen ive or has a blighting influence on the
community.
10 . That the costs of batement of this nuisance are estimated
to exceed two thousand doll rs ( 52 , 000 . 00 ) or the abatement involves
demolition of a building other than a structure accessory to a
residential building .
ORDER
The Saint Paul City Co ncil hereby makes the following order :
1 . The above refe enced owners , interested parties and
responsible parties and their assigns shall make the Subject
Property safe and not de rimental to the public peace, health,
safety, and welfare and remove its blighting influence on the
community by rehabilita ing this house and correcting those
deficiencies set forth n the list previously referenced in
accordance with all appl cable codes and ordinances, or in the
alternative by demolishin the building and filling the site in
accordance with all ap licable codes and ordinances. The
rehabilitation or demoli ion of the building must be completed
within thirty ( 30 ) days o the date of mailing of this resolution.

On January 6, 1989, the Div sion of Public Health mailed an order
to the owners, interested p rties and responsible parties of this
building requiring that the building be either repaired, by
correcting the attached lis of deficiencies, or demolished on or
before March 7 , 1989 . Inasm ch as the orders have not been
completed to the satisfacti n of the Division and the continued
abandoned condition of the uilding contributes a blighting
influence and potential haz rd to the neighborhood, it is the
recommendation of the Divis ' on that the City Council pass a
resolution ordering the own rs, interested parties and
responsible parties to eith r repair or demolish the building in
a timely manner to the sati faction of the City.
In the event the owners, i erested parties or responsible
parties fail to comply wit the Council Resolution, the Division
of Public Health should be authorized to demolish the building
and assess all costs incur ed in the demolition against the real
estate as a special assess ent to be collected in the same manner
as taxes .

pursuant to Chapter 34 of the ' t Paul Legislative Code."
The ordinance further states that an ned l�uilding is a nuisance and it may be
ordered torn daan by the City.
