WHEREAS, the Division f Public Health has requested the
City Council to hold a publ c hearing to consider the
advisability and necessity ' f the correction or wrecking and
removal of four buildings . he buildings are described as
follows :
a one-story, wood fram , wood and masonry facade,
deteriorated and dilap� dated westmast industrial building
located adjacent to La son Avenue; and
a one-stor.y, wood fra , w�od and masonry facade,
deteriorated and dilap' dated industrial building located
adjacent to West Lawso Avenue on the west side and adjacent
to the railroad right '- f-way; and
a three-story, masonr , wood frame, deteriorated and
dilapidated industrial building, which is both adjacent to
Kent Street anr� is al north of 980 Kent Street; and
a one-story, wood fra e, wood a�nd masonry facade,
deteriorated and dila idated industrial building located
near the corner of W. Lawson Avenue and Mackubin Street;
which are located on the p operty hereafter referred to as the

Legislative Code. The owners were iven an order to repair or tear down the
buildings by August 18, 1989, bu�t ailed to comply. The buildings have been

WHEREAS, based upon th records in the Ramsey County
Recorder' s Office on June 1 1989, the following persons are
owners, interested parties r responsible parties of the Subject
Property: H. G. McNeely, Jr , 444 Pine Street, Saint Paul ,
Minnesota 55101-2499; and G eat Northern Railway Company, dba
Burlington Northern Railway 4105 Lexington Avenue North, Arden
Hills, Minnesota 55126 , Att : Property Disposition; and
WHEREAS, the Division f Public Health has issued an order
identified as an "Abandoned Building Notice" dated July 18 , 1989
which is attached and incor orated as part of this resolution by
this reference. This order was served in accordance with the
provisions of Chapter 45 of the Saint Paul Legislative Code on
all owners, interested part es and responsible parties of the
Subject Property known to t e enforcement officer. The notice
and order informed these pa ties that:
a one-story, wood fram , wood and masonry facade,
deteriorated and dilap dated westmost industrial building

a one-story, wood fram , wood and masonry facade,
deteriorated and dilap dated industrial building located
adjacent to West Lawso Avenue on the west side and adjacent

located on the Subject Prop rty are abandoned buildings and
nuisances pursuant to Secti ns 45 . 01 , Subd. 1 and 45 . 02 , Subd. 11
of the Saint Paul Legislati e Code. The July 18 , 1989 order also
had attached to it a list o deficiencies regarding these
buildings on the Subject Pr perty, said list is attached and
incorporated as part of thi resolution; and
WHEREAS, the July 18 , 1 89 order informed all owners,
interested parties and resp nsible parties that they must either
repair the structures on th Subject Property by correcting the
list of deficiencies or dem lish the structures, either action to
take plar_e by August 18, 19 9; and
WHEREAS, after the issu nce of the Order, the Division of
Public Health reinspected t e buildings on October 3 , 1989 and
determined that not only ar the buildings abandoned and
nuisances under our ordinan es but that they arP also hazardous
buildings under Section 463 15 , Subd. 3, Minnesota Statutes and
dangerous structures under Pction 45 . 01 , Subd. 3 , of the Saint
Paul Legislative Code; and
WHEREAS, a supplemental list of deficiencies was prepared as
a result of the October 3 , 989 inspection which is attached and
incorporated as part of thi resolution by this reference; and
WHEREAS, no action has een taken regarding compliance with
the July 18, 1989 notice an order, and as a result the Division
of Public Health requested hat a public hearing be scheduled to
take place on Thursday, Oct ber 19 , 1989 for the City Council to
consider the advisability a d necessity of ordering the
correction of the nuisance onditions or in the alternative
consider the demolition and removal of these buildings; and
WHEREAS, the above refe enced owners, interested parties and
responsible parties have be n served notice in accordance with
the provisions of Chapter 4 of the Saint Paul Legislative Code
of the time and purpose of he October 19, 1989 hearing before
the Council as well as noti e of the supplemental determination
that the buildings are both dangerous and hazardous as described
above and included with thi notice a copy of the October 3, 1989
list of deficiencies; and
WHEREAS, in July of 198 the Building Inspection and Design
Division of the City of Sai t Paul issued an order to remove a
collapsed building of simil r construction to three of these four
buildings located on the Su ject Property. This building
collapsed because of deteri ration, dilapidation and lack of
maintenance; and

WHEREAS, a hearing was h ld before the Saint Paul City
Council on October 19, 1989 a d all testimony and evidence was
considered by the Council ;
NOW THEREFORE, BE IT RES LVED, that based upon all of the
testimony and evidence presen ed at the October 19, 1989 hearing,
the Saint Paul City Council reby adopts the following Findings
and Order concerning the buil ings at 1014 Kent Street:
l . The buildings have b en unoccupied for many years and
have for purposes of this Or inance been deemed to be vacant
since January of 1987 . The b ildings have remained vacant since
January of 1987 .
2 . That due to the vaca t and abandoned status of these
buildings, this site has bee subject of trespassing, burglary
and vandalism and is an attr ctive nuisance in the neighborhood.
3 . That there are now a d have been previous to January of
1987 , multiple exterior Buil ing Code violations in existence at
the Subject Property.
4 . That if action is no taken immediately regarding these
buildings, these buildings a e certain to collapse as did a
similar structure in July of 1987 .
5 . That the buildings 1 cated on the Subject Property are
hazardous buildings under Se tion 463 . 15 , Subd. 3 , Minnesota
St.atutes in that they are bu' ldings "which because of inadequate
maintenance, dilapidation, p ysical damage, unsanitary condition
or abandonment constitutes a fire hazard or a hazard to public
safety or health. "
6 . That the vacant buil ings located on the Subject Property
do not currently have a Cert ficate of Occupancy issued by the
Fire Prevention Division of he City of Saint Paul .
7 . That the owners, int rested parties and responsible
parties of these buildings a e as previously stated in this
resolution. These individua s have been properly served notice
of the Ortober 19, 1989 hear ng concerning these buildings and
were made aware of all the i sues that were to be considered at
such hearing .
8 . That on July 18 , 198 an Abandoned Building Notice was
sent to the owners, interest d parties or responsible parties
ordering these persons to ei her demolish these buildings or make
repairs and cure t.he list of deficiencies by August 18 , 1989.
9 . That the order of Ju y 18 , 1989 has been disregarded by
the owners , interested parti s and responsible parties .

10 . That the buildings 1 cated on the Subject Property are
abandoned buildings under Se tion 45 . 01 , Subd. l, of the Saint
Paul Legislative Code in tha each is "a building or portion
thereof which has stood unoc upied for longer than one ( 1 ) year"
and during that period of ti e it has been either "unsecured" ,
"boarded" , or has had "multi le exterior Housing Code or Building
Code violations" .
11 . That each of the bui dings on the Subject Property are a
nuisance as defined under Sa nt Paul Legislative Code Section
45 . 02 , Subd. 11, in that ear_ of the buildings are an abandoned
building located in the City of Saint Paul that has created a
dangerous or unhealthy condi ion or which threatens the public
peace, health, safety or san tary condition of the City or which
is offensive or has a blight ng influence on the r_ommunity.
12 . That the buildings 1 cated on the Subject Property are
dangerous structures under S ction 45 . 01 , Subd. 3 , of the Saint
Paul Legislative Code in tha each is "a structure which is
potentially dangerous to per ons or property" including being "in
danger of partial or complet collapse. "
13 . That the buildings 1 cated on the Subject Property are
each a nuisance as defined u der Saint Paul Legislative Code
Section 45 . 02 , Subd. 10, in hat they are each a dangerous
structure located in the Cit of Saint Paul that has created a
dangerous or unhealthy condi ion or which threatens the public
peace, health, safety or san tary condition of the City or which
is offensive or has a blight ng influence on the community.
14 . That the costs of ab tement of these nuisances are
estimated to exceed two thou and dollars ( $2, 000 . 00 ) or the
abatement involves demolitio of a building other than a
structure accessory to a res dent.ial building .
ORDER
The Saint Paul City Coun il hereby makes the following order:
1 . The above referenced owners, interested parties and
responsible parties and thei assigns shall make the Subject
Property safe and not detrim ntal to the public peace, health,
safety, and welfare and remo e its blighting influence on the
community by rehabilitating hese structures and correcting those
deficiencies set forth in th lists previously referenced in
accordance with all applicab e codes and ordinances and obtaining
a Certificate of �ccupancy f om the Fire Prevention Division of
the City of Saint Paul , or i the alternative by demolishing
t.hese structures and fil�ing the site in accordanr_e with all
applicable codes and ordinan es . The rehabilitation or
demolition of these structur s must be completed within �r�ky niy�y��

The buildings have stood uno cupied for longer than one year and
meets one or more of the co itions that constitute an abandoned
building, as defined in Cha er 45 of the Saint Paul Legislative
Code.
The buildings meet one or m re of the conditions that constitute
a dangerous structure, as d fined in Chapter 45 of the Saint Paul
Legislative Code.
The buildings are also haza dous buildings pursuant to Section
463 . 15 , Subd. 3 , Minnesota tatutes .
On July 18 , 1989, the Divis ' on of Public Health mailed an order
to the owners, interested p rties and responsible parties of the
buildings requiring that th building be either repaired, by
correcting the attached lis of deficiencies, or demolished on or
before August 18 , 1989 . In ddition, the owners were sent a copy
of a supplemental deficienc list dated October 3 , 1989. Inasmuch
as the orders have not been completed to the satisfaction of the
Division and the continued bandoned condition of the buildings
contributes a blighting inf uence and potential hazard to the
neighborhood, it is the rec mmendation of the Division that the
City Council pass a resolut on ordering the owners , interested
parties and responsible par ies to either repair or demolish the
buildings in a timely manne to the satisfaction of the City.
In the event the owners, in erested parties or responsible
parties fail to comply with the Council Resolution, the Division
of Public Health should be uthorized to demolish the buildings
and assess all costs incurr d in the demolition against the real
estate as a special assessm nt to be collected in the same manner
as taxes .
