WHEREAS, Pursuant to Minnesota Stat tes, � 462.357 and § 64.400 of the Legislative Code, The Housing and R development Authority duly petitioned to rezone 712, 714, & 716 Mackubin St. located on the southeast corner of Mackubin and Minnehaha Ave. from RM 2 to P-1 for the purpose of constructing an off-street parking lot, the peti ion having been certified by the Planning Division on April 21, 1989 as havin been consented to by at least two-thirds of the owners of the area of the pr perty to be rezoned, and further having been consented to by at least 67% o the owners of the property situated within 100 feet of the total contig ous property within one year precedin� the date of the petition; and WHEREAS, The Zoning Committee on Ju e 1, 1989 conducted a public hearing for the purpose of considering the rezo ing petition, and pursuant to Section 107.03 of the Administrative Code, ubmitted its recommendation to the Planning Commission that the petiti n be granted; and WHEREAS, The Planning Commission co sidered the rezoning petition at its meeting held on June 9, 1989 and re ommended that the City Council approve the petition; and WHEREAS, Notice of a public hearing before the City Council on the said rezoning petition was duly publishe in the official newspaper of the City on June 17, 1989 and notices were duly mailed to each owner of affected property and property situated wholly or par ly within 350 feet of the property sought to be rezoned; and COUNCIL MEMBERS Yeas Nays Requested by Department of: Dimond �� �� In Favor � Gosw;tz � RetUman sche;be� Against BY -:� Sonnen �. The petition was originally file on �arch 21, 1989, but was determined by staff to be insufficient.
