An ordinance amending Chapt r 60 of the Saint Paul Legislative Code
pertaining to zoning for th City of Saint Paul and the zoning maps
thereof.
WHEREAS, Pursuant to Minnesota Stat tes, � 462.357 and § 64.400 of the
Legislative Code, The Housing and R development Authority duly petitioned to
rezone 712, 714, & 716 Mackubin St. located on the southeast corner of
Mackubin and Minnehaha Ave. from RM 2 to P-1 for the purpose of constructing
an off-street parking lot, the peti ion having been certified by the Planning
Division on April 21, 1989 as havin been consented to by at least two-thirds
of the owners of the area of the pr perty to be rezoned, and further having
been consented to by at least 67% o the owners of the property situated
within 100 feet of the total contig ous property within one year precedin� the
date of the petition; and
WHEREAS, The Zoning Committee on Ju e 1, 1989 conducted a public hearing for
the purpose of considering the rezo ing petition, and pursuant to Section
107.03 of the Administrative Code, ubmitted its recommendation to the
Planning Commission that the petiti n be granted; and
WHEREAS, The Planning Commission co sidered the rezoning petition at its
meeting held on June 9, 1989 and re ommended that the City Council approve the
petition; and
WHEREAS, Notice of a public hearing before the City Council on the said
rezoning petition was duly publishe in the official newspaper of the City on
June 17, 1989 and notices were duly mailed to each owner of affected property
and property situated wholly or par ly within 350 feet of the property sought
to be rezoned; and

WHEREAS, A public hearin� before the City Council, having been conducted on
July 6, 1989 where all interested pe sons were heard, and the Council having
considered all the facts and recomme dations concerning the petition; now,
therefore,
THE COUNCIL OF THE CITY OF SAINT PAU DOES ORDAIN:
Se tion 1.
That the zoning map of the ity of Saint Paul, Sheet No. 12, as
incorporated by reference i Section 60.301 of the Saint Paul
Legislative Code, as amende , is hereby further amended as follows:
That property located on th southeast corner of Mackubin St. and
Minnehaha Ave. being more p rticularly described as lots 46 & 47;
Block 2; Smith's Subdivisio of Blocks 2,6,7, & 8 be and is hereby
rezoned from RM-2 to P-1.
S ction 2.
This ordinance shall take e fect and be in force thirty (30) days
from and after its passage, approval and publication.

On June 1, 1989, the Zoning Committee f the Planning Commission held a public
hearing on this rezoning. The petiti er testified. At the close of the
public hearing, the Committee voted 5 to 0 to approve the rezoning based on
staff findings.
On June 9, 1989, the Planning Commiss on upheld the Zoning Committee's
recommendation on a unanimous voice v te.
This rezoning is scheduled to be hear by the City Council on July 6, 1989.
Please notify me by July 3, 1989, if ny member of the City Council wishes to
have slides of the site presented at he public hearing.

w WHEREAS� Saint Paul Housing and Redevel pment Authority� file #10466, has petitioned
. to rezone 712-714-716 Mackubin Street s tuated on the southeast corner of Mackubin
and Minnehaha, from RM-2 to P-1 for the purpose of permitting reuse of the property
for off-street parking for adjoining bu iness uses to the east; and
WHEREAS, the Zoning Committee of the P1 nning Commission on June 1, 1989� held a
public hearing at which all persons pre ent were given an opportunity to be heard
pursuant to said application in accorda ce vith the requirements of Section 64.400
of the Saint Yaul Legislative Code; and
WHEREAS, Saint Paul Planning Commission based on the evidence presented to its
Zoning Committee at the public hearing s substantially reflected in the minutes�
made the following findings of fact:
1. The petition was originally file on �arch 21, 1989, but was determined by
staff to be insufficient. The p titioner �as informed that additional
consent signatures would be requ red� _and the petition was returned to him.
2. The amended petition was receive on April 12, 1989, and declared officially
received on April 21, 1989� at w ich time it was again checked for
sufficiency.
3. The petition was declared suffic ent on April 21� 1989 with 16 of the 19
eligible property owners having igned the petition. Only thirteen
signatures would be required for the petition to be sufficient.
4. The proposed use of the property to provide off-street for the commercial
uses to the east of the site is ' enerally in keeping with the comprehensive
plan for this area of the city.
5. Rezoning to a P-1 zoning classif cation will provide the opportunity to
�- properly screen the site from ad oining lower intensity uses, and provide
. something of a buffer between th industrial uses to the north and the low
density residential uses to the ' outh of the site. An application for
? review and approval of a site pl n mist be filed with the zoning office so
that the review required by the ity code can be completed.

Mr. McGuire showed slides of the si e and reviewed the staff report with a
recommendation for approval. He sa d that� according to Mr. Gomez of the
Department of Planning and Economic' Development, District 7 has given its
verbal support to the rezoning and s forwarding a letter of confirmation.
Joe Gomez� PED Project Services, 12 City Hall Annex. stated that District 7 �
will forward a letter of support. offered to answer questions.

Ms. Zieman asked about the involveme t of HRA in the petition process. Mr. .
Gomez responded that HRA owns the pr perty and circulated the petition; Total
Asphalt purchased the building, pla to construct offices and �develop the
parking lot� and paid the rezoning a plication fee.
Ther�e being no further testimony, Ms Morton closed the public hearing.
Mr. Christenson moved to reco�end a proval of the Rezoning from RM-2 to P-1
based on staff report findings. Ms. Zieman seconded the motion which passed
on a unanimous. voice vote (5•0) .

B. PARCEL SIZE: The parcel has 79 feet of frontage on liinnehaha Ave and 125 feet
of frontage along the east side of M ckubin. The area of the parcel is 9,875
sq. ft.
C. EXISTING LAND USE: The parcel is cu rently vacant.
D. SURROUNDING IAND USE:
North: Across Minnehaha, the uses e heavy industrial operations including
Total Asphalt, There are pil s of crushed rock materials on that site.
East: A welding and bottled gas su ply store occupies the abutting site to the
east.
South: The property to the south is currently vacant. Further south, the land
use is predominantly low den ity residential.
West: The property to the west is eveloped in moderate density multi-family
housing.
E. ZONING CODE CITATION: Section 64.40 . (b) provides that " . . .an amendment to the
zoning code may be initiated by the uncil, the planning commission or by
petition of the owners of sixty-seve (67) percent of the area of the property

An ordinance amending Chapt r 60 of the Saint Paul Legislative Code
pertaining to zoning for th City of Saint Paul and the zoning maps
thereof.
O WHEREaS, Pursuant to Minnesota Statu es, � 462.357 and § 64.400 of the
� Legislative Code, The Housing and Re evelopment Authority duly petitioned to
(n rezone 712, 714, & 716 Mackubin St. ocated on the southeast corner of
{\j Mackubin and Minnehaha Ave. from RM- to P-1 for the purpose of constructing
G�? an off-street parking lot, the petit on havino been certified by the Plannin�
� Division on April 21, 1989 as having been consented to by at least two-thirds
of the owners of the area of the pro erty to be rezoned, and further having
been consented to by at least 67% of the owners of the property situated
within 100 feet of the total contigu us property within one year prececiing the
date of the petition; and .
WHEREAS, The Zonina Committee on Jun 1, 1989 conducted a public hearing for
the purpose of considering the rezon' g petition, and pursuant to Section
107.03 of the Administrative Code, s mitted its recommendation to the
Planning Commission that the petitio be granted; and
WHEREAS, The Plannino Commission cons'dered the rezoning petition at its
meeting held on June 9, 1989 and reco mended that the City Council approve the
petition; and
WHEREA5, Notice of a public hearing b fore the City Council on the said "
rezoning petition was duly published 'n the official newspaper of the City on
June 17, 1989 and notices were duly m iled to each owner of affected property
and property situated wholly or partl within 350 feet of the property sought
