WHEREAS, The Councii of the City of� aint Paui, pursuant to Chapter 62 of
the Administrative Code and followi g the public hearing held on
October 1 1, 1988, did adopt a Resolu ion establishing the level of Street
and Alley Maintenance Service to be erformed in the City of Saint Paul,
and the estimated amount of servic� charges to be levied against
benefitted property, the work to be erformed in 1989, and the charges to
be collected with the regular taxes i 1990; and
WHEREAS, The Department of Public orks has performed the approved
street and alley maintenance work d submitted its report together with
the total cost of street and alley m intenance in the amount of
$13,529,734; and
WHEREAS, The City Councii determl ed that the City shaii pay the sum of
56,067,734 of the street and alley aintenance costs from: Municipai
State Aid ($1,412,295), Trunk High' ay Maintenance Aid (3278,700),
County Aid (�387,244), Mlsceilaneo s Receipts (E235,000), Generai Fund
(t3,734,495), and the remaining a aunt ot �7,4b2,000 shall be assessed
against benefltted properties, and urther resolved that a Public Hearing
was heid in the Counci i Chambers October 10, 1989, for the purpose of
adopting the service charges agafn t ali benefltted properties; and

We appeal the street maintenance ervice charge on this property on the
following grounds.
This is a corner property and we eside on Brookline Street, Springside
Drive is the long side street.
The property along Springside Dr' e is very steeply sloped with lime-
stone facing. It is also on the iver Corridor bluff which makes it
unbuildable.
There is a recorded easement acr ss approximately 800' of this property
that provides access to Brooklin Street which renders the property as
unusable until such a time that he City of St. Paul developes Brookline
Street with an ingress and egres . There are six residences on
Brookline Street that are provid d for by this easement.

maintenance service cha ges assessed against Appellant's
property were in the to al amount of $1,167.00.
3 . That Appellant is here y appealing said service charges
and is entitled to reli f sought herein on the following
grounds:
a. That such assessm nt is in an amount in excess of
the actual benefit to the property; and

b. That such proper y has been partially, unfairly or
unequally assess d with maintenance service charges
in comparison wi other property in the City; and
c. That the mainte ance service charges assessed
against the same 's illegal, in whole or in part.
4. That said property as been assessed with the 1989
maintenance service harges in an amount greater than _ -
the real or actual va2 e.
WHEREFORE, Appellant p ays for an Order of this Court as
follows:
l. Judgment that the as� ssed maintenance service charges
of the property be re uced so that property is fairly
and equally assessed; that the 1989 assessments levied
against the property reduced so that the property
bears no more than its fair proportion of such
assessments as they re ate to the actual benefits to the
property; and
2 . For such other relief as may be just and equitable,
including Appellan ' s costs , disbursements and
attorneys' fees.

Notice is hereby given that a Public aring will be held on the 10th day of
October 1989 at 9:00 A.M. in the Saint aul City Council Chambers,City Hall and
Court House,Saint Paul,Minnesota. ' he purpose of the Public Hearing is to
consider the level of service of street aintenance performed in the City of
Saint Paul in 1989 and to ratify the c of such service to be charged against
benefitted properiy in accordance wit Chapter 62 of the Administrative Code.
� The particular service has been perfor ed and the estimated costs as proposed by
the Department of Public Works are a follows:
A I -D T RL P TRE T
Description•
Class I service has been performed on downtown or loop streets with the
following boundaries: Kellogg Boule ard on the south and west,Eleventh Street
on the north and Broadway on the eas .
1989 Level of Services:
The downtown streets have been swe t three times per week and flushed five
times per week. All routine mainten ' ce,including patching and repairing of
street surfaces,has been performed on an as-needed basis.
Assessment:
All Class I service will be assessed at a rate of 3.01 per assessable foot.

Descri�tion•
Class II service has been performed on all outlying commercial and arterial streets
in the City. These are the major arteri' in the City and have both heavy volumes
of vehicular and pedestrian traffic and in most cases,have business or commercial
properties fronting on them. Typical e amples would be as follows: University
Avenue,Snelling Avenue,West Seven Street,East Seventh Street,Rice Street,
Payne Avenue,Arcade Street,Summit venue,Grand Avenue, and others. All
of these Class II streets are accurately fined on a map available for viewing in the
Department of Public Works,900 City all Annex.
1989 Level of Services:
The Class II streets have been swept or cleaned approximately 18 times per season.
All routine maintenance,including pat hing and repairing of street surfaces,has
been done on an as-needed basis.

Assessment•
Under Class II service there are two a sessment rates,one commercial and one
residential. The commercial properry ate is 2.07 per assessable foot and the
residential property rate is .94 per as essable foot.

Descri�tion:
Class III service has been performed o all residential streets including oiled
streets,paved streets and intermediat type streets.
1989 Level of Services:
Residential streets,including oiled str ts,paved streets and intermediate streets
have received a thorough cleaning wh included sweeping and flushing.
Patching and repairing has been on an as-needed basis; approximately 120 miles of
oiled streets received a sand sealcoat d approximately 20 miles of paved streets
received a chipseal coat. In the fall (w ather permitting) leaves will be picked up
from these streets.
Assessment:
Under Class III service there are two a essment rates; one residential and one
commercial. The residential property te is .94 per assessable foot and the
commercial property rate is 1.50 per a sessable foot.

Class IV service has been perforxned o all oiled,paved and intermediate type
alleys within the City.
1989 Level of Services:
All oiled,paved and intermediate alley have been swept during the season. All
routine maintenance,including patchin and repairing of the alley surfaces,has

Under Class IV service, there are two as essment rates;one commercial and one

unimproved we mean those streets an alleys that have not been developed for

Class II service has been performed o' all outlying commercial and arterial streets
in the City. These are the major arteri s in the City and have both heavy volumes
of vehicular and pedestrian traffic an in most cases,have business or commercial
properties fronting on them. Typical amples would be as follows: University
Avenue,Snelling Avenue,West Seve h Street,East Seventh Street,Rice Street,
Payne Avenue,Areade Street,Summi Avenue,Grand Avenue,and others. All
of these Class II streets are accurately efined on a map available for viewing in the
Department of Public Works,900 City Hall Annex.

The Class II streets have been swept o cleaned approximately 18 times per season.
