The meeting was called to order at 2:16 p.m.
STAFF PRESENT: Meghan Riley, City Attomey's Office; Chuck Votel, Code Enforcement

Note: The meeting started at 1:30 p.m. Leonard Anderson was not present at the meeting. This
meeting reconvened at 2:16 p.m.
Gerry Strathman stated this meeting is to hear an appeal filed by Leonard Anderson. Mr.
Anderson is appealing an order issued relative to kris properiy at 559 McKnight Road South.
Chuck Votel reported the building was condemned on 5-20-99. The building had obvious
hazards and defects that effected its use and livability. Mr. Anderson has repaired most of the
defects that would cause it to be unfit to live in. However, he is not complete as stipulated on the
agreement he signed with Code Enforcement. At this time, Code Enforcement is prepared to lift
the arder to vacate and would ask Mr. Anderson to allow Code Enforcement to make an interior
inspection of the building. Mr. Votel observed items that were of a life safety nature in 1994,
and he would like to make an interior inspection to complete the report on the building and look
at the building in its entirety. Mr. Votel is not sure how to pursue getting those items repaired.
Mr. Strathman asked Leonazd Anderson what he thinks of Mr. Votel's proposal.
Leonard Anderson apologized for being late. He has been having health problems. He would
like to leave Saint Paul and a11 problems associated with trying to live here. Carol Berg has
helped hun immensely. Every time Mr. Anderson does one item, something else is found to be
wrong. Mr. Anderson has made arrangements to sell the home to Edina Realty; therefore, Mr.
Votel can deal with the new owners. The things that Mr. Votel has done in the past aze criminal.
He came on the properiy and took a crane. It did not have to have a license.
Mr. Strathman stated he is aware there is a long history here and asked Mr. Anderson to focus on
the issue at hand.
He has a file on his property that is seven inches thick, stated Mr. Anderson. He has done
eveiything in his power to bring the properiy up to code. He has applied two times to the Saint
Paul home loan fund. The last time he applied, he was told he could not have it because he had a
snow plow. Mr. Votel took the snow plow, picnic table, and a bicycle.
Some of the things are delayed because he is constantly jumping through hoops, stated Mr.
Anderson. Carol Berg supplied a lot of money to do the rehab of the properiy. He has a video to

show the properry is clean, tidy, and nice. Also, he hired an azchitect to refute Mr. Votel's
statements.

that, there would be nothing to prohibit Mr. Anderson from inhabiting the house. Mr. Strathman
asked is Mr. Anderson seliing the property or has it been sold. Mr. Anderson responded it is in
the process of being sold. The new purchaser is Dick Nicholson and it is being sold by Edina
Realty.
Is there a closing date, asked Mr. Strathman. No, responded Mr. Anderson, because he has been
under pressure from the holidays. The closing date may be nea�t week. (Mr. Anderson explained
some of his health problems.)
Mr. Strathman asked Mr. Anderson is his posifion as follows: he will not allow an interior
inspection of the home at this rime, the property is about to be sold, and perhaps the City can deal
with the new owner for exterior violations. Mr. Anderson responded that is his position. If Code
Enforcement can leave the situation alone, it will solve itself quickly. He needs 6me to go
through his documents and straighten them out. He does not want Mr. Votel in the house.
Mr. Anderson stated he planned to have the realtor and the new owner here today. He has a
video and some letters from neighbors to share with Mr. Strathman.
Mr. Strathman asked for Mr. VotePs response. Would Mr. Anderson a11ow another enforcement
officer to do an interior inspection, asked Mr. Votel.
Mr. Anderson responded he needs tnne away from this issue to deal with some of his health
issues. He talked to Racquel, who told him a letter was suppose to be delivered to him the other
day. Carol Berg took two hours off of work because they thought there would be a hearing in
front of the City Council, but the letter said otherwise. Later in the day, Mr. Votel came out to
deliver the letter, but Mr. Anderson toid him to go away because he already had it. On an earlier
visit, Mr Votel said progress was being made. Mr. Votel would not shake Mr. Anderson's hand,
and was hostile, arrogant, and rude. There is no credibility anymore.
Would it be agreeable for someone else to do the inspection, asked Mr. Strathman. Mr.
Anderson responded that is an absolute no.
Mr. Strathman asked for fiirther comments from Mr. Votel. Mr. Votel responded he is prepared
to lift the condemnation. Code Enforcement will review whether they will seek a seazch warrant
of the premises.
Carol Berg stated it is unconscionable what the Ciry has done to Mr. Anderson. There are homes
in worse shape than his. Everything has been brought up to code.

Mr. Strathman asked for fiirther comments from Mr. Votel. Mr. Votel responded he is prepared
to lift the condemnation. Code Enforcement will review whether they will seek a seazch warrant
of the premises.
Carol Berg stated it is unconscionable what the Ciry has done to Mr. Anderson. There are homes
in worse shape than his. Everything has been brought up to code.

Mr. Strathman stated this matter is closed. Code Enforcement has withdrawn their 5-20-99
"Notice of Condemnation as LJnfit for Human Habitation and Order to Vacate", there is nothing
to appeal at this point, and there is nothing to discuss.
