An ordinance amending hapter 60 of the Saint Paul Legislative Code
pertaining to zoning f r the City of Saint Paul and the zoning maps ,
thereof.
WHEREAS, Pursuant to Minnesota tatutes, § 462.357 and § 64.400 of the
Legislative Code, Pier 1 Impor duly petitioned to rezone 727-733 Grand
Avenue, located on the north si e between Grotto & St. Albans Streets from
B-2C and B-3 to B-2 for the pu ose of expanding the existing Pier 1 Store
and associated off-street park' g, the petition having been certified by the
Planning Division on May 4, 19 9 as having been consented to by at least
two-thirds of the owners of th area of the property to be rezoned, and
further having been consented o by at least 67X of the owners of the property
situated within 100 feet of th total contiguous property within one year
preceding the date of the peti ion; and
WHEREAS, The Zoning Committee n May 4, 1989 conducted a public hearing for
the purpose of considering the rezoning petition, and pursuant to Section
107.03 of the Administrative C de, submitted its recommendation to the
Planning Commission that the p tition be granted; and
WHEREAS, The Planning Commissi n considered the rezoning petition at its
meeting held on May 12, 1989 a d recommended that the City Council approve the
petition; and
WHEREAS, Notice of a public he ring before the City Council on the said
rezoning petition was duly pub ished in the official newspaper of the City on
May 27, 1989 and notices were uly mailed to each owner of affected property
and property situated wholly o partly within 350 feet of the property sought
to be rezoned; and

WHEREAS, A public hearing before the City Council, having been conducted on
June 15, 1989 where all interes d persons were heard, and the Council having
considered all the facts and re mmendations concernin� the petition; now,
therefore,
THE COUNCIL OF THE CITY OF SAIN PAUL DOES ORDAIN:
Section 1.
That the zoning map of he City of Saint Paul, Sheet No. 27, as
incorporated by refere e in Section 60.301 of the Saint Paul
Legislative Code, as a nded, is hereby further a�ended as follows:
That property located the northwest corner of Grand Ave. and
Grotto St. being more articularly described as lots 16 through 19,
Block 6; Summit Park A dition, be and is hereby rezoned from B-2C and

Section 2.
This ordinance shall t ke effect and be in force thirty (30) days

Dear Sir:
On May 4, 1989, the Zoning Committee of the Planning Commission held a public
hearing on this rezoning. The petition r testified. At the close of the
public hearing, the Committee voted 5 t 0 to approve the rezoning from B-2C
and B-3 to B-2 based on staff findings.
On May 18, 1989, the Planning Commissi upheld the Zoning Committee's
recommendation on a unanimous voice vo e.
This rezoning is scheduled to be heard by the City Council on June 15, 1989.

WHEREAS, Pier I Imports, file #10445, ha petitioned to rezone 727-733 Grand Avenue
situated on the north side between Grott and St. Albans, from B-2C and B-3 to B-2
for the purpose of permitting expansion f the existing Pier I store and its parking
facilities; and
WHEREAS, the Zoning Committee of the P1 ing Commission on April 6, and May 4,
1989, held a public hearing at which al persons present were given an opportunity
to be heard pursuant to said applicatio in accordance with the requirements of
Section 64.400 of the Saint Paul Legisl tive Code; and
WHEREAS, Saint Paul Planning Commission based on the evidence presented to its
Zoning Committee at the public hearing s substantially reflected in the minutes,
made the following findings of fact:
The petitioners request rezoning of the site from B-2C and B-3 to B-2 so that the
entire store site is in a single zoning district.
The current and proposed uses of the co bined properties are B-2 uses.
The Planning District Council recommen approval of rezoning to B-2 classification
as consistent with area plans.
NOW, THEREFORE, BE IT RESOLVED, by the Saint Paul Planning Commission that the
petition of Pier I Imports to rezone p operty at 727-733 Grand Avenue, more
particularly described as Lots i6, 17, 18 and 19, Block 6, Summit Park Addition,
from B-2C and B-3 zoning classificatio to a B-2 zoning classification is consistent
with the Comprehensive Plan for the Ci y; and
BE IT FURTHER RESOLVED, that the Saint Paul Planning Commission does hereby
recommend to the Council of the City o Saint Paul that rezoning property located at
727-733 Grand Avenue from B-2C and B-3 zoning classification to a B-2 zoning
classification be approved.

The applicant was present; there was position present at the hearing.
Mr. McGuire showed slides of the site and reviewed the staff report with a
recommendation for denial. He said t at District 16 sent a letter in
opposition to B-3 rezoning but in sup ort of B-2 rezoning.
Irving T. Margolis, 727 Grand Avenue, said that he would like to cooperate
with staff and would like to upgrade he building and the entrance to Pier I.
Ms. Morton asked the applicant if he ould agree to P-1 or B-2 zoning. Mr.
Margolis replied that he would be wi ing to downzone the entire parcel to
B-2.
Mr. Segal clarified options for the pplicant and the Committee.
Ms. Zieman inquired about the size o the proposed expansion. Mr. Margolis
answered that they would add about 2 00 to 2700 square feet, that the building
would have the same plaza front, tha parking would be to the east of the site
and that there would be some drivewa changes.
Ms. Zieman asked if District Counci #2 would be consulted regarding design
features. Mr. Margolis answered af irmatively and added that the proposed
design would be "softer" than the P er I South Robert Street store.
Ms. Morton asked if the trailer pre ently on the site would be removed. Mr.
Margolis said yes. .
Ms. Hirte requested information abo t .the Grand Avenue Task Force and their
recommendations.
Mr. Harvey stated that the Grand A nue Task Force has not taken a position
nor does it expect to take a posit'on on the Pier I Imports application for
rezoning. He said that the task f rce has looked into providing small,
appropriately screened, parking lo s on Grand Avenue. He said that there is
opposition to B•3 rezoning but end rsement of a request for P-1 or B-2
rezoning.

Timothy G. Conley, 728 Summit Avenue, s ted that Pier I has been an excellent
neignbor and that he would support a re est for rezoning, particularly to
B-2.
Christine A. Trost, Summit-Hill Associa ion District 16 Planning Council,
745 Grand Avenue, distributed a letter rom Brian D. Alton, president of
District 16, stating that the organizat on opposes B-3 rezoning, but that it
would support B-2 rezoning for both lot .
Eve Dorn, 1422 Ashland, said that the G and Avenue Business Association board
of directors requests B-2 rezoning for oth lots.
Ms. Zieman inquire� about Pier I store ours and also about shared parking.
Mr. Margolis introduced Robert R. Laska, manager of Pier I Imports. Mr. Laska
said that store hours are from 10 a.m. 0 9 p.m. on Mondays through Saturdays
and from noon to 6 p.m. on Sundays. H offered to speak with Mr. Margolis and
his representatives regarding a functi al plan for shared� parking.
'Ms. Hirte asked if a site plan was app opriate. Mr. McGuire said yes.

Mr. Christenson moved to recommend lay ver to May 4, 1989 to allow the

A. PURPOSE: To consider rezoning of n adjoining lot from B-2C to B-3 to provide
additional off-street parking so t e existing Pier I Imports store can expand.
B. PARCEL SIZE: The parcel has 40 fe t of frontage on Grand Avenue and a depth of
150 feet. The area of the parcel s 6,000 square feet.
C, EXISTING LAND USE: The site is c rently vacant. A small house was recently
moved from this property to a sit across the alley to the northwest.
D. SURROUNDING LAND USE:
North: Land to the north is occu ied by mixed density residential uses which
front on Summit Avenue. ere are three churches and associated parking
lots to the northwest.
East: Land to the east is mixe residential and commercial in mixed zoning.
The block face along the north side of Grand Avenue is presently split
into six small districts which are B-3, B-2, B-2C and RM-2 zones.
South: Property to the south is also mixed residential and commercial in mixed
zoning districts.
West: Sites to the west are zo ed for and used as commercial properties in B-3
and B-2 zoning districts
E. ZONING HISTORY: Prior to 1975, he site was zoned for commercial use.
F. DISCUSSION: The site for which ezoning is requested is presently vacant, and
during the past year has been a unsightly weed patch. The petitioners request
rezoning of the site from B-2C B-3 so that the entire store site is in a

single zoning district. Section 62.104 3) of the zoning code requires that
parking for nonresidential uses be " . . . ocated either on the same zoning lot, in
a P-1 Vehicular Parking District, or wi hin the same or a less restrictive
zoning district. . .and within three hund ed (300) feet of the building it is
intended to serve. . ." . To be used in c nnection with the existing store, the
lot would have to be rezoned to either -3, or P-1. The restrictions in a P-1
zoning district would reduce the number of parking spaces which could be
developed on the site.
The current use of the adjoining prope ty, that is the three lots on which the
current store was developed, is a B-2 se. Further, it is our understanding
that deed restrictions on this B-3 pro erty prohibit the more intensive B-3
uses. Rezoning the additional lot to -3, while it may solve the immediate
problem for the petitioner, does not m ke good planning sense, since the single
lot is too small for most B-3 uses and the ad�oining property to the west is
essentially restricted to B-2 uses.
The adjoining property to the east wil remain for the time being at least, a
B-2C use. There is significant conce on the part of the Planning District
Council and adjoining neighbors, that ezoning to B-3 will open the way for
similar actions on this and other area properties.
G. STAFF RECOMMENDATION: Based on the c ditions surrounding this rezoning
request, staff recommends denial of t requested rezoning to B-3. Staff
recommends approval of a rezoning for this site to P-1, or rezoning of the
entire Pier I Imports site to B-2.

An ordir�ance amending Chapt r 60 of the Saint Paul Legislative Code
pertaining to zoning for th City of Saint Paul and the zoning maps
thereof.
WHEREAS, Pursuant to Minnesota Stat tes, § 462.357 and § 64.400 of the
Legislative Code, Oneida Education enter and Oneida Communit,y College dul,y
petitioned to rezone 357 Oneida Str et located at the southwest corner of
Oneida St. and Jefferson Ave. from M-2 to OS-1 for the purpose of permitting
use of the existing structure as an office building, the petition having been
certified by the Planning Division n April 14, 1989 as having been consented
to by at least two-thirds of the ow ers of the area of the property to be
rezoned, and further having been co sented to by at least 67% of the owners of
the property situated within 100 fe t of the total contiguous property within
c�ne vear preceding the date of the etition; ai�d
WHEREAS, The Zonin� Coromittee on Ma 18, 1989 conducted a public hearing for
the purpose of considering the rezo ing petition, and pursuant to Section
107.03 of the Administrative Code, ubmitted its recommendation to the
Planning Commission that the petiti n be granted; and
WHEREAS, The Planning Commission co sidered the rezoning petition at its
meeting held on May 26, 1989 and re ommended that the City Council approve the
petition; and
WHEREAS, Notice of a public hearin before the City Council on the said
rezoning petition was duly publish in the official newspaper of the City on
July 1, 1989 and notices were duly ailed to each owner of affected property
and property situated wholly or pa tly within 350 feet of the property sought
to be rezoned; and
