The contract cost of the woric or, if the work is not contracted, the cost of all lauor, materials and equipm nt rental required to complete the work, except the cost of providinb the power supply to the service pole or pad shall constitute the actual "Construction Cost" and shall be o referred to hereinafter. 3. The County shall ins all or cause the installation of traffic contr�l signaLs wit� street lights in accordance ith State Aid Project No. 62-830-24 on Larpenteur Avenue at Fernwood Street. Esti ated construction cost is $79,884.00. County's share is 50.Oa per cent. St. Paul's shar is 25.00 Qercent. Roseville's share is 25.00 per cent. 4. The County shall i tall or cause the inst�llation of an EVP System in accordance with State Aid Proje t No. 6Z-630-24 on Larpenteur Avenue at Fernwood Street. Estimatzd constructio cost is $3,801.00 which includes County furnished materials and labor. St. Paul's are is 50.00 per cent. Roseville's share is 50.00 per cent. 5. Upon execution of his agreement and a request in writing by the County, St. Paul and Roseville shall adva ce to the County an amount equal to their portion of the project costs based on the etual bid price and County-furnished materiaLs labor, plus six percent (6''G) of such amo nt for each respective share for the cost of engineering and inspection. 89002 Pa�e 1 0[ 4 , . . . ����`/��'9 6. Koseville and St. Paul hall jointly be responsible for the installation of an adequate electric�l power supply t the service pole including any necessary extensions of Qower lines. U�on completion of th traffic control signal and EVP Syste:n izstallation, Roseville shall receive the ;nonthly lectrical bill and invoice St. Paul for 50 percent of tne costs. In accordance with t e Policy for Lighting County Roadways, County Board �Rzsolution 78-1394, Roseville nd St. P�ul shall jointly be responsible to maintain and pay eneroy costs of the integra street lightino. 8. Upon completion of th project, the County shall inaintain and keep in repair tne traffic control signal and street lighting, includino relamping, cleaning and painting r�t its expense. 9. The EVP System provi ed for in pargraph 4 hereof shall be installed, operated, maintained, revised or re oved in accordance with the following conditions and require:nents: A. All modifications, revisi ns and maintenance of the EVP System considered nec�ssary or desirable, for any reason, shall be done by County forces, or, u�on concurrence in writino by the County's Traffic Engineer, may be done by others all at t e c�st and expense of the respective party (St. Paul or Roseville). B. Emitter units :nay be i talled and used only on vehicles responding to an e.nergency as defined i Minnesota Statutes Chapter 169.01, Subdivision 5 and 169.03. C. Eaeh respective party hall cnaintain and require others usino the EVP System to maintain a 1 g showin� the date, tirne and type of emergency for e�c�y tiine the traff' signal covered hereby is actuated and controlled by the EVP System. ;VI lfunetion of the EVP System shall be reported to tne County irnmedi3tel . D. All maintenance of tne VP Syste:n shall �e performad by the County and Roseville shall reimburs the County for �etual cost thereof. The County shall submit an invoice o Roseville annually, listing aIl l�bor, equipment, materiaLs and overhead used to maintain the EVP System. Labor costs, overhead and equipment costs Nill be at the established rates paid by the County at the time th work is performed, and ;naterial costs �nrill be invoiced at the actual st thereof to tne County. Twenty-five per cent (25°6) of these costs wi be added to the invoice, to cover the County's cost for supervision and administration, in accordance with the policy for Traffic Control Signal S stems, County Board Resolution 81-1001. Except for tne negligent ts of the County, its aoents and employees engaged in the maintenanc work, St. Paul t�nd ftoseville shall assume all liability for, and save the ountj�, its agents and e:nployees, harmless from any and all claims for da ages, actions or causes of action arising out of tne continuino uses by St. Paul and Roseville including but not limited to the operation, use and e stence of the equipment for the �VP System. 10. All timing and related djustments of the traffic control si�nal and interconnect shall be determined by he County through its Traffic Engineer, and no chanbes shall �e made to tnese adjus ments without the approval of the County. 11. The guidelines pertain t all new construction, u�grading and revisions of any type. EXPLANATION To clearly define the cost particip tion and maintenance responsibilities between the county and the city h�.ving juris iction over the entering roadways before final commitment to expend public fu ds for traffic control signal systems is made, cooperative agreements describing tl ese responsibilities �Nill be negotiated and executed by the affected agencies. With the e responsibilities clearly defined in advance of the installation or revision, all requir d wor�c can be performed ex�editiously without confusion as to each agency's re ponsibilities. Policies contained herein are not applicable to intersections controlle by the Minnesota Department of Transportation. DEI'INITIONS County - R.amsey County, acting y and through its Board of County Commissioners. City - Municipal corporation, a ting by and through its council. ENTERING LEGS Under this document "entering le; ' means the physical legs of an intersection. The entering leg may carry two-way vehicular traffic or may carry pedestrian traffic exclusively. In t1�e event an enter ng leg is split by a subdivision boundary, that leo shall be equally prorated. STANDARD PROCEDURES Resolution A cooperative traffic sig al project shall be initiated by a resolution of the city havin� jurisdiction ov r the entering legs requesting the improvement and indicating willingness to s are in the cost of the work. Fundin� If sufficient warrants exi t for the install.ation of traffic control signals as outlined in the Manual o Uniform Traffic Control Devices on county state aid highways or county r adways at their intersections with roadways under the jurisdiction of cities, the co�inty will participate in the construction cost and the engineering and i spection costs as set forth in this policy. The county will not parti ipate in installations where it cannot justify a need for a traffic signal. Inst llation may be permitted at no cost to the county. The couzlty will prepar the plans, construct, operate �nd m�intain the installation at tl�e expens of the city. All equipment will become the property of tl�e county. , . . . . C� �� -���`9 2 0 3 Agree ments The county, through the Public j1lorks Deprzrtment, Division of Traffic Engineering, will prepare coopera ive agreements as necessary to administer the improvement. The agreement will orovide for all costs and responsibilities pertaining to engineering, constr tion and maintenance for the county and the city. POLICIES - FINANCING The construction cost �articipation will be in the same ratio as the number of entering legs of the intersection under each jurisd etion bears to the number of legs entering the intersection. The construction cost is defined as the contract cost of the work, or, if the worlc is not contracted, the cost f all labor, materials, and equipment rental required to complete the work. The participAnt who awards the contra t and supervises the construction shall be reimbursed for a portion of the const ction engineering (plans, specifications and proposals) and inspection costs. The re mbursement will be computed as a uniform fixed percentage of the other participan 's share of the cooperative construction cost. The current rate is fi percent and is sub ect to uniform change. Exceptions Federal Funding If federal funds are sed for the traffic signal construction, any remaining participation costs will be in the same ratio as the number of entering ]egs of th intersection. Emergency Vehicle Pre-Emptio The city will pay 100 percent of the cost of the emergency vehicle pre-emption installati or improvement. Private Intersections, Shopping Centers The county will shar in these construction costs on the basis of negotiation, consideri such items as entering legs in the intersection, hazard to through tr ffic, traffic volumes, etc. In no case will the county pay more tha 50 percent of the cost. POLICI�S - MAINTENANCE The county will own and maintain th control equipment, electrical wiring including conduit and bases, replace knocked-do n equipment, relamp, clean and paint. � The participating city shall provide t e installation of an adequate electrical power supply to the service equipment or ole including any necessary extension of power lines at no cost to the county. The city shall maintain the integral street lighting including relam�ing and c1ea�ling of e luminaires.
