1 BE IT RESOLVED, that, upon the petition of Gwynn Evans, as documented in Finance Department
2 File Number 18-1999, public properties hereinafter described aze hereby vacated and discontinued as

4 The property to be vacated is described as follows:
5 that part of the alley in Block 3, Homer H. Hoyt Company Addition lying northerly of the
6 easterly extension of the south line of Lot 18, said Block 3
7 This vacation shall be subject to the terms and condition of Chapter 130, codified March 1, 1981, of the
8 Saint Paul L.egislative Code as amended, and to the following condifions:
9 1. That the petitioner's, their successors and assigns shall pay $500.00 as an administrative fee for
10 this vacauon which is due and payable within 60 days of the effective date of this resoluuon.

2. That a permanent drainage easement sha11 be retained on, over, under and across the vacated azea
on behalf of the City of Saint Paul, Department of Public Works. Said drainage easement shall
be subject to the following conditions:
a. No buildings, structures, or trees are permitted within the easement area nor any
temporary structure, material storage, fixture, or other objects that will restrict the normal
alley drainage
a. Improvements in or upon the easement area that do not interfere with the City's reserved
rights may be allowed by obtaining approval from the Department of Public Works Sewer
Division with the understanding that the restorauon and costs of such improvements shall
be the sole responsibility of the petiuoner, its successors and assigns, in the event the City
exercises its reserved easement rights or due to damage caused by drainage through the
easement area.

No change from the existing grade is permitted within the easement area without the
written permission from the Deparlment of Public Works Sewer Division.
No change in surfacing within the easement area is permitted without the written
permission from the Departrnent of Public Works Sewer Division.

e. The petitioner, its successors and assigns shall indemnify, defend, and save harmless the
Ciry of Saint Paul, its officers agents, employees, and servants from all suits actions, or
claims which shall arise from any injuries or damages received or sustained by any break
in any storm pipe in said easement, or from the restriction of the normal flow of water,
arising out of, or resulting from, any action or negligence on the part of the petitioner, its
employees agenu, or business invitees.

7 3. That the petitioner shall dedicate, on behalf of the Ciry of Saint Paul Department of Public
8 Works, a permanent drainage easement on, over under and across the northerly 10.00 feet of Lot
9 18, Block 3, Homer H. Hoyt Company Addiuon. Said drainage easement shall be subject to the
10 conditions enumerated under condition 3. above.
11 4. That a permanent utility easement shall be retained within the vacated area to protect the interest
12 of Northem States Power Company.
13 5. That the petitioners, their successors and assigns agree to indemnify, defend and save hannless
14 the City of Saint Paul, its officers and employees from all suits, acuons or claims of any character
15 brought as a result of injuries or damages received or sustained by any person, persons or
16 property on account of this vacation or petitioners' use of thas property, including but not limited
17 to, a claim brought because of any act of omission, neglect, or misconduct of said petitioners or
18 because of any claims or liability arising from any violation of any law or regulation made in
19 accordance with the law, whether by the petitioners or any of their agents or employees.
20 6. That the petiuoners, their successors and assigns shall, within 60 days of the effective date of this
21 resolution, file with the City Clerk an acceptance in writing of the conditions of this resolution
22 and shall, within the period(s) specified in the terms and conditions of this resolution, comply in
23 all respects with these terms and conditions.

Dear Mr. Carlson:
The Department of Public Works has completed a review of the above-referenced vacation
proposal. This alley is a 14 foot wide unimproved, dead-end alley. The alley drains to the north
and then the water flows westerly to Pierce Street along the north side of I.ot 18, which is the
petitioner's property. There currently is a new rail fence built across the alley at the south line of
L.ot 18. ff the area which is proposed to be vacated is filled, water would pond on the north end
of the remaining alley.
Therefore, the Department of Public Works has no objections to the vacation subject to the
foilowing requirements:
1. That a fuil width drainage easement is retained over the entire vacated area, subject to the
usual easement restrictions (see attached); and
2. That the property owner of Lot 18, Block 3, Homer H. Hoyt Company Addition shall grant to
the City of Saint Paul, a drainage easement across the north 10 feet of said Lot 18, subject to the
same restrictions referred to above.

DRAINAGE EASEMENT RESTRICTIONS:
a. No buildings, sriuctures, or trees are permitted within the easement azea nor any temporary
structure, material storage, fixture, or other objects that will resh the normal aliey drainage.
b. Improvements in or upon the easement area that do not interfere with the City's reserved
rights may be allowed by obtaining written permission from the Department of Public Works
Sewer Division with the understanding that the restoration and costs of such improvements shall
be the sole responsibility of the petitioner, its successors and assigns, in the event the City
exercises its reserved easement rights or due to damage caused by drainage through the easement
azea.
c. No change from the existing grade is pernutted within the easement area without the written
pernussion from the Department of Public Works Sewer Division.
d. No change in surfacing within the easement area is pernutted without the written permission
from the Departrnent of Public Works Sewer Division.
e. That the petitioner, its successors and assigns shall indemnify, defend, and save harmless the
City of Saint Paul, its officers, agents, employees, and servants from all suits, actions, or claims
which shall arise from any injuries or damages received or sustained by any break in any storm
pipe in said easement, or from the restriction of the normal flow of water, arising out of, or
resulting from, any action or negligence on the part of the petitioner, its employees, agents, or
business invitees.

17 to, a claim brought because of any act of omission, neglect, or misconduct of said petitioners or
18 because of any claims or liability arising from any violation of any law or regulation made in
19 accordance with the law, whether by the petitioners or any of their agents or employees.

Dear Mr. Carlson:
The Department of Public Works has completed a review of the above-referenced vacation
proposal. This alley is a 14 foot wide unimproved, dead-end alley. The alley drains to the north
and then the water flows westerly to Pierce Street along the north side of I.ot 18, which is the
petitioner's property. There currently is a new rail fence built across the alley at the south line of
L.ot 18. ff the area which is proposed to be vacated is filled, water would pond on the north end
of the remaining alley.
Therefore, the Department of Public Works has no objections to the vacation subject to the
foilowing requirements:
1. That a fuil width drainage easement is retained over the entire vacated area, subject to the
usual easement restrictions (see attached); and
2. That the property owner of Lot 18, Block 3, Homer H. Hoyt Company Addition shall grant to
the City of Saint Paul, a drainage easement across the north 10 feet of said Lot 18, subject to the
same restrictions referred to above.

DRAINAGE EASEMENT RESTRICTIONS:
a. No buildings, sriuctures, or trees are permitted within the easement azea nor any temporary
structure, material storage, fixture, or other objects that will resh the normal aliey drainage.
b. Improvements in or upon the easement area that do not interfere with the City's reserved
rights may be allowed by obtaining written permission from the Department of Public Works
Sewer Division with the understanding that the restoration and costs of such improvements shall
be the sole responsibility of the petitioner, its successors and assigns, in the event the City

a. No buildings, structures, or trees are permitted within the easement area nor any
temporary structure, material storage, fixture, or other objects that will restrict the normal
alley drainage
a. Improvements in or upon the easement area that do not interfere with the City's reserved
rights may be allowed by obtaining approval from the Department of Public Works Sewer
Division with the understanding that the restorauon and costs of such improvements shall
be the sole responsibility of the petiuoner, its successors and assigns, in the event the City
exercises its reserved easement rights or due to damage caused by drainage through the
easement area.

17 to, a claim brought because of any act of omission, neglect, or misconduct of said petitioners or
18 because of any claims or liability arising from any violation of any law or regulation made in
19 accordance with the law, whether by the petitioners or any of their agents or employees.

Dear Mr. Carlson:
The Department of Public Works has completed a review of the above-referenced vacation
proposal. This alley is a 14 foot wide unimproved, dead-end alley. The alley drains to the north
and then the water flows westerly to Pierce Street along the north side of I.ot 18, which is the
petitioner's property. There currently is a new rail fence built across the alley at the south line of
L.ot 18. ff the area which is proposed to be vacated is filled, water would pond on the north end
of the remaining alley.
Therefore, the Department of Public Works has no objections to the vacation subject to the
foilowing requirements:
1. That a fuil width drainage easement is retained over the entire vacated area, subject to the
usual easement restrictions (see attached); and
2. That the property owner of Lot 18, Block 3, Homer H. Hoyt Company Addition shall grant to
the City of Saint Paul, a drainage easement across the north 10 feet of said Lot 18, subject to the
same restrictions referred to above.

DRAINAGE EASEMENT RESTRICTIONS:
a. No buildings, sriuctures, or trees are permitted within the easement azea nor any temporary
structure, material storage, fixture, or other objects that will resh the normal aliey drainage.
b. Improvements in or upon the easement area that do not interfere with the City's reserved
rights may be allowed by obtaining written permission from the Department of Public Works
Sewer Division with the understanding that the restoration and costs of such improvements shall
be the sole responsibility of the petitioner, its successors and assigns, in the event the City
exercises its reserved easement rights or due to damage caused by drainage through the easement
azea.
c. No change from the existing grade is pernutted within the easement area without the written
pernussion from the Department of Public Works Sewer Division.
d. No change in surfacing within the easement area is pernutted without the written permission
from the Departrnent of Public Works Sewer Division.
e. That the petitioner, its successors and assigns shall indemnify, defend, and save harmless the
City of Saint Paul, its officers, agents, employees, and servants from all suits, actions, or claims
which shall arise from any injuries or damages received or sustained by any break in any storm
pipe in said easement, or from the restriction of the normal flow of water, arising out of, or
resulting from, any action or negligence on the part of the petitioner, its employees, agents, or
business invitees.

At the October 13, 1999 meeting of the Merriam Park Community Council the
Board of Directors voted unanimously to support Gwynne Evans request for
vacation of the northernmost portion of the alley neaz Pierce St. and University
Ave.
The Council is impressed with Ms. Evans commitment to her building and the
