WHEREAS, based upon the records in the Ramsey County Recorder' s Office on May 9, 1989 the following ersons are owners, interested parties or responsible parties of the S ject Property: Raymond A. The notice and order informed these parties that 'the one-story, wood frame, single family house located on the Subject Property is a dangerous structure and a nuisance pursuant to Section 45 .U1, Subd. 3 and 45. 02, Subd. 10 of the St. Paul Legislative Code. The eteriorated detached garage is also a dangerous structure and a nu sance pursuant to Sections 45.01, Subd. 3 and 45. 02, Subd. 10 of the St. P ul Legislative Code. WHEREAS, no action has b en taken regarding compliance with the April 20, 1989 notice and order, an as a result the Division of Public Health requested that a public heari g be scheduled to take place on Thursday, September 14, 1989 for the Ci y Council to consider the advisability and necessity of ordering the cor ection of the nuisance conditions or in the alternative consider the demo ition and removal of these buildings; and WHEREAS, the above refer nced owners, interested parties and responsible parties have been served notice in accordance with the provisions of Chapter 45 of t e Saint Paul Legislative Code of the time and purpose of the September 14, 989 hearing before the Council ; and WHEREAS, a hearing was h ld before the Saint Paul City Council on September 14, 1989 and all te timony and evidence was considered by the Council . NOW, THEREFORE, BE IT RE LVED that based upon all of the testimony and evidence presented at the eptember 14, 1989 hearing the 5aint Paul City Council hereby adopts th following Findings and Order concerning the buildings at 725 Sherburne Ave ue: l . That on March 20, 198 the house located on the Subject Property was determined to be vacant an open to access. The house has remained vacant and has been either ope or boarded since March 20, 1989. 2. That since March 20, 989 the City of Saint Paul has on one occasion issued orders to the wners to make this building secure and not accessible. On one occasion, ecause of the inaction on the part of the owners, the City has had to hi e a private contractor to make the building secure and not open to access. 3. That the owners of th Subject Property have repeatedly failed to register and pay the vacant bu lding fee for this property as required by City Ordinance. 4. That the Division of ublic Health of the City of Saint Paul condemned this structure as "U fit for Human Habitation under Chapter 34 of the Saint Paul Legislative Cod " in March, 1989. The building is still subject to this condemnation o der. 5 . That there are now an have been since March 20, 1989, multiple exterior Aousing Code or Build ng Code violations in existence at the Subject Property. 6. That the owners, inte ested parties and responsible parties of these buildings are as previou ly stated in this resolution. These individuals have been properly served notice of the September 14, 1989 hearing concerning these build ngs. 7. That the order of Apr 1 20, 1989 has been disregarded by the owners, interested parties an responsible parties. 10. That the one-story, w od frame, single family house located on the Subject Property is a dangero s structure under Section 45 . 01, Subd. 3, of the Saint Paul Legislative Co e in that it is "a structure which is potentially dangerous to pers ns or property" including being "in danger of partial or complete collapse. ' 11 . That the deteriorated detached garage located on the Subject Property is a dangerous struc ure under Section 45.01 , Subd. 3 of the St. Paul Legislative Code in that it is "a structure which is potentially dangerous to persons or prope ty" including being "in danger of partial or complete collapse. " 12. That the deteriorated detached garage located on the Subject Property is a nuisance as def ned under St. Paul Legislative Code Section 45 . 02, Subd. 10, in that it i a dangerous structure located in the City of St. Paul that has created a d ngerous or unhealthy condition or which threatens the public peace, h alth, safety or sanitary condition of the City or which is offensive or has a blighting influence on the community. 13 . That the one-story, w od frame, single family house located on the Subject Property is a nuisanc as defined under Saint Paul Legislative Code Section 45 . 02, Subd. 10, in t at it is a dangerous structure located in the City of Saint Paul that has c eated a dangerous or unhealthy condition or which threatens the public pe ce, health, safety or sanitary condition of the City or which is offensiv or has a blighting influence on the community. 14. That the cost of abate ent of this nuisance is estimated to exceed two thousand dollars ( $2, 000. 0) or the abatement involves demolition of a building other than a structu e accessory to a residential building. ORDER The Saint Paul City Coun il hereby makes the following order: l . The above referenced owners, interested parties and responsible parties and their assigns sha 1 make the Subject Property safe and not detrimental to the public pea e, health, safety, and welfare and remove its blighting influence on the co unity by rehabilitating these buildings and correcting those deficiencies set forth in the list previously referenced in acco dance with all applicable codes and ordinances, or in the alterna ive by demolishing the buildings and filling the site in accordance with a 1 applicable codes and ordinances.
