WHEREAS, the Division of Publi Health has requested the City Council
to hold a public hearing to conside the advisability and necessity of the
correction or wrecking and removal f a two and one-half story, fire
damaged, wood frame duplex which is located on property hereafter referred
to as the "Subject Property" common y known as 224 N. Avon Street, Saint
Paul , Minnesota. The Torrens proper y is legally described as :
Lot 11, Block 1 , Nininger and onnelly' s Addition to Holcombe' s
Addition St. Paul , according t the recorded plat thereof, and situate
in Ramsey County, Minnesota.
WHEREAS, based upon the recorcls in the Ramsey County Recorder' s Office
on December 7, 1988, the following ersons are owners, interested parties
or responsible parties of the Subje t Property: John P. Flanaghan, 224 N.
Avon St. , Saint Paul , MN 55104; Tho as Robert Nichols, address unknown;
United Mortgage Corporation, 8300 N rman Center Drive #1000, Bloomington,
MN 55437; Federal National Mortgage Association, 10920 Wilshire Blvd. , Los
Angeles, CA 90024; Internal Revenue Service, Attn: Special Procedures

WHEREAS, the Division of Publi Health has issued an order identified
as an "Abandoned Building Notice" d ted November 21 , 1988 which is attached
and incorporated as part of this re olution by this reference. This order
was served in accordance with the p ovisions of Chapter 45 of the Saint
Paul Legislative Code on all owners interested parties and responsible
parties of the Subject Property kno n to the enforcement officer. The

notice and order informed these pa ies that the two and one-half story,
fire damaged, wood frame duplex lo ated on the Subject Property is an
abandoned building and a nuisance rsuant to Sections 45 . 01 , Subd. 1 and
45 . 02 , Subd. 11 of the Saint Paul egislative Code. The November 21, 1988
order also had attached to it a li t of deficiencies regarding the house on
the Subject Property, said list is attached and incorporated as part of
this resolution; and
WHEREAS, the November 21, 198 order informed all owners, interested
parties and responsible parties th t they must either repair the structure
on the Subject Property by correct ' ng the list of deficiencies or demolish
the structure, either action to ta e place by January 21, 1989 .
WHEREAS, no action has been t ken regarding compliance with the
November 21, 1988 notice and order, and as a result the Division of Public
Health requested that a public hea ing be scheduled to take place on
Tuesday, September 12 , 1989 for th City Council to consider the
advisability and necessity of orde ing the correction of the nuisance
condition or in the alternative co sider the demolition and removal of this
duplex; and
WHEREAS, the above referenced owners, interested parties and
responsible parties have been serv d notice in accordance with the
provisions of Chapter 45 of the Sa ' nt Paul Legislative Code of the time and
purpose of the September 12, 1989 earing before the Council ;
WHEREAS, a hearing was held b fore the Saint Paul City Council on
September 12 , 1989 and all testimo y and evidence was considered by the
Council .
NOW THEREFORE, BE IT RESOLVED that based upon all of the testimony
and evidence presented at the Sept mber 12 , 1989 hearing, the Saint Paul
City Council hereby adopts the fol owing Findings and Order concerning the
duplex at 224 N. Avon Street:
l . That in February of 1987 he duplex located on the Subject
Property was determined to be vaca t and open to access. The duplex has
remained vacant and has been eithe open or boarded since February of 1987 .
2. That since February of 19 7 the City of Saint Paul has on one
occasion issued orders to the owne s to make this duplex secure and not
accessible. On one occasion, beca se of the inaction on the part of the
owners, the City has had to hire a private contractor to make the duplex
secure and not open to access .
3 . That the owners of the Su ject Property have repeatedly failed to
register the vacant building as re uired by City ordinance.
4. That there are now and ha e been since February of 1987 , multiple
exterior Housing Code or Building ode violations in existence at the
Subject Property.

5 . That the owners, interest d parties and responsible parties of
this duplex are as previously stat d in this resolution. These individuals
have been properly served notice o the September 12 , 1989 hearing
concerning this duplex.
6 . That on November 21, 1988 an Abandoned Building Notice was sent to
the owners, interested parties or esponsible parties ordering these
persons to either demolish the dup ex or make repairs and cure the list of
deficiencies by January 21 , 1989.
7 . That the order of November 2 , 1988 have been disregarded by the
owners, interested parties and res onsible parties.
8 . That the owners, inte ested parties or responsible parties
have been ordered on numerous occa ions to repair this structure and have
failed to do so.
9. That the two and one-half tory, fire damaged, wood frame duplex
located on the Subject Property is an abandoned building under Section
45 . 01, Subd. 1, of the Saint Paul egislative Code in that it is "a
building or portion thereof which as stood unoccupied for longer than one
( 1 ) year" and during that period o time it has been either "unsecured" ,
"boarded" , or has had "multiple ex erior Housing Code or Building Code
violations" .
9 . That the two and one-half story, fire damaged, wood frame duplex
located on the Subject Property is a nuisance as defined under Saint Paul
Legislative Code Section 45 . 02 , Su d. 11, in that it is an abandoned
building located in the City of Sa ' nt Paul that has created a dangerous or
unhealthy condition or which threa ens the public peace, health, safety or
sanitary condition of the City or ich is offensive or has a blighting
influence on the community.
10 . That the costs of abateme t of this nuisance are estimated to
exceed two thousand dollars ( $2 , 00 . 00) or the abatement involves
demolition of a building other tha a structure accessory ta a residential
building .
RDER
The Saint Paul City Counc ' 1 hereby makes the following order:
1 . The above referenced wners, interested parties and
responsible parties and their assi s shall make the Subject Property safe
and not detrimental to the public ace, health, safety, and weltare and
remove its blighting influence on e community by rehabilitating this
structure and correcting those def ' iencies set forth in the list
previously referenced in accordanc with all applicable codes and
ordinances, or in the alternative demolishing the structure and filling
the site in accordance with all ap licable codes and ordinances. The
rehabilitation or demolition of th structure must be completed within
thirty ( 30) days of the date of mailing of this resolution.

2 . If the above correcti e action is not completed within the

Paul are hereby authorized to take whatever steps are necessary to demolish
this structure and fill the site a d charge the costs incurred against the
Subject Property pursuant to the p ovisions of Section 45 . 08 of the Saint
Paul Legislative Code.
3 . In the event the buil ing is to be demolished by the City of
Saint Paul , all personal property r fixtures of any kind which shall
unreasonably interfere with the de olition and removal shall be removed
from the building by the owners, i terested parties and responsible parties
by the end of the thirty ( 30 ) day ime period. If the personal property is
not so removed, the City of Saint aul shall remove and dispose of such
property and fixtures as is provid d by law.
4 . IT IS FURTHER ORDERED that a certified copy of this
resolution and the incorporated Or er and list of deficiencies be mailed to
the last known address of the owne s, interested parties and responsible
parties pursuant to Section 45 . 11 , Subdivision ( 5 ) .

The building is a two and one- alf story, wood frame, fire
damaged, duplex.
The subject property has been noccupied since February 1987 .
The building has stood unoccup ed for longer than one year and
meets one or more of the condi ions that constitute an abandoned
building, as defined in Chapte 45 of the Saint Paul Legislative
Code.
On November 21 , 1988 , the Divi ion of Public Health mailed an
order to the owners, intereste parties and responsible parties
of this building requiring tha the building be either repaired,
by correcting the attached lis of deficiencies, or demolished on
or before January 21 , 1989 . In smuch as the orders have not been
completed to the satisfaction o the Division and the continued
abandoned condition of the buil ing contributes a blighting
influence and potential hazard o the neighborhood, it is the
recommendation of the Division hat the City Council pass a
resolution ordering the owners , interested parties and
responsible parties to either r pair or demolish the building in
a timely manner to the satisfac ion of the City.
In the event the owners, intere ted parties or responsible
parties fail to comply with the Council Resolution, the Division
of Public Health should be auth rized to demolish the building
and assess all costs incurred i the demolition against the real
estate as a special assessment o be collected in the same manner
as taxes.

The Division of Public Health has de ermined that the above-noted building
is an abandoned building, which Chap r 45 of the Saint Paul Legislative
Code defines as:

Housing Code or Building Code vi lations, or (d) placarded as "Unfit
for Human Habitation" pursuant t Chapter 34 of the Saint Paul
Legislative Code."
The ordinance further states that an ndoned building is a nuisance and

NOTE: If you do not want to have the ity begin action to have the
building torn down, then the attach list of deficiencies must be
repaired or you must tear the buildi down on or before January 21,
1989.

the Cit1� Clerk's Office and a resolution declaring this property to be a
nuisance shall be on file in the Ramsey County Recorder's Office.

The Division of Public Health has d termined that the aY,�ve-noted building
is an abandoned building, which Cha ter 45 of the Saint Paul Legislative
Code def ines as:
• • " any building or portian of a bu lding which has stood c,*ith an
, incomplete eaterior shell for 1 nger than three (3) years or any
building or portion thereof whi h has stood unoccupied for longer than
one (1) year and ti�hich meets on or more of the following criteria;
� (a) unsecured, or (b) boarded, r (c) having multiple exterior ,
Housing Code or Building Code v'olations, or (d> placarded as "Unfit
for Human Habitation" pursuant Chapter 34 of the Saint Paul
Legislative Code."
The ordinance further states that a abandoned building is a nuisance and
it may be ordered torn do�,�n by the ity.
NOTE: If you do not want to have th City begin action to have the
building torn down, then the attach list of deficiencies must be
repaired or you must tear the build" g down on or before January 21,
1989.
Any repair or demolition must l.�e co leted in accordance ti�ith all
applicable lai.�s.
If the work is not completed or if u have not torn the building down by
the above date, the Di��ision of Publ'c Health will refer this matter to
the City Council to receive authori to tear doc,�n the building and charge
all costs incurred in wrecking the ilding against the real estate as a -

evidence to the City Council. A copy of this order ti�ill rie kept on file in
the Cit�� Clerk's Office and a resolution declaring this property to be a
nuisance shall be on file in the Ramsey County Recorder's Office.
Compliance aTith the attached list of deficiencies ti�ill remove your
building from the list of abandor�ed buildings but it does not mean that
the building complies �:•ith all a�licable housing and building ccxles.
The date for compliance H�ith these orders shall not be extended unless ��ou
receive �,Tritten approval from the Division of Public Health.
