WHEREAS , Lara Investment , 965 Arcade Street, Saint Paul ,
Minnesota, 55106 , acting -thr ugh its attorne_y, S . Mark Vaught,
Suite 800, 345 St. Peter St eet, Saint Paul , Minnesota, 55102 ,
applied for an Administrativ Review from the decision of the
Zoning Administrator that ad itional rooms established without
building permits in the base ent of 965 Arcade was an illegal
extension of a non-conforming use and that a proposed secondary
stairway to serve these rooms is an illegal structural alteration
of a non-conforming use acco ding to the provisions of Section
62 . 102(e) ( 1 ) and (2) of the S int Paul Zoning Code as it pertains
to the building' s location nd the operation of adult use in
the B-3 zoning district ; and
WHEREAS , the matter was considered by the Board of Zoning
Appeals at a public hearing on May 23 , 1989 , with notice to
the appellant and affected property owners and the Board of
Zoning Appeals by its Reso ution No. 10478 adopted May 23 ,
1989, affirmed the decisio of the Zoning Administrator in
this matter based upon the following findings of fact:
( 1 ) The building at 65 Arcade Street was established
as a sauna and an adult use p ior to the enactment of the existing
provisions contained in the Zoning Code restricting adult uses
in the B-3 zoning district and therefore the adult use as
existed and operating subseq ent to the Zoning Code amendments
was allowed as a non-conformi g use ;
(2) That prior to 198 the main floor of the building
at 965 Arcade was operating and being used as a sauna and an
adult use and the basement ich contained four rooms was being
used for storage and laund y purposes as well as containing
the furnace and water heater or the building;
( 3) That inspection by Fire Department personnel in the

spring of 1989 showed that t least two rooms had been added
to the basement without obtain�ng the necessary building permits ;
(4) That the applicant had applied for building permits
to legalize the rooms that w re added to the basement and the
Zoning Administrator had de ' ed the application for building
permits based upon the de rmination that this constituted
an illegal expansion of the non-conforming use in accordance
with Section 62 . 102(e) ( 1 ) a d (2) of the Saint Paul Zoning
Code ;
(5) The applicant contend that the prior use of the basement
for storage and laundry was and continued to be an extension
of the sauna and adult use f the premises on the main floor;
(6) The 1989 Certificate of Occupancy for 965 Arcade states
that the use of the propert is restricted to only the first
floor. The 1989 letter that p ecedes the Certificate of Occupancy
does indicate the approximat square footage of the building,
however, this data is only used for purposes of billing the
applicant and was included o ly once in this type of mailing.
The Fire Department testifie that it intends to remove this
information from the Certif' cate of Occupancy correspondence
in the future . This data o the 1989 correspondence does not
imply that the use is bein conducted in the entire building
and does not imply that expa ding the primary use to the entire
building or to the basement a a is legal ;
(7) The building was originally designed and used for
light manufacturing use and ot for a sauna on the main floor.
The building plans relating t the recent changes in the basement
show four rooms on the "befo " plan and six rooms on the "after"
plan. The difference in th se two plans clearly indicate the
addition of two rooms to the basement area. Although the earlier
plan does not reflect the or ginal basement use , Fire Department
sta=f have indicated that th two rooms across from the laundry
room were actually used origi ally for storage purposes .
(8) The Board of Zonin Appeals found and determined that
the Zoning Administrator co rectly interpreted the Zoning Code
in determining that addition 1 rooms established without permits
in the basement of this build ng, which has a legal non-conforming
status as an adult use , i an illegal extension of a non-
conforming use and that t e proposed secondary stairway to
serve these rooms is an ' llegal structural alteration of a
non-conforming use.

WHEREAS , pursuant to t e provisions of Section 64. 205 ,
the applicant duly filed wi h the City Clerk its appeal from
the determination made by th Board of Zoning Appeals and re-
quested that a hearing be eld before the City Council for
the purpose of determining whether the actions of the said
Board were correct or wheth r they were erroneous as alleged
by the appellant; and
WHEREAS , acting pursuant to Sections 64. 205 through 64. 208
and upon notice to appellant and other affected property owners ,
a public hearing was duly conducted by the City Council on
August 8 , 1989 wherein all interested parties were given an
opportunity to be heard; and
WHEREAS , the applicant was represented at this hearing
by its attorney, Mr. S. Mark Vaught , and the City Council having
heard the statements made nd having considered the appeal ,
the report of staff, the inutes and findings of the Board
of Zoning Appeals , does hereb
RESOLVE , that the City C uncil does hereby find and determine
that the Board of Zoning A peals did not commit any error in
fact or procedure in this matter and does hereby affirm the
findings made and determine by the said Board that the prior
use of the basement area by he applicant for storage and laundry
did not constitute an adul use of the basement for zoning
code purposes and therefore the proposed construction of rooms
in the basement area does onstitute an expansion of the adult
use for purposes of the Z ning Code , which is prohibited by
Section 62. 102(e) (1 ) and ( ) of the Saint Paul Zoning Code ;
and, be it
FURTHER RESOLVED, that the appeal of Lara Investments ,

Dear Sir:
On May 23, 1989 the Board of Zoning ppeals held a public hearing on this
administrative review of the decisio of the Zoning Administrator. The
attorney of the applicant testified. At the close of the public hearing, the
BZA voted 4 to 0 to deny the appeal f the applicant and support the decision
of the Zoning Administrator.
This administrative review of the BZ decision is scheduled to be heard by the
City Council on July 27, 1989. Ple e notify Marv Bunnell of my staff (3368)
by July 24, 1989, if any member of e City Council wishes to have slides of
the site presented at the public he ring.

LARA INVESTMENTS (#10478) : Appeal of he determination by the Zoning
Administrator that additional rooms es ablished without permits in the
basement of a building that has a leg non-conforming status as an adult use
is an illegal extension of a non-conf ing use and that a proposed secondary
stairway to serve these rooms is an i legal structural alteration of a
non-conforming use.
The applicant was present. There was no opposition present at the hearing.
Mr. Bunnell showed slides of the site and reviewed the staff report with a
recommendation that the Zoning Admini trator correctly interpreted the Zoning
Code in determining that additional r oms established without permits in the .
basement of this building, which has legal non-conforming status as an adult
use, is an illegal extension of a non conforming use and that the proposed
secondary stairway to serve these roo s is an illegal structural alteration of -
a non-conforming use.

Mr. Osborn asked if the building occ ies the entire lot. Mr. Vaught rep�ied
yes.
� Mr. Bunnell stated that Pat Rife, Di trict 5 Community Organizer, requested a
layover because they did not receive the notification regarding this case and
they would like to review it.
Mark Vaught, 6 W. 5th St. � stated th t many of the findings in the staff
report are irrelevant and that his c ient occupies the whole building. He
stated that Fire Department staff c e to the building and told his client
that he needed a stairway to the bas ment. His client went to apply for the
permit to build the stairway and he as denied the permit. Mr. Vaught stated
. that clearly there is conflict betwe n the city departments even though the �
. staff report states there is not. H stated that his client is willing to do
whatever is necessary to conform to he Zoning Code.
Mr. Vaught stated that permits were ot pulled for the basement remodeling
that was done and the contractors w were negligent paid a fine for doing so.
He stated that although one city de artment is stating that his client must
obtain a building department to bui d the stairway, another city department is
denying his client the permit. He tated that if the city is authorizing his
client to build a stairway they sho ld also authorize the permit to do so.

Mr. Vaught stated that his client will ay any penalties if required to do so.
He stated that the building has had a c rtificate of occupancy and until 1989
there was no mention of limiting the b iness to the first floor only. He
� stated that there are no facts to prov that the building has been
structurally altered. He stated that 's client has used the entire building
for this business since 1975. He stat that what his client has done is no
different than a gracery store switchi g their shelves aith the storage area.
The square footage on the certificate f occupancy clearly indicates that the
entire building is used for the busine s. He stated that although Ms. Lane
and Mr. Bunnell have made their recomm ndations, neither one of them have
stepped inside of the building. The o ly people who have been inside of the
building are the Fire atid Safety Code mployees. .
Mr. Segal stated that there seems to b something missing in the staff report
pertaining to staff findings 1 and 5. He questioned how the basement was used
at the time of each inspection and wha facts there are to back it up. He
stated that if there were rooms in the basement being used before 1983 that
would indicate partial use of the base ent.
Mr. Vaught stated that the basement ha been continuously used since the mid
1970's. He stated that since his clie t acquired the building� the entire
building including the basement has be n used under a valid certificate of
occupancy. He stated that there was t a structural change. He stated that
Ms. Lane and Mr. Bunnell have no fact to back up their recommendations as
neither one has stepped inside the bu ding.
, Kathy Reyes, St. Paul Fire Department stated that she could not find anything
in their files indicating what the ba ement was being used for other than for
a laundry area. She stated that tt�e ublic was not in the basement at the
time of the inspection. She stated t at the square footage Mr. Vaught is .
referring to on the certificate of oc upancy is used for the Fire Department's
invoicing and does not reflect how ma y feet can be legally used for a
business. She added that recently th y have ceased adding the square footage
to their invoicing. The same inspect r went through the building in 1988 and
1989 and noticed the change in use of the basement. The order they gave for a
second exit stairway was on the condi ion that the BZA and BIDD approve the
use.
Mr. Osborn asked how often commercia buildings are inspected. Ms. Reyes
replied every year. Mr. Osborn aske if there are records kept of each
inspection. Ms. Reyes replied yes. r. Osborn asked what the inspector
inspe�ts. Ms. Reyes replied that th inspect the attic, basement, crawl
' ' space, and every room they can get i to. .
Mr. Osborn asked if there was a chan e in use of the building. Ms. Reyes
stated that the Fire Inspector visua ly remembered a change of use in the
building although there was nothing itten in the file.

Mr. Osborn asked who the inspector wa . Ms. Reyes replied that A1 Sarazoza
made the inspections in 1988 and 1989 �
Mr. Kirk asked if the BIDD had any kn wledge of the change of use. Ms. Lane
replied that they have no permits ind cating that the basement was being
remodeled.
Ms. Lsne stated that this same type o incident happened a few years ago at
the Faust Theater when they moved som of their adult entertainment into the
basement. The Faust Theater was not llowed to continue having adult
entertainment in the basement.
Mr. Vaught stated that the walls were added in the basement but the use is
still the same. He stated that every hing that was done in the basement was
done in con�unction with the adult us of the building. He stated that it
does not matter that the use. was chan ed specifically in the basement.
Mr. Segal read Zoning Code Section 62 102(e)(1) and (2) regarding expansions
of non-conforming uses.
Mr. Segal noted that the resolution d es not reflect the testimony given at
the hearing and should be revised.
Hearing no further testimony, Mr. Kir closed the public portion of the
meeting. _
Mr. Osborn moved to support staff's r commendation that the Zoning
Administrator correctly interpreted t e Zoning Code in determining that

R'HEREAS, Lara Investments has appli for an administrative review from the decision
of the Zoning Administrator that addit' nal rooms established without permits in the
basement of 965 Arcade Street, which h s a legal non-conforming status as an adult use, is
an illegal extension of a non-eonformin use and that a proposed secondary stairway to
serve these rooms is an iIlegal structural alteration of a non-conforming use according to
the provisions of Section 62.102(e)(1) an (2) of the Saint Paul Lcgislative Code pertaining
to its location and operation in the B-3 oning district; and
WHEREAS, the Saint Paul Board of Zo 'ng Appeals conducted a public hearing on May 23,
1989, pursuant to said appeal in accorda ce with the requirements of Section 62.204 of the
Legislative Code; and
WHEREAS, the Saint Paul Board of Zon ng Appeals based upon evidence presented at the
public hearing, as substantially reflecte in the minutes, made the following findings of
fact:
� 1. Aa iaspcctor of the Fire Department nspected these premiscs in the Spring of 1988 and .
March, 1989. His inspections found t at at least two rooms were added to the basement
area of this building during this peri of time. The inspector indicated that in 1988
the bas4ment was only used for a lau dry room and for storage purposes. •
2. In March 1989, eight citations were is ued to the contractors hired for various work
performed in the basement of this bui ding. The citations were for work regarding
remodeling the basement without req 'red permits. The contractors paid $110 for each
of these violations.
. 3. Since then, permits were obtained for dding central air conditioning on the main floor
� and for correcting some deficiencies i entified in the Certificate of Occupancy
inspection of March 1989; these includ d adding a new door and a hand railing on the
main floor.
4. The 1989 Certifieate of Occupancy fo this property clearly states that the use is
restricted to only the first floor. The 989 ietter that precedes the C. of O. does indicate
the approaimate square footage of the uilding. However, this data is only used for
purposcs of billing the applicant and as included only once in this typc of mailing.
The Fire Dept. intends to remove this i formation from Certificate of Occupancy
. correspondenec in the future. This da on the 1989 correspondence does not imply that �
. . � the use is being conducted in the cntir building and does not imply that expanding the
primary use to the entire building or t the basement area of a building is legal.
� 5. The building was originally designed a d used for light manufacturing use and not for
a sauna use on the main floor. The bui ding plans relating to the recent changes on the
basemeni floor show four rooms on the "before" plan and six rooms on the "after" plan.
The differcncc in these two plans clear y indicate the addition of two rooms to the
basement area. Although the earlier pl n does not reflect the original basement use, Fire
Dept. staff have indicated that the two rooms across from the laundry room were
actually used originally for storage pur oses.

6. According to BIDD "structurally altered" means a change to a building that affects its
structural integrity; this includes change to the floor or to a load bearing wall. Any
changcs that do not affect the structural integrity of the building are not considered
structural alterations. Since the propose construction of a secondary stairway to serve
the basement would affect both a load b aring wall and the floor, it is considered a
structural altcration.
7. The Fire Dept. ordered the applicant to rovide a secondary stairway to serve the
basemcnt arca only if the additional ro ms provided in the basement without permits
are approved by the city. The applican has been ordered to not use the basement area
for any adult sauna uses until and unle s the zoning approvals are obtained. There is no
conflict between the Fire Dept. and BI D as alleged by the applicant. The coastruction
of a secondary stairway to the basemen has not been considered important by the
applicant for the fifteen years it has o cupied this building; this view changed when the
applicant was ordered to provide the st irway to the basement by the Fire Dept. for
health and safety reasons.
NOW, THEREFORE, BE IT RESOLVED, by the Saint Paul Board of Zoning Appe.als that
the Zoning Administrator correctly inter reted the zoning codc in determining that
additional rooms cstablished without per its in the basement of this building, which has a
legal non-conforming status as an adult se, is an illegal extension of a non-conforming use
and that the proposed secondary stairwa to serve these rooms is an illegal structural
alteration of a non-conforming use.

B. ACTION REOUESTED: A decision by t BZA that the Zoning Administrator erred and
that a valid Certificate of Occupa cy for this use in effect prior to recent
Zoning Code amendments is valid fo the entire building, that the basement was
designed and arranged for this adu t use, that construction of a secondary
stairway to the basement is not a tructural alteration, and that such
construction is of such importance from a health and safety standpoint to
require its completion.
C. SITE AND AREA CONDITIONS: Lot are is approximately 2,142 square feet according
to tax records. The site is essen ially level.

D. BACKGROUND: Prior to 1972, the b ilding was occupied by Solmes Uniform Co. , a
manufacturer of uniforms. The pr perty became vacant in 1972 according to the
, R. L. Polk Directory. In October 1974, a plumbing permit was obtained for work
in this building which was to be sed as a sauna at that time. Afterward two
laundry trays and a floor drain w re installed on the first floor.
The original adult use ordinance f the Zoning Code went into effect in November
1983. At that time the adult use on the first floor of this building became a
legal non-conforming use. This iginal ordinance would not have allowed
' structural alterations to the ba ment.

E. FINDINGS:
1. An inspector of the Fire Dept. fo d that at least 2 rooms were added to the
basement area of this building be een spring of 1988 and March of 1989.
This inspector also noted that the use of the basement in 1988 was for a
laundry room and for storage.
2. In March 1989, eight citations wer issued to the contractors hired for
various work performed in the base ent of this building. The citations were

This letter is submitted in s pport of -the request of this date `
for an Administrative Review of a ecision of the Division of Building
Inspection and Design. That deci ion was contained in a letter signed
by Wendy Lane, Zoning Manager, da ed March 28, 1989, a copy of which
is appended.
, The applicant asks for the A inistrative Review for the following
three reasons and requests the re ief suggested in each case.
1 . The applicant was ordere by the Department of Fire and Safety
Services on March 21 , 19 9, as a condition of issuance of a
Certificate of Occupancy to provide a second exit from the
basement of the building Acting on that order, the applicant
, applied for a building rmit to construct the second exit.
: The Division of Buildin Inspection and Design refused on
I�larch 28, 1989 to issue he permit, maintaining that the
construction of a secon exit would be a structural alteration
of the building, which s allegedly prohibited by ordinance.
The applicant, through o fault of its own, finds itself
caught in a conflict be ween two city agencies.
The applicant requests he following:
a. That the Board of Z ning Appeals finds that construction
of a second exit is not a structural alteration and order
: the issuance of the proper building permit; or
b. That the Board of ning Appeals finds that the construction
of a second exit, twithstanding the fact that ssuch .con-
� struction may cons itute a structural alteration of the
building, is of su ficient import from a health and safety
standpoint, to mer t its construction and order the

sion that prior to the pas age of Chapter 62 of the Leqisla-
tive Code, which is relied upon by the Division of Building
Inspection and Design in f nding that applicant has attempted

the part of building int which the nonconforming use was
expanded was not manifes y designed or arranged for such use.

arranged for the pri r nonconforming use.

Although you appealed our order of rch 28, 1988 regarding the expansion
of a nonconforming use into the cell r of the referenced property, the pro-
blem of the construction work done i the cellar still needs to be addressed.
This letter shall serve as official otice that once the zoning issue is
resolved through the city process, y u will have fourteen (14) days to either:
l. Remove all construction work in luding plumbing, electrical, heating,
and general carpentry work done in the cellar without the required
permits; or
2. If the zoning is approved for a adult use in the cellar or if another
use is proposed for the cellar hich is a conforming use under the
zoning code, submit all necessa y site plan information and construction
documents to this office for re iew for compliance with the State Building
Code and parking requirements. All appropriate permits would then be
required once the plans meet th requisite specifications.

We have reviewed your request for a pe mit to construct a secondary stairway
to the basement at the referenced prop rty and hereby deny said request.
The use of this property is an adult u e as defined in the St. Paul Zoning
code. The property is zoned B-3; an dult use in a B-3 zoning district
must meet certain conditions and requi es a special condition use permit
irom the Planning Commission as specif ' d under Section 60.544(10)-(18) of
the St. Paul Legislative Code. The ad t use at this location does not
meet all conditions listed.
The first floor of this property has le al nonconforming use status because
the adult use was established prior to dult use zoning requirements.
Section 62. 102(e) regulates nonconformi g uses. Paragraph (1) states:
No existing structure devote to a use not permitted
by this code in the district in which it is located
shall be enlarged, extended, reconstructed, moved or
structurally altered except n changing the use of
the structure to a use permi ted in the district in
which it is located.
Paragraph (2) continues:
Any nonconforming use may be extended throughout any
parts of a building which ar manifestly arranged or
designed for such use. . . .
The proposed stairway would be a struct ral alteration, prohibited under
paragraph 1. The additional rooms esta lished without permits in the basement,
which was not designed for such use, is pr.ohibited under paragraph 2. Replacing
the nonbearing wall in room ��3 is not p ohibited under this chapter, and the
building permit for this work only was ssued March 27, 1989.

To construct the stairway and expand he adult use into the basement, a
special condition use permit must be btained from the Planning Commission.
Before the Planning Commission may co sider a waiver of the required condi-
tions, a consent petition signed by 9 percent of the property owners within
800 radial feet of the lot must be su mitted.
If you believe our decision is made i error, you have the option of filing
for an Administrative Review before t e Board of Zoning Appeals.

An inspection has been made f the above location on March
23, 1989, to determine if th room at the bottom of the
basement stairs could be use temporarily while the second
exit stairway was being cons ructed. (See Item #4 included
in letter dated 3/21/89 - a ached) As soon as a permit is
issued for the stairway, wo will begin. During
construction of the stairwa from the basement, one of the
four rooms on the first flo r will be unusable, therefore,
Kathy Stuart has requested o use the room at the bottom of
the basement stairs tempora ily during this time. When the
second exit stairway is com lete, the room on the first
floor will be usable, once gain, and the basement room will
no longer be approved for t mporary use. Kathy Stuart
understands completely that even after the second exit is
provided, the use of the ba ement for any purpose will not
be approved until the zonin issue is resolved and all
necessary permits are grant d and approved. She stated she
sent you a letter of unders anding about this issue on
Friday, March 24, 1989 .
Following is a result of my inspection:
- Maximum of 15 people in ilding.
- Total of seven rooms (fo on first floor and three in
basement) .
- Room at bottom of baseme t stairs is approximately 30 feet
(including travel distan e within room) from exit door to
outside on first floor.
- Maximum of two people us 'ng basement room.
- Light switch in room ind cates on panel on first floor if
someone is in room.

Conditions for temporary se of the room at the bottom of
the basement stairs are a follows:
- Provide a smoke detector in corridor outside the basement
room.
- Provide a smoke detector at the top of the basement
stairs.
- Install a fire door betw en the t.v, room and stairway to
basement. All doors wit in this stairway must be kept
closed.
- All doors into basement orridor must be kept closed.
- Provide an exit sign abo e door to outside (lst floor from
basement) .
- No other rooms shall be u ed in the basement until all
permits are issued and ap roved.
A reinspection of the above items was completed on March 24,
1989. All items have been pproved, therefore, temporary
use of the basement room ha been granted until April 10,
1989, or until the second e it stairway is completed,
whichever comes first. I r ceived a copy of your March 22nd
letter today. Please let m know if Kathy Stuart is unable
to obtain a permit to begin construction on this stairway
because of the zoning issue. Approval for temborary use of
the basement room has been anted onl if the room on the
first floor is not usable be ause of the construction.

Investment Company, Lar Hammel , President.

to construct a second e it from the basement, and to
restore a connecting ro m that is now unusable.
We understand that gran ing of a permit to construct the
second exit from the ba ement in no way implies approval for
expanding our business ' usable space into the basement area.

Dear Mr. Olson:
I represent the party takin� he above entitled appeal from a
decision of the Board of Zoni g Appeals.
It is my understanding that i is the obligation of the City to
notify such a party of �he da e of such a hearing. Though the
issue probably becomes moot, s I do know that the hearing is set
for July 27 , 1989, I have to ate received no official
notification from any city de artment or from the city itself
that the hearing is to be sch duled that date.
I did receive a carbon copy o a letter to you from Peggy A.
Richert, Deputy Director of t e Department of Planning and
Economic Development dated Ju y 13, 1989 which references the
date, but I have received no ndependent notification of the
hearing date.
In addition, before the heari g date was set no party contacted
me with. regard to either the vailability of myself or my client
on the date in question. I a scheduled to be trial in Hennepin
County District Court on JUly 27 , 1989 and I am simply not
available that day to represe t my client� s interest.
Therefore, I would request th t the matter be postponed to a
mutually agreeable date and 'me and you may consider this letter
as my client' s waiver of a r uirement that the hearing be held
within 30 days of the date o perfection of the appeal.
Frankly, this entire matter ould have been resolved and I think
the hearing probably could h ve been held within the 30 day
period if the city would ado t a policy of simple courtesy by
checking with the various pa ties to an appeal with respect to an
acceptable date and time. ' T e City Counsel meets twice weekly
and I am sure, had I receive a call, a date within the 30 days
period could have been agree upon with some ease.
