submitted in writing.
The minutes of the .�un 13, 1989 meeting were approved with
the following correc ion. On page 8 last paragraph, under
Board Action after the date "June 30" and before "to"
deleted the year of " 1 89" and insert the year " 1990".
Motion made by Dayid Schultz that the minutes of the June
13, 1989 meeting be proved with corrections. Seconded by
Rober,t Viering. MOTI CARRIED UNANIMOUSLY.
Chairman � Glassman welcom the appellants and explained the
procedures, stating that what the board does is, recommends
action to the City Council .

SUBJECT: Appellant is requesting a variance to install a 8 foot
high grapevine arbor/trellis on the West side of the house
abutting the property line.
PROCEEDINGS: Mr. Szachowicz stated that the fence does not
obstruct traffic.
Ms. Gloria Williams - 1871 Saunders, a neighbor, stated she �
was in opposition of the neighbor installing the trellis. It
would be 8 feet 6 inches tall and the overhang comes out 10
feet, only 5 feet from the foundation. This trellis would
have a roof.
BOARD ACTION: Motion made by Ron Ankeny to deny the request for a
variance on installing a grapevine arbor/trellis on the west
property line. Seconded by David Schultz.

Dick Lippert, from Division of Public Health stated that he is
requesting that the board deny the appellants request for an
extension time, first of all , because the appellant is not in
attendance, and secondly, because there is 6 criminal charges
pending, regarding the items that Mr. Halverson has filed an
appeal for, which are set for trial .
Mr. Glassman referred to the application of Mr. Halverson,
wherein, it stated that the appellant is unable to do the work,
that is requested because their is a tenant that is threatening,
and dangerous. Is he in danger?

Mr. Lippert, stated Mr. Hal rson has a dispute going on with the
tenant, I would say that th are equaliy hostile to each other.
I believe Mr. Halverson is i no danger, the tenant may have
already moved out.
BOARD ACTION: Motion made b Bill Tilton to deny the request for
an extension of time to do he necessary repairs pertaining to
holes in front deck floor, craped loose paint and resurface,
repair light on porch, dead olts, repair or remove wall paper in

Mrs. Halverson arrived lat to the meeting. She requested to speak
to the Board. Mrs. Halvers n stated that the tenants have moved,
an that she would like at' 1 ast 60 days to complete the work.

which was to deny an exte�s on of time, instead to grant an
extension of time until Sep ember 1 , 1989, due to the fact that

Don Miller, from Division o Public Health stated that Code is a
ratio of 5 to 1 on a bathro m, therefore, is requesting that the
appellant' follow the code.
A suggestion was made by Mr Tilton to give the appellant some
time to bring the building 'nto code compliance.

SUBJECT: Appellant is requesting a variance on the number of
baths for the number of occupants in the building
PROCEEDINGS: The building was built in 1912, then switched to a
Graduate Club in 1942. Third floor has a toilet, sink and a 2
stall-sink - 11 occupants; Seconded floor the same - 8 occupants.
On the first floor the appellant has a private bath room. The
basement has a sink, toilet and a tub and a athletic shower.
This is a Coop building, each tenant owns a part of the building.
There has been improvements made to the building, such as fire
escapes, water heater, new boiler, new front steps, also a new
fire alarm.
Don Miiler, from Division of Public Health stated that the
building is a mess.
BOARD ACTION: Motion made by Ron Ankeny to deny the request for a
variance on the number of baths for the amount of occupants.
The board granted an extension of time for 1 year until July 11 ,
1990 to install a bath on the third floor, then the second year
an additional bath is to be instalied on the second floor. Mr.
Tilton amended the motion, giving the appellant an extension of
time for 1 year (July 11 , 1990) to install a bath on the third
, fioor, at that time, if there has been progress, satisfactory to
the City, then be given an additional year extension until July
11 , 1991 to instalt an additional bath on the second floor, if
not, then at that time the extension is null and void. Seconded
by David Schultz. MOTION CARRIED UNANIMOUSLY.

bids as to a cost to install mechanical ventilation in the

fire separation-basement apartments, provide door closure-laundry
room, provide proper escape windows in apartments 5 & 7, cover
glass rear stairwell or provide wired glass in metal frame,
remove storage under stairs, fire extinguishers-first floor, fire
doors, hardwired smoke detectors interconnected, repair or
repiace door ciosures on all apartments that are inoperable.
PROCEEDINGS: Wayne Carlson stated that there are six items on the
correction list that need to be addressed. Item #1 - Fire
separation in the basement, this was completed in 1981 , a
sprinkler system was installed, therefore, I will withdraw this
item.
Dave Bergman, from Fire Prevention stated that he was to the
property on July 10, 1989 to do final inspection prior to this
meeting. Some of the items were done and some were not.
Wayne Carlson stated that on Item 3 (Wired glass rear stairwell )
he needs more time. Item 2 (Provide escape window) need
variance. Item 4 (Fire Extinguishers) withdrawn; Item 5 (door
• closures) withdrawn: Item 6 (hard wired detectors interconnected)
deleted.
BOARD ACTION: Motion made by David Schuttz to grant an extension
of time 45 days (August 1 , 1989) to install wired gtass in
rear stairwell . Seconded by Robert Viering. MOTION CARRIED

3. Discussion - Name change or the Board. �
There was a short discussion on considering a name change for the
board. This was discussed i January and a letter was forwarded
to Councilmember Jim Scheibel for review. Mr. Scheibel was going
request some research be don , then he was to get back to the
board witti some recomrnendati ns. The name suggested at that time
was "Code� Enforcement Appea�1 Board".
After some discussion Mr. G1 ssman suggested "Property Code
Enforcement Appeals Board. "
Board Members unanimously �gr ed with the name suggestion.
