Dear Sir: Attached is the application, survey nd staff report for the Guilio Casci request for a lot split with varianc for property located on the south side of Beech street between Atlantic and Duluth Streets. The parcel is presently occupied by single family stucco house which is situated entirely on lot 8. The hou e is three feet from the westerly line of lot 8. The zoning ordinance require a minimum sideyard setback of four feet. The property owner proposes to sell he vacant lot for the construction of a single family home. Gotzian's Rearrangement of Sigel's Addition , Ramsey C . Minn. 4. PRESENT ZONING: R - 4 ZONI G CODE REFERENCE: 67.304. , 67.703. 5. STAFF INVESTIGATION & REPORT: DATE: 5/18/1989 BY: Charles L. McGuire A. PURPOSE: To consider a lot sp it with variance to permit division of the parcel into two separate 1 gal descriptions, one of which would have a single family home with a be ow minimum side yard setback. A variance is required because f the side yard setback. B. SITE AND AREA CONDITIONS: One alf of the site is currently occupied by a single family home. Other pr perties in the area are developed with small single family homes on 40 foot wide lots. The dominant developraent pattern for the area is small s ngle family homes, however, there are a few duplexes in the vicinity. C. MINIMUM LOT REOUIREMENTS: The -4 zoning district requires a minimum lot area of 5,000 square feet a d a lot width of 40 feet. D. CUR.RENT WIDTH AND AREA: The si e has 80 feet of frontage on Beech street and a depth of approxima ely 123 feet. Including 1/2 of the alley area allowed for density omputation, the site area is in excess of 10,000 square feet. E. PROPOSED WIDTH AND AREA: If sp it as proposed, the individual sites would have 40 feet of frontage n Beech St. The lot area for each lot including allowable alley area ould be in excess of the required 5,000 ssquare foot minimum. F. FINDINGS: 1. The requested lot split me ts all requirements of Section 67.304 of the zoning code with th exception of condition 6, for which variance is requested. Co dition 6 provides that the division of the property " . . .does not esult in the creation of a nonconforming structure or use." . The subdivision would leave the existing home on the parce nonconforming as to side yard setback on the westerly side of th home. 2. The City Council may grant a variance from the subdivision regulations when complianc would create an unusual hardship, based on sic findings of S ction 67.703 of the zoning ordinance. These findings and the app icants ability to meet them with the current proposal are as fo lows: � Fi�e SBD #355 Page 1�0. a) The intent of the (su division) chapter is met. The intent of this chapt r is to provide for the orderly, economic, and safe devel pment of land. This intent can be met with the proposed lot sp it. b) The granting of the v riance will not be detrimental to the public safety, health or elfare or injurious to other property or improvements in the neig orhood in which the property is located. The lot split will have irtually no impact on adjoining properties. c) The conditions upon w 'ch the request for a variance is based are unique to the propert for which the variance is sought and are generally not applica le to other property. The siting of the house o lot 8 is such that division of lots 8 & 9 results in a below mini um side yard. This condition is unique to these two lots, and no generally applicable to other property in the area. d) The literal interpreta ion of the provisions of this chapter would deprive the applica t of rights commonly enjoyed by other properties in the same zo ing district. Literal interpretation of the provisions would resu t in the property owner being required to retain a lot which is o times the size of most lots in the area, and meets all other inimum requirements for division into two properties. e) The special conditions nd circumstances do not result from the actions of the applicant. The home was built on the roperty long before it was purchased by the applicant. f) Unusual hardship to the owner would result, as distinguished from a mere inconvenience, if the strict letter of these regulations were carried o t. The applicant would be req ired to maintain a property which is significantly larger than djoining properties. G. STAFF RECOMMENDATION: Based on the staff findings, sta f recommends approval of this lot split with variance. ��� /�`'� / ST.
