provide for hearings concern ng licensed premises, and for
adverse action against s ch licenses , under Chapter 310 ,
including sections 31 �1. �! nd 310.06 , of the Saint Paul
Legislative Code. In the c s of licenses for intoxicating and
, non=intoxicating liquor , au h rity is also conveyed by section
340A.415 of the Minnesota S at tes. Adverse action may include
revocation, suspension, fine a d other penalties or conditions.

The basis for adverse c ion is that you and/or your
employees made payoffs on video poker machines in the
licensed premises on Apr ' 1 1PJ and 11 , 1989, leading to the
execution of a search war a t for the premises on April 12,
1989 and the recovery of a bling devices and paraphernalia,
together with cash proce ds used in such unlawful gambling.
The foregoing violates s c ion 409.QJ8 (6) of the Saint Paul
Legislative Code.
You have the right to be rep e ented by an attorney before and
during the hearing if you o choose, or you can represent
yourself. You may also have a person of your choice represent
you, to the extent not prohi i ed as unauthorized practice of
law.
The hearing will be conducted i accordance with the requirem ents
of sections 14.57 to 14.62 o t e Minnesota Statutes, and such
parts of the procedures und r section 31A.�15 of the Saint Paul
Legislative Code as may be a pl 'cable.
At the hearing , the Admin ' st ative Law Judge will have all
parties identify themselves fo the record. Then the City will
present its witnesses and evid nce, each of whom the licensee or
attorney may cross=examin . The licensee may then offer in
rebuttal any witnesses or e id nce it may wish to present, each
of whom the City attorney m y ross=examine. The Administrative
Law Judge may in addition h a relevant and material testimony
from persons not pzesented s witnesses who have a substantial
interest in the outcome o he proceeding; for example, the
o wners or occupants of prope t located in close proximity to the
licensed premises may have s bstantial interest in the outcom e
of the proceeding. Concl d ' nq arguments may be made by the
parties. Following the hea i g, the Judge will prepare Findings
of Fact, Conclusions of La , nd a specific recommendation for
action to be taken.
You should bring to the e ring all docum ents, records and
witnesses you will or m y need to support your position.

or the production of doc m nts in conformity with Minnesota

Dear Mr. Weyandt:
As your file will reflect, I ep esent Pat's Bar & Grill regarding the
administrative hearing which has ee set for July 25, 1989. Prior to this time,
I was dealing with Philip Byrne 'e had originally set this on the calendar
for the City Council meeting w ic was to have been held on June 20, 1989
wherein we were not going to n est the allegations in the �oliee reports.
Just prior to the June 20th m et ng. my client was charged with a gross
misdemeanor and vae took it of t e agenda because of the pending criminal
matter.
Please be advised that on July 4, 989 �ve appeared before Judge 4Gilson and
pled guilty to the charge. Ju ge W ilson stayed imposition of sentence and
ordered my client to pay $200. 0 s and for court costs.
Inasmuch as the criminal matter s n w concluded, we are respectfully requesting
that the administrative hearing pr ently scheduled for July 25 be cancelled.
Further, we ask that the matt r e placed back on the City Council agenda
