WHEREAS , Edna Alfo d f 2101 Randolph Avenue , Saint Paul ,
became an employee wit he City of Saint Paul Highland Golf
Course as a seasonal e p oyee on June 25, 1979, and at that
time was advised by he upervisor that she was not eligible
for pension through P RA because of her seasonal position;
and
WHEREAS , subsequent re earch by her and other people clearly
indicated that Edna A1 o d was eligible for pension through
PERA in her seasonal pos ' ti n; and
WHEREAS , upon lear i this fact Edna Alford did in fact
purchase as much retroac iv PERA pension benefits as was possible
under the law, but this b y back was limited by law to a three
year period; and
WHEREAS , the Minne ot Legislature in the 1989 Legislative
Session approved a bill u er H.F . 1079 , S .F. 1038 , which would
allow Edna Alford to b y back such pension coverage that was
originally printed by la , provided that Edna Alford would
pay back the employee ' ortion of the contribution together
with interest at the a of 6 percent per year compounded
annually, and provided f rther that the City of Saint Paul
could at its option p y the employer portion of the pension
coverage for this per ' od of time together with interest at
a rate of 6 percent a y ar compounded annually from the date
on which the contribu io s would otherwise have been made ;
and

WHEREAS , it further pears to the Council that if such
proper instruction had e given to Edna Alford at that time ,
the City would have ma e the basic payments to the pension
benefits as an employer a at time ; and
WHEREAS , Edna Alfor as indicated that she will purchase
the retroactive pension e efits as allowed by the State Legis-
lative action as it ap li s to the employee; now, therefore,
be it
RESOLVED , that the o cil of the City of Saint Paul hereby
agrees to pay to PERA t at amount necessary to provide for
the employer ' s buy back a escribed in the legislation approved
by the State Legislatur nder H.F . 1079/S .F. 1038 in the 1989
Legislative Session, to e her with interest at the rate of
6 percent a year compo n ed annually from the date on which
the contributions would o herwise have been made to the date
on which payment is actua 1 made ; and, be it

proper City officials to determine the specific amount due

I met with Jim Lombardi, Jim y er, and Gary Norstrem to discuss Ms. Alford's
PERA situation. Specifically, w considered the buyback proposal as defined
in State Legislation CF 89-16 8, 2-08-89 (HR-1079, SF-1038) .
Prior to our meeting, Gary No st em contacted representatives from PERA.
Based on Gary's information a d he facts surrounding Ms. Alford's employment
status with the City, we reco e d the City pay the employer portion plus
interest of Ms. Alford's tota P RA contribution for the defined payback
period. Ms. Alford would be es onsible for her share plus interest of the
PERA payment. It is evident ha Ms. Alford was eligible for
employee/employer contributio s uring the employment period defined in the
legislation.
The total cost to the City is es imated to be between $2,500 and $3,000. The
cost to Ms. Alford would be b tw en $1,500 and $2,000. The variance is due to
the fact that interest must b p id to the date of payment which is not
determined.
If Councilmember Long agrees it the staff recommendation, I will request the
City Attorney's Office draft r solution to authorize the City payment.

As follow-up to o p one conversation, I am sending you a
copy of the information provide t 's office by Rep. Orenstein's Office
regarding a City employee, Fdna A1 ord. The information I have is that
Ms. Alford was informed by Earl Be 1 of Parks and Recreation that she was
not eligible to participate i.n as a part-time employee when she began
working June 25, 1979. She la er learned that was not the case and bought
back as much of the time as she co d, but there zs�a limit on how far back
an employee can buy back, so St te legislation was necessary to permit her
to go back and cover the perio f om 1980 to 1985. It is my understanding
that this legislation does not eq 're consent from the City, as it does
not require the City to contrib te ything. It is Rep. Orenstein's idea
that the City should pay $2446. the $4022.94 required to buy back 1980
to 1985. That reflects the int e , with Ms. Alford paying the remainder.
Rep. Orenstein's reasoning is t t . Alford would not be in this situation
if she had been given accurate ' o tion when she began working for the
City.
It strikes me that th re is a policy issue involved here as
well as a financial/budget one d fairness issue. I do not know how these
various claims are to be sorted ut but would appreciate some advise
after you have consulted with ot er City staff. Call me if I can be of
further help and/or ifZneed to ncluded in the discussions.

At a later date , she was made a are that she was eligible for PERA
and inquired in�0 her her sit a ion . She called PERA and talked to
Dorothy Linn who said that so e imes people like her fall through
the cracks and do not make pa m nts into PERA because they are not
aware that they are eligible , rs . Alford said that she was willing
to pay for her back payments , a d she asked PERA to help her . Under
the Statute of Limitations , s e was only al�lowed to make back pay-
ments for three years prior t er notification date to PERA, but
before the three year period , she was unable to make payments unless
legislation was enacted . Mrs lford is willing to pay the present

I spoke with Mrs. Alford 11/1 r garding her pensi'on situation.
She became employed at the Hi h and 18 Hole Golf Course (1403
Montreal ) in 6/79. At that t me she was told by Earl Bell ,
who was then Superintendent o arks and Playgrounds, that
she did not qualify for a pen i n through the city. �She beca«�e
certifed as a Refectory Atten e t in 1980 and she recently
was allowed to join PERA and a allowed to go back to 12/85 .
She wants to go back to 1980� w ich was when she became certified.
Sh�e also said something about s cial security, but it appeared
to be a separate issue so I t o ght I would let it go until
this first thing is cleared u .
I called Cynthia MacDonald, A m nistrative Assistant, Public
Employees Retirement Associat ' o , on her behalf. Ms: MacDonald
informed me that eligibil.ity o �PERA was dependent upon your
income� i .e. �, you must make a m nimum of $325.00 a month to
participate. She also let me k ow that people in Mrs. Alford' s

is going to have the Benefits M nager call Mrs. Alford today
