Specifically, w considered the buyback proposal as defined in State Legislation CF 89-16 8, 2-08-89 (HR-1079, SF-1038) . Prior to our meeting, Gary No st em contacted representatives from PERA. Based on Gary's information a d he facts surrounding Ms. Alford's employment status with the City, we reco e d the City pay the employer portion plus interest of Ms. Alford's tota P RA contribution for the defined payback period. Ms. Alford would be es onsible for her share plus interest of the PERA payment. It is evident ha Ms. Alford was eligible for employee/employer contributio s uring the employment period defined in the legislation. The total cost to the City is es imated to be between $2,500 and $3,000. The cost to Ms. Alford would be b tw en $1,500 and $2,000. The variance is due to the fact that interest must b p id to the date of payment which is not determined. The information I have is that Ms. Alford was informed by Earl Be 1 of Parks and Recreation that she was not eligible to participate i.n as a part-time employee when she began working June 25, 1979. She la er learned that was not the case and bought back as much of the time as she co d, but there zs�a limit on how far back an employee can buy back, so St te legislation was necessary to permit her to go back and cover the perio f om 1980 to 1985. It is my understanding that this legislation does not eq 're consent from the City, as it does not require the City to contrib te ything. It is Rep. Orenstein's idea that the City should pay $2446. the $4022.94 required to buy back 1980 to 1985. That reflects the int e , with Ms. Alford paying the remainder. Rep. Orenstein's reasoning is t t . Alford would not be in this situation if she had been given accurate ' o tion when she began working for the City. It strikes me that th re is a policy issue involved here as well as a financial/budget one d fairness issue. I do not know how these various claims are to be sorted ut but would appreciate some advise after you have consulted with ot er City staff. Alford said that she was willing to pay for her back payments , a d she asked PERA to help her . Under the Statute of Limitations , s e was only al�lowed to make back pay- ments for three years prior t er notification date to PERA, but before the three year period , she was unable to make payments unless legislation was enacted .
