WHEREAS, said condition was placed on the license after an incident involving patrons
of the bar resulted in a shooting, in which one person was killed and another injured; and
WHEREAS, on November 21, 1998 an undercover police officer entered Jazzville, and
the employee at the door failed to use a metal detector to scan him for weapons; now, therefore,
be it
RESOLVED, that the licenses held by Jazzville, Inc., d/b/a Jazzville, for the premises at
486 Robert Street North shall be suspended for a period of two days, commencing at 12:01 a.m.

This let�er is late because it did not come in my
mail, my resturaunL manager found it on the street.
But, I would srill like to address this matter.
At the time the off�cer came in, my hired help and
my self was proceeding to clear the floor,we were in
the process of closing the bar for the evening.
I have two people on the door Fri.,Sat.,and Sun.
They are new people,and even though they are informed
to card and scan everyone, the officer just slipped by
them. There's really nothing else I can say except,
that I'm doing all thats in my power to comply with
your stipulations. Theres nothing more that I can do
except try harder not to let that happen again.

Please take notice that a hearing conceming the above-named establistunent has been scheduled
for 5:30 p.m., Wednesday, February 3,1999 in the City Council Chambers, Third Floor, Saint
Paul City Hall and Ramsey County Courthouse.
Enclosed are copies of the proposed resolution and other documents which will be presented to
the City Council faF their considerauon. This is an uncontested hearing, in that the facts
conceming the failure to follow license conditions and use a metal detector on all incoming
patrons have not been disputed. You will have an opportunity at the Council hearing to present
oral and/or written remazks as to the penalty, if any, to be imposed. The recommendation of the
license office will be for a suspension of all licenses for two days, or alternatively a$1,000.00

The Director of the Office of License, Inspections and Environmental Protection is
recommending that adverse action be taken against your license. The basis for the adverse action
is:
On November 16,1998 }�ou agreed to certain conditions being part of }�our
license as a result of a shooting outside of Jazzville. One of the conditions
was that all customers �i�ould pass through a metal detector to determine the
presence of any �; eapons. On \ o�•ember 21, 1998, an undercover police
office entered Jazzviile without an emplo}�ee scanning or checkina him for
weapons. This is a violation of the condition placed on your license.
If you do not dispute the above facts please send me a letter with a statement to that effect. The
matter will then be scheduled for a hearing before the St. Paul City Council to determine what
penalTy, if any, to impose. You will ha�•e an opportunity to appeaz and speak on your own
behalf, or to have someone appear there for you.
On the other hand, if you wish to dispute the above facts, I wili schedule an evidentiary hearing
before an Administrative Law Judge (AL.�. If you wish to have such a hearing, please send me a
letter stating that you are contesting the facts. You will then be sent a"Notice of Hearing," so
you will know when and where to appeaz, and w�hat the basis for the hearing will be.

1. The back entrance to the estabiishment sha11 remain locked to prevent entry
to the establishment at all times, except for daytime (7:00 a.m. to 6:00 p.m.)
deliveries, and emer�ency exitin�. A si�n shall be installed on the inside and
outside of the rear door that reads, in lar�e letters, "Emer�ency Exit Only--No
entrance except for daytime deliveries".
2. No employees or patrons of Jazzville shall use, occupy, or loiter in or on any
space in the Rossmor Buildin;, outside of the licensed premises.
3. A metal detector shall be used by the estabiishment to prevent the
introduction of weapons on the licensed premises. Every customer shall be checked
prior to entry, and reentry, no exceptions.
4. The management of the establishment must call police for assistance when
there are altercations between patrons or between patrons and empioyees of the
establishment. If patrons are ejected from the establishment for threatening or
violent behavior, the police shall be called immediately. No exceptions.
�. Manajement will ban people from the establishment who were previously
arrested, or asked to leave the establishment, due to their involvement in fi?hts or
altercations.
6. Management will provide the names and birth dates of a11 employees and
security personnel to the LIEP Office so that criminal background checks can be
conducted on these individuals.
7. Exterior video surveillance cameras shall be installed to monitor outside
activity in front of the licensed premises.

I, Officer Spencer, was working in an undercover capacity for the Vice Unit . I was with Sgts
Ramstad and Burke. We were conducting compliance checks at various bars in the city.
While conducting a check of Jazzville Bar, 488 N. Robert St., I entered the bar and I was asked
for my identification by one o thf�ie ouncers. I showed him my �sconsin DL and was let in. The
second employee that was at the door was scanning peop]e with a metai detector for weapons.
The second person told me to go right in and failed to scan me or check me for weapons. This is
a violation of the city's license requirements for the bar.
Sgts Ramstad and Burke entered the baz after me. They identified themselves with their police
badges. The person using the metal detector person scanned them both for weapons. Sgt
Ramstad and I located the manager, Leroy Daniels, and explained what occurred and made him
awaze of the violation.

mail, my resturaunL manager found it on the street.
But, I would srill like to address this matter.
At the time the off�cer came in, my hired help and
my self was proceeding to clear the floor,we were in
the process of closing the bar for the evening.
I have two people on the door Fri.,Sat.,and Sun.
They are new people,and even though they are informed
to card and scan everyone, the officer just slipped by
them. There's really nothing else I can say except,
that I'm doing all thats in my power to comply with
your stipulations. Theres nothing more that I can do
except try harder not to let that happen again.

The Director of the Office of License, Inspections and Environmental Protection is
recommending that adverse action be taken against your license. The basis for the adverse action
is:
On November 16,1998 }�ou agreed to certain conditions being part of }�our
license as a result of a shooting outside of Jazzville. One of the conditions
was that all customers �i�ould pass through a metal detector to determine the
presence of any �; eapons. On \ o�•ember 21, 1998, an undercover police
office entered Jazzviile without an emplo}�ee scanning or checkina him for
weapons. This is a violation of the condition placed on your license.
If you do not dispute the above facts please send me a letter with a statement to that effect. The
matter will then be scheduled for a hearing before the St. Paul City Council to determine what
penalTy, if any, to impose. You will ha�•e an opportunity to appeaz and speak on your own
behalf, or to have someone appear there for you.
On the other hand, if you wish to dispute the above facts, I wili schedule an evidentiary hearing
before an Administrative Law Judge (AL.�. If you wish to have such a hearing, please send me a

1. The back entrance to the estabiishment sha11 remain locked to prevent entry
to the establishment at all times, except for daytime (7:00 a.m. to 6:00 p.m.)
deliveries, and emer�ency exitin�. A si�n shall be installed on the inside and
outside of the rear door that reads, in lar�e letters, "Emer�ency Exit Only--No
entrance except for daytime deliveries".
2. No employees or patrons of Jazzville shall use, occupy, or loiter in or on any
space in the Rossmor Buildin;, outside of the licensed premises.
3. A metal detector shall be used by the estabiishment to prevent the
introduction of weapons on the licensed premises. Every customer shall be checked
prior to entry, and reentry, no exceptions.
4. The management of the establishment must call police for assistance when
there are altercations between patrons or between patrons and empioyees of the
establishment. If patrons are ejected from the establishment for threatening or
violent behavior, the police shall be called immediately. No exceptions.
�. Manajement will ban people from the establishment who were previously
arrested, or asked to leave the establishment, due to their involvement in fi?hts or
altercations.
6. Management will provide the names and birth dates of a11 employees and
security personnel to the LIEP Office so that criminal background checks can be
conducted on these individuals.
7. Exterior video surveillance cameras shall be installed to monitor outside
activity in front of the licensed premises.

I, Officer Spencer, was working in an undercover capacity for the Vice Unit . I was with Sgts
Ramstad and Burke. We were conducting compliance checks at various bars in the city.
While conducting a check of Jazzville Bar, 488 N. Robert St., I entered the bar and I was asked
for my identification by one o thf�ie ouncers. I showed him my �sconsin DL and was let in. The
second employee that was at the door was scanning peop]e with a metai detector for weapons.
The second person told me to go right in and failed to scan me or check me for weapons. This is
a violation of the city's license requirements for the bar.
Sgts Ramstad and Burke entered the baz after me. They identified themselves with their police
badges. The person using the metal detector person scanned them both for weapons. Sgt
Ramstad and I located the manager, Leroy Daniels, and explained what occurred and made him
awaze of the violation.

But, I would srill like to address this matter.
At the time the off�cer came in, my hired help and
my self was proceeding to clear the floor,we were in
the process of closing the bar for the evening.
I have two people on the door Fri.,Sat.,and Sun.
They are new people,and even though they are informed
to card and scan everyone, the officer just slipped by
them. There's really nothing else I can say except,

The Director of the Office of License, Inspections and Environmental Protection is
recommending that adverse action be taken against your license. The basis for the adverse action
is:
On November 16,1998 }�ou agreed to certain conditions being part of }�our
license as a result of a shooting outside of Jazzville. One of the conditions
was that all customers �i�ould pass through a metal detector to determine the
presence of any �; eapons. On \ o�•ember 21, 1998, an undercover police
office entered Jazzviile without an emplo}�ee scanning or checkina him for
weapons. This is a violation of the condition placed on your license.
If you do not dispute the above facts please send me a letter with a statement to that effect. The
matter will then be scheduled for a hearing before the St. Paul City Council to determine what
penalTy, if any, to impose. You will ha�•e an opportunity to appeaz and speak on your own
behalf, or to have someone appear there for you.
On the other hand, if you wish to dispute the above facts, I wili schedule an evidentiary hearing
before an Administrative Law Judge (AL.�. If you wish to have such a hearing, please send me a

1. The back entrance to the estabiishment sha11 remain locked to prevent entry
to the establishment at all times, except for daytime (7:00 a.m. to 6:00 p.m.)
deliveries, and emer�ency exitin�. A si�n shall be installed on the inside and
outside of the rear door that reads, in lar�e letters, "Emer�ency Exit Only--No
entrance except for daytime deliveries".
2. No employees or patrons of Jazzville shall use, occupy, or loiter in or on any
space in the Rossmor Buildin;, outside of the licensed premises.
3. A metal detector shall be used by the estabiishment to prevent the
introduction of weapons on the licensed premises. Every customer shall be checked
prior to entry, and reentry, no exceptions.
4. The management of the establishment must call police for assistance when
there are altercations between patrons or between patrons and empioyees of the
establishment. If patrons are ejected from the establishment for threatening or
violent behavior, the police shall be called immediately. No exceptions.
�. Manajement will ban people from the establishment who were previously
arrested, or asked to leave the establishment, due to their involvement in fi?hts or
altercations.
6. Management will provide the names and birth dates of a11 employees and
security personnel to the LIEP Office so that criminal background checks can be
conducted on these individuals.
7. Exterior video surveillance cameras shall be installed to monitor outside
activity in front of the licensed premises.

I, Officer Spencer, was working in an undercover capacity for the Vice Unit . I was with Sgts
Ramstad and Burke. We were conducting compliance checks at various bars in the city.
While conducting a check of Jazzville Bar, 488 N. Robert St., I entered the bar and I was asked
for my identification by one o thf�ie ouncers. I showed him my �sconsin DL and was let in. The
second employee that was at the door was scanning peop]e with a metai detector for weapons.
The second person told me to go right in and failed to scan me or check me for weapons. This is
a violation of the city's license requirements for the bar.
Sgts Ramstad and Burke entered the baz after me. They identified themselves with their police
badges. The person using the metal detector person scanned them both for weapons. Sgt
Ramstad and I located the manager, Leroy Daniels, and explained what occurred and made him
awaze of the violation.

for 5:3� p.m., Wednesday, February 3,1999 in the City Council Chambers, Third Floor, Saint

the City Council for their consideration. This is an uncontested hearing, in that the facts
