The sound level variance will allow sound levels in excess of those in Chapter 293
(Saint Paul Noise Ordinance) for Riverfest to be held July 28 - August 6, 1989 at
Harriet Island in Saint Paul. The variance provides that at all times through the
duration of said event, that it conforms to the conditions and limitations set forth
in the attached resolution. A public hearing was held on July 6, 1989.
ADVANTACiES IF APPROVED:
Riverfest will be able to provide entertainment that produces sound levels exceeding
the limits set in Chapter 293 (Saint Paul Noise Ordinance),
DISADVANTA(iES IF APPROVED:
Sound levels at the mix of 110 dba will be more than twice as loud as the 100 dba
allowed for the 1987 and 1988 Riverfest events. �
DISADVANTAOES IF NOT APPROVED:
Riverfest would be unable to provide entertainment such as live music that would
meet the sound level limits as set in Chapter 293 (Saint Paul Noise Ordinance) .

Dear Mayor Latimer:
By action of the City Council y st day, a noise variance was granted for
RiverFest 1989 at a decibel lev 1 at would in effect double the amount of
perceived sound over what was a lo d last year.
The staff of the Environmental ea th Division of Community Services
recommended that the decibel le el of sound be limited to a maximum of 103
dBAs. This is 3 dBAs over the ax' um permitted during last year's festival.
Instead of following the Enviro e tal Health staff recommendation, the
Council authorized a maximum le el of 110 dBAs.
I maintain that the sound level w ich were agreed upon after negotiations
last summer for RiverFest 1988 ro ided a maximum sound level (100 dBAs)
adequate for entertainment purp se , and that we should not exceed those
agreed upon limits. i
For these reasons, I request th t ou veto the resolution pertaining to this
noise variance.

Saint Paul City Council
The residents of Irvine Pa k experience the trials and
tribulations of living nex o downtown Saint Paul on a
daily basis . We are bomba' d d by the noise of trains ,
trucks , barges , and helico t rs throughout the day . T�iost of
these irritations diminish i frequency in the evening , when
our children are going to e . t•7ith that in mind , we
respectfully request the Cit Council not approve a variance
that would raise the noise l vel and extend the time of the
Riverfest activities beyond he compromise reached last
year .
Our association and an exper in the neighborhood worked
with City staff and a cons l ant two years age to study the
levels of noise that reached into nearby communities .
Recommendations were made an a compromise reached which we
believed everyone could li've with. That joint effort and
the resulting controls are , e believe , the reason there
were relatively few complain s last year .
tJe want to support efforts t make downtown , and especially
the riverfront � an area t at everyone can enjoy. Please do
not rekindle the negatives' a event like this can create for
those of us who have to li've in the area .

To the City Council:
It is with great sense of frustration, ve some paranoia, that I write to
you. It is not only on my behalf, b t al o that of my neighbors', that I
address this letter to protest the ac on of RiverFest Educational Fairs, Inc.
Attached to this letter, under the le er ead of the Leech/McBoal, Irvine
Park, and Sherman Forbes Comm i Crime Watch, is a petirion which
coincides with my protest. This pe 'rio represents the west area of this
Crime Watch and is near unanimo s f r the residents of the area; only rime
and circumstances prevented unan mi . Under separate cover is the
petirion of the Little Sisters of the P or
I wish to protest first the procedur �s o Riverfest Educational Fairs, Inc.
which have repeated themselves fr m ears past. Once again, a contract has
been signed, probably to the ignor 'nc of you the City Council. Once again,
a key provision of the contract: 80 a advance applicarion for sound
variance, has been ignored. Once gai , little publicity was given for this
very hearing before you. Once aga n, ttle advance norice was given our
community to appear before you t te 'fy. And once again, employed
individuals are discriminated again t b the city council by the scheduling of
testimony in the workday hours.
The substance of the matter before o is the doubling of sound levels, as
well as increase of hours. Our co m ity is adamantly opposed to any
sound increase, both in volume an in time. In my personal case, those two
weeks I shall be working fifteen ho rs ays, minimum, and am at wits end
trying to figure how I shall be able p epare classes, work forty hours,
then teach, and then maintain som se blance of sanity with this noise.
