The Council of the City o aint Paul has the authority to
provide for hearings conce n ng licensed premises, and for
adverse action against s ch licenses , under Chapter 310 ,
including . sections 314J. �5 nd 31 �.06 , of the Saint Paul
Legislative Code. In the c s .of licenses for intoxicating and
non=intoxicating liquor , au h ritX is also conveyed by section
34�A.415 of the Minnesota St t tes. Adverse action may include
revocation, suspension, fine a d other penalties or conditions.
Evidence will be presented t t e judge which m ay lead to adverse
action against all the licen e you hold at the above premises as

The basis for adverse a t ' on is that on April 14, 1989, at
about 1:50 a.m., you and or your employee allowed persons to
display and consume al oh lic beverages after closing , as
well as serving or dis e sing such beverage. Two weeks
earlier officers observ d mployees who had been drinking,
on the premises at abou 6 4!4! a.m.
You have the right to be re re ented by an attorney before and
during the hearing if you so choose, or you can represent
yourself. You may also hav a person of your choice represent
you, to the extent not proh bited as unauthorized practice of
law. _
The hearing will be conducted i accordance with the requirem ents
of sections 14.57 to 14.62 o t e Minnesota Statutes, and such
parts of the procedures und r ection 316.05 of the Saint Paul
Legislative Code as may be a pl cable. �
At hearing , the Administrat v Law Judge will have all parties
identify them selves for the e ord. Then the City will present
its witnesses and evidence, ac of whom the licensEe or attorney -
may cross=examine. The lice s e may then offer in rebuttal any
witnesses or evic]ence it ma ish to. present, each of whom the
City attorney may cross=exa in . The Administrative Law Judge
may in addition hear relevant a d m aterial testim ony from persons
not presented as witnesses w ave a substantial interest in the
outcome of the proceeding; f r example, the owners or occupants
of property located in close p oximity to the licensed premises �
may have substantial intere t in the outcome of the proceeding.
Concluding arguments may be ma e by the parties. Following the
hearing, the Judge will prep r Findings of Fact, Conclus.ions of
Law, and a specific recommen a ion for action to be taken.
You should bring to the h a ing all docum ents, records and
witnesses you will or ma eed to support your position.
Subpoenas m ay be available t ompel the attendance of witnesses
or the production of docum n s in conformity with Minnesota
Rules, part 140g.70B0.

WHEREAS , the most rec t fire fighter examination given
by the City of Saint Paul a been attacked by the Minnesota
Department of Human Rights a being discriminatory to women;
and
WHEREAS , in conjunctio ith these charges the Minnesota
Department of Human Rights in Rugust 1985 sought and received
an order of the court preve t ' g the city from hiring any fire
fighters until the trial the charges has been completed,
and a determination and remed stablished; and
WHEREAS , as a result o this hiring "freeze" the Fire
Department is incurring serio s problems in regard to availability
of personnel for the paramed c program, availapility of i�ersonnel
for appointment to regular ire fighting duties and serious
financial problems because o overtime required to meet the
problem of the hiring freeze ; a d
WHEREAS , it is clearl n the best interest of the City
of Saint Paul and the cit z s of the City of Saint Paul to
resolve this situation th u h discussion and settlement, if
possible ; now, therefore, be it
RESOLVED , that the Coun il of the City of Saint Paul declares
its intent to continue nego ia ions with the Minnesota Department
of Human Rights , the fire f' ghter ' s union, the applicants who
passed the fire fighter ' s te t, the parties who did not pass
the test and brought sui , and any other parties of record
in an attempt to resolve th s issue through settlement ; and,
be it
FURTHER RESOLVED, tha the Council hereby requests the
office of the City Attorne o review all issues closely with
