CITY OF A1 T PAUL INTERDEPARTMEN AL MEMORANDUM TO: Peter White Room 218 City Hall FROM: Mike Klassen 800 City Hall Annex DATE: Aprii 10, 1989 SUBJECT: Permanent easement to con tru t, operate and maintain street lighting on the north si e Kellogg Description for permanent easement requi ed or street lighting for the East Kellogg Gateway NPP Project is as follows: In the matter of condemning and takin a ermanent street lighting easement to construct, operate and maintain street I gh ing planned to be installed in conjunction with the East Kellogg Gateway Neighb rh od Partnership Program project, over and across that part of Kittson's Addition, L ts and 8, Block 62, Lots 7 and 8, Block 63 and including vacated Olive Street, lying so th of a line beginning at a point on the east line of Lot 6, Block 62, Kittson's Addition. ai point being 8 feet north of the north line of Kellogg Boulevard, thence easterly to p int on the west line of John Street, said point being 9.3 feet north of the north line of el ogg Boulevard, except the portion previously condemned and taken for a permanen si ewalk easement in conjunction with sidewalk file S-11135 and approved by Council ile No. 280664. It is my understanding that this easement ill e given to the city at no cost in order to allow the street lighting to be constructed as the ex' ting 5' sidewalk does not allow enough space to allow for the light standards to be instal d nd still maintain space for pedestrians. Also, since CIB funds are being used to constru t t is system, the improvements must be on public property; therefore requiring the easemen . Attached is a modified drawing of the side al easement showing the street lighting easement. If you have any questions, feel free to giv m a call at 2926293.
